TheJuvenileCourtorderwasenteredonthe3rddayofMay,1996,andprovidedinpertinentpart:0 0 1. ThatJonathanAlexanderRogoishisadependentandneglectedchildwithinthemeaningofthelaw,isherebymadeawardofthisCourt,andthetemporarycustodyofthesaidchildisawardedtotheStateofTennessee,DepartmentofHealth/ChildrensServices,formerlyDepartmentofHumanServices,effectiveJuly13,1996,withtheauthoritytoconsenttoanynecessarymedical,surgical,hospitalorinstitutionalcare.0 0 2. ThattheDefendant,JulieRogoish,shallhaverightofsupervisedvisitationwithsaidchilduponherinitiationaccordingtotherulesandregulationsoftheStateofTennessee,DepartmentofHealth/ChildrensServices.0 0 3. Theplanofcare,attached,isapproved.TheCourtnotesthatthegoalisreunificationandthattheprimaryresponsibilitythatthemotherhasnotfinishedistoundergoapsychiatricandpsychologicalexaminationandfollowallrecommendations.Themotherwillcooperatewithallserviceproviders.TheDepartmentshalladviseserviceprovidersthatthemothermaynotpresentaccurateinformation.  DefendanttimelyperfectedanappealtotheKnoxCountyCircuitCourtpursuanttoT.C.A.371159.TheCircuitCourtsetthecasefortrialonJuly30,1997,butonJanuary31,1997,theTrialCourtenteredanorderdismissingtheappeal withoutprejudicebecausetheCourtfoundtheDepartmenthad,inJanuary1997,filedapetitiontoterminatethedefendantsparentalrightsinJuvenileCourtofKnoxCounty.ThemotherhasappealedtothisCourt.  T.C.A.371159(c)provides:0 0 whenanappealhasbeenperfected,thejuvenilecourtshallcausetheentirerecordinthecase,includingthejuvenilecourtsfindingsandwrittenreportsfromprobationofficers,professionalcourtemployeesorprofessionalconsultants,tobetakenforthwithtotheCircuitCourtwhosedutyitis,eitherintermorinvacation,tosetthecaseforanearlyhearing.Whenanappealistakenfromajuvenilecourtsdecisionthatinvolvestheremovalofachildorchildrenfromthecustodyoftheirnaturaland/orlegalparentsorguardian...suchhearingshallbeheldwithinfortyfive(45)daysofreceiptofthefindingsandreports.Initsorder,thecircuitcourtshallremandthecasetothejuvenilecourtforenforcementofthejudgmentrenderedbythecircuitcourt.Appealsfromanorderofthecircuitcourtpursuanttothissubsectionmaybecarriedtothecourtofappealsasprovidedbylaw.(Emphasissupplied).TheCircuitCourtsactioninsettingthiscasemorethanayearafterthedecisioninSessionsCourt,i.e.,July30,1997,constitutesanimpermissibledelay.Moreover,theTrialCourtsdismissaloftheappealdeprivedboththemotherandchildoftheirrightsaffordedbytheStatute.Whilethe45daytimeframeisdirectory,SeeKitev.Kite,1997WL259332(Tenn.)1997,theGeneralAssemblyclearlyintendedthatcaseswhereaparentisdeprivedofcustodyofachildbegivenpreferenceandprocessedexpeditiously.Suchcasesaretotakeprecedenceoverothercasesexceptthosewhicharealsostatutorilymandatedtobeheardwithinaspecifictimeframe.  T.C.A.371159gavetheplaintifftherighttoatrialdenovobeforetheCircuitCourtifherappealwasproperlyperfectedandshewasentitledtoanexpeditioushearing.Thesummarydismissaloftheappealhasnobasisinlaw.Partieswhobringthemselveswithinthestatutoryprovisionprovidingforanappealareentitledtotheappealasamatterofright.SeeCaldwellv.HodsdensHeirs,69Tenn.305(Tenn.1978).  TheactionoftheTrialCourtisvacatedandthecauseremanded.TheTrialCourtisdirectedtogiveprecedencetothiscaseonitsdocketoveranycasesthatdonotenjoyastatutorypreferenceforanexpeditedhearing.
