LarryRussellwasconvictedofrape,andhewassentencedtoeighteenyearsimprisonment.OnOctober19,1993hewasreleasedonparole.OnMarch10,1994,Mr.RussellwasarrestedinDeSotoCounty,Mississippiforsellingarockofcrackcocainetoanundercoverinformantfor$20.TheBoardofParolessubsequentlyinitiatedparolerevocationproceedingsagainsthim.FollowingahearingonJune23,1994,Mr.Russellsparolewasrevokedonthegroundsofleavingthestatewithoutpermission,andfailuretoreporthisarresttohisparoleofficer.  Mr.RussellsubsequentlyfiledaPetitionforHabeasCorpuswiththeGeneralSessionsCourtofShelbyCounty.ThePetitionwasdismissed.HethenappealedtotheCourtofCriminalAppeals.Followingthedismissalofthatappealforlackofjurisdiction,Mr.Russellfiledthetwopetitionsforwritofcertiorariwhicharethesubjectofthisappeal.ThechancerycourtdismissedbothpetitionsonJune30,1995.  Thetwopetitionsrepeatedtheallegationsoriginallystatedinthepetitionforhabeascorpus.However,webelievethatbecauseofthelimitednatureofthereliefthatmaybegrantedunderaWritofCertiorari,seePowellv.ParoleEligibilityReviewBoard,879S.W.2d871(Tenn.App.1994),theonlyrelevantissuebeforethechancerycourtwasMr.RussellschallengetothemannerinwhichtheBoardofParolesreacheditsdecisiontorevokehisparole.InourorderofJanuary31,1996,wenarrowedtheissuetothequestionofwhethertheBoardbaseditsdecisionuponimproperevidence.@ II.   Unfortunately,therecordoftherevocationproceedingsissomewhatsparse,andtheprosebriefoftheappellantisnotofmuchhelptousindeterminingwhytheevidencethattheboardbaseditsdecisionuponshouldbeconsideredobjectionable.Mr.RusselladmitsthathewasincustodyintheStateofMississippi,butinsiststhathewasnotbooked,fingerprintedorphotographed.  Whileanindictmentorconvictionforanyfelonyormisdemeanorcommittedduringparoleconstitutesprobablecausethattheparoleehasviolatedtheconditionsofhisparoleinanimportantrespect,Tenn.CodeAnn.4028121(c),therevocationofMr.Russellsparolewasnotbasedonindictmentorconviction,butonnarrowergrounds.ThusMr.RussellsallegationsconcerningthelackofanauthenticatedchargingdocumentfromtheStateofMississippiinnowayinvalidatedtheParoleBoardsdecision.  Itiswellestablishedthatthefullpanoplyofrightsthataredueadefendantinacriminalprosecutiondonotapplyinaparolerevocationhearing.TheBoardofParolesisfreetoconsiderevidencethatwouldnotbeadmissibleinacriminaltrial,andtobaseitsrevocationuponalesserstandardofproofthanwasrequiredtoinitiallyconvict.SeeMorrisseyv.Brewer,408U.S.471,92S.Ct.2593,33L.Ed.2d484(1972).  TheappellanthasadmittedthathewasincarceratedintheStateofMississippi,andhehasnotclaimedthathereceivedpermissiontoleaveTennessee,northatheevernotifiedhisparoleofficerofhisarrest.Hisownstatements,standingbythemselves,areprobablysufficienttoestablishtheconductforwhichhisparolewasrevoked.Leavingthestatewithoutpermission,andfailingtoreportallarreststohisparoleofficerarebothviolationsoftheconditionsthatwereimposedonMr.Russellatthetimehewasreleased.  Havingfoundaviolation,theBoardcanexerciseagreatdealofdiscretionindeterminingwhethertheparoleesconductwassufficientlyserioustowarrantarevocationofparole.Infact,thelegislaturehasdeclaredthat [t]heboardmayrevoketheprobationaryparoleforanyreasonsatisfactorytoit.Tenn.CodeAnn.4028115(e).Underthecircumstancesofthiscase,wedonotfindthattheBoardbaseditsdecisionuponimproperevidence,nordowefindanythingunreasonableorarbitraryinitsaction.@ IV.
