àSteve€H.€Sanders€and€Mary€¢Milbourn£€Sanders€were€divorced€in€JuneÏ1983.€€Ms.€Sanders€received€custody€of€their€two€children,€and€Mr.€SandersÏwas€ordered€to€pay€$116€per€week€in€child€support.€€The€parties€have€hadÏfrequent€judicial€skirmishes€over€their€respective€support€obligations€everÏsince.€€In€1988,€the€trial€court€increased€Mr.€œSandersððs€child€supportÏobligation€to€$225€per€week€and€approved€his€agreement€to€pay€even€moreÍsupport€voluntarily.€€The€voluntary€child€support€payments€ceased€when€Mr.ÏSanders€remarried€in€1989.ÌÌà àSeveral€years€later€Ms.€Sanders€again€requested€an€increase€in€childÏsupport.€€The€trial€court€increased€the€amount€of€Mr.€Sandersððs€child€supportÏto€$4,537€a€month.€€Mr.€Sanders€appealed€this€decision,€and€while€the€appealÏwas€pending,¢× ƒ5 ××  ×£€Ms.€Sanders€filed€a€contempt€petition€alleging€that€Mr.€SandersÏhad€violated€the€1983€divorce€decree€by€not€paying€his€child€support€on€time,Ïby€failing€to€provide€health€insurance€for€the€children€or€to€pay€their€medicalÏexpenses,€and€by€participating€in€a€wrongful€execution€on€her€automobile.¢× ƒ6 ××  ×£€ÏThe€trial€court€dismissed€Ms.€Sandersððs€contempt€petition€in€August€1994Ïbecause€Ms.€Sanders€had€obstructed€pre„trial€discovery€regarding€herÏcontempt€petition.ÌÌà àOn€April€11,€1995,€the€trial€court€entered€an€order€purporting€toÏresolve€all€pending€post„divorce€disputes.€€The€order€stated€that€Mr.€SandersÏowed€$32,830€in€child€support€for€the€period€from€February€1992€to€JuneÍ1995× ƒ7 ××  ×€and€directed€Mr.€Sanders€to€pay€this€amount€by€ð ð[¢n]o£€later€thanÏSeptember€15,€1995,€at€1:00€p.m..ðð€€It€also€provided€that€ð ð[¢i]f£€the€$32,830.00Ïis€not€paid€in€full€by€this€date€and€time,€an€immediate€attachment€order€will€beÏissued€by€this€Court€against€Steve€Sanders€who€will€immediately€begin€servingÏten€(10)€days€in€jail€for€contempt€of€this€Order.ððÌÌà àMr.€Sanders€paid€the€balance€of€the€required€amount€on€September€15,Ï1995€but€missed€the€1:00€p.m.€deadline€by€several€hours.€€Accordingly,€theÏtrial€court,€apparently€on€its€own€initiative€and€without€notice€to€Mr.€Sanders,Ïissued€an€order€on€September€15,€1995,€directing€that€Mr.€Sanders€be€arrestedÏand€incarcerated€for€ten€days€in€the€Sumner€County€jail.€€Mr.€SandersÏimmediately€moved€to€quash€and€to€stay€the€order.€€During€a€hearing€onÏSeptember€19,€1995,€Mr.€Sanders€explained€that€he€had€been€unable€to€makeÏthe€€required€payments€until€he€received€his€paycheck€and€that€he€did€notÏreceive€his€paycheck€until€mid„afternoon€on€September€15,€1995.€€Based€onÏthis€proof,€the€trial€court€quashed€its€original€order€and€entered€a€new€orderÏrequiring€Mr.€Sanders€ð àThe€sanctions€in€this€case€bear€all€the€earmarks€of€criminal€contemptÏsanctions.€€They€were€imposed€solely€to€punish€Mr.€Sanders€for€failing€to€payÏoff€his€child€support€obligation€by€the€deadline€in€the€April€11,€1995€order.€ÏThey€could€not€have€been€intended€to€coerce€him€into€complying€with€theÏpayment€deadline€in€the€April€11,€1995€order€because€that€deadline€hadÏalready€passed.× ƒ8 ××  ×€€The€incarceration€was€for€a€definite€term€and€requiredÏcommunity€service€work€which€is€normally€a€condition€of€criminalÏprobation.× ƒ9 ××  ×€€In€addition,€they€were€imposed€by€the€trial€court€on€its€ownÏmotion€without€a€request€by€Ms.€Sanders.€€Thus,€despite€Mr.€SandersððsÏcharacterization€of€the€proceeding€as€a€civil€contempt€proceeding,€we€find€thatÏit€was€a€criminal€contempt€proceeding.ÌÌà@ ƒ: ××  ×£€the€privilege€against€self„incrimination,¢× ƒ; ××  ×£€and€the€requirement€thatÏtheir€guilt€be€proven€beyond€a€reasonable€doubt.¢× ƒ< ××  ×£€€ÌÌà àMr.€Sandersððs€failure€to€meet€the€deadline€in€the€April€11,€1995€orderÏwas€not€committed€in€the€courtððs€presence€and€therefore€could€not€form€theÏbasis€for€a€summary€contempt€proceeding€notwithstanding€the€self„executingÏlanguage€of€the€April€11,€1995€order.€€Thus,€the€trial€courtððs€issuance€of€an€exÏparte€attachment€order€on€September€15,€1995€was€improper€and€an€abuse€ofÏdiscretion.€€The€trial€courtððs€issuance€of€modified€criminal€contempt€sanctionsÏon€September€20,€1995€following€a€hearing€was€also€an€abuse€of€discretionÏbecause€Mr.€Sanders€was€not€provided€with€any€of€the€procedural€safeguardsÏto€which€a€person€facing€sanctions€for€criminal€contempt€is€entitled.€ÏAccordingly,€the€imposition€of€criminal€contempt€sanctions€against€Mr.ÏSanders€must€be€vacated.€€ÌÌà@
