Theplaintiff,MichaelJ.Reynolds,workingasanundercoveragentfortheMetropolitanNashvillePoliceDepartmentwasshotbyapoliceofficerduringadrugraid.TendayslatertheplaintiffsignedareleaseinconsiderationoftheMetropolitanGovernmentspaymentofhismedicalbillsandthedamagetohiscar.  WithintheoriginalstatuteoflimitationstheplaintifffiledanactionagainsttheMetropolitanGovernmentanditsagents.Thetrialjudgegrantedthedefendantsmotionforsummaryjudgment,butthiscourtreversedbecausewefoundfactualdisputesintherecordontheplaintiffscontentionthatthereleasewassignedunderduress.ThiscourtsjudgmentwasfiledonFebruary21,1991andthemandateissuedonApril1,1991.OnMarch10,1995thedefendantsfiledamotiontodismissforfailuretoprosecute  OnApril10,1995thelowercourtdismissedtheplaintiffscase.Intheorderofdismissalthecourtrecitedthefollowingfacts:8 8  1) theCourtofAppealsissuedamandateApril1,1991,remandingthiscasetothecircuitcourtsfortrial;8 8  2) theHonorableMariettaShipleyenteredanOrderSeptember4,1991,transferringthecasetotheFifthCircuitCourtandrecommendingthatthecasebesetfortrialwithin90days;8 8  3) theDefendantsdepositionswerescheduledbyPlaintiffsattorneyforNovember17,1992,attheofficeofPlaintiffsattorney.Defendantswerepresent;Plaintiffsattorneyfailedtoappear;8 8  4) ayearlater,November4,1993,noticewassenttoPlaintiffsattorneybythecourtclerkthatthecasewouldbedismissedunlessamotiontosetfortrialwasfiledandheardbythetrialjudgewithin30days;8 8  5) amotiontosetwasthenfiledbyPlaintiffNovember12,1993,anditwasbroughttothetrialjudgesattentionthatPlaintiffsattorneyhadfailedtoappearforthedepositionsayearearlier;8 8  6) anOrderwasenteredFebruary11,1994,assessing$200againstPlaintiffsattorneyasDefendantMetropolitanGovernmentsreasonableexpensesforhisfailuretoappearforthedepositions;8 8  7) theOrderspecificallystatedthatuponpaymentoftheassessmentPlaintiffcouldobtainacourtdateandsetthiscasefortrial;8 8  8) onFebruary14,1995,overoneyearlater,thecourtclerkagainsentnoticetoPlaintiffsattorneythatthecasewouldbedismissedifanOrdersettingthecasefortrialwasnotenteredwithin30days;8 8  9) onMarch6,1995,elevendaysafterPlaintiffhadfiledamotiontosetandoveroneyearafterthisCourthadorderedPlaintiffsattorneytopaythe$200assessment,DefendantMetropolitanGovernmentreceivedacheckfor$200fromPlaintiffsattorney.  Theplaintiffdoesnotdisputeanyofthefactsrecitedbythecourt.Instead,heseekstoblamethedefendantsforobstructiveanddilatorytactics.Thelowercourtfoundthat therecordfailstosupportthiscontentionnorhasplaintiffscounselsoughttheassistanceofthecourt.Allofthecourtsfindingsaresupportedbytherecord.SeeRule13(d),Tenn.R.App.Proc.̛̜@ @ II.   Rule41.02(1)oftheTennesseeRulesofCivilProcedureallowsadefendanttomovefordismissalofanyclaimagainsthimfortheplaintiffsfailuretoprosecute.ThiscourthasheldthatthedismissalofanactionunderRule41.02(1)iswithinthediscretionofthetrialjudgeandtheappellatecourtswillnotdisturbthedecisionintheabsenceofanaffirmativeshowingthatthetrialjudgeactedunreasonably,arbitrarily,orunconscionably.SeeKotilv.HydraSports,no.01A019305CV00200,slipop.at6,filedOct.5,1994.  Weareoftheopinionthatthetrialcourtdidnotabuseitsdiscretionindismissingthiscase.Plaintiffscounselhasneverexplainedwhyfourteenmonthspassedafterthetrialcourtrecommendedthatthecasebesetfortrialwithinninetydaysbeforehescheduledthedepositionsofthetwoindividualdefendants,orwhy,whentheyappearedathisofficebyagreementonNovember17,1992,thedepositionswerenottaken.Afterthecourtorderedplaintiffscounseltoreimbursethedefendantsfortheirexpensesincurredintheaborteddepositionsanotheryearpassedbeforetheassessmentwaspaid.AnymovementinthecasewaspromptedbynoticefromthecourtthatdismissalwasϜimminent.WhenthedefendantsmadetheirmotiontodismissinMarchof1995discoveryhadnotevenbegunand,sofarasthisrecordshows,noneofthemedicalproofhadbeentaken.̀  ThejudgmentofthelowercourtisaffirmedandthecauseisremandedtotheCircuitCourtofDavidsonCountyforanyfurthernecessaryproceedings.Taxthecostsonappealtotheappellant.      _____________________________      BENH.CANTRELL,JUDGECONCUR:̜_______________________________HENRYF.TODD,PRESIDINGJUDGEMIDDLESECTION̜_______________________________SAMUELL.LEWIS,JUDGE     ќ
