àThis€is€an€unemployment€compensation€case.€€Petitioner,€Wanda€R.ÏSargent,€appeals€from€the€order€of€the€trial€court€dismissing€her€petition€forÏcertiorari€and€affirming€the€decision€of€the€Board€of€Review€that€disallowed€herÏclaim€for€unemployment€compensation€benefits.Ìà àSargent€was€employed€by€Roane€Hosiery,€Inc.€as€a€folder€on€July€26,€1993.€ÏShe€worked€53€hours€a€week,€nine€hours€a€day€Monday€through€Friday€andÏeight€hours€on€Saturday.€€Sargent€was€pregnant,€and€on€February€14,€1994,€sheÍvisited€a€doctor€due€to€exhaustion€from€her€long€hours€and€her€pregnancy.€ÏSargentððs€doctor€advised€her€to€take€two€weeks€off€work,€which€she€did€startingÏFebruary€14,€1994.€€On€March€1,€1994,€Sargent€called€Roane€and€told€herÏemployer€that€she€could€work€six€to€seven€hours€a€day,€but€not€nine€hours€aÏday.€€The€next€day,€she€presented€a€doctorððs€letter€stating€that€nine€hours€a€dayÏis€too€exhausting€for€a€pregnant€woman.€€However,€Jim€Rummell,€her€foreman,Ïtold€her€that€Roane€did€not€have€any€part„time€work.€€Sargent€did€not€return€toÏwork€for€Roane€or€receive€any€wages€from€Roane€after€February€14,€1994.€ÏSargent€testified€that€she€did€not€quit,€but€Rummell€testified€that€he€was€underÏthe€impression€that€she€quit€because€there€were€no€part€time€jobs€at€Roane.€ÏSargent€was€kept€on€the€payroll€at€Roane€for€insurance€purposes€betweenÏFebruary€14,€1994€and€May€16,€1994.€€On€May€16,€1994,€Roane€informedÏSargent€that€she€was€terminated€based€on€its€company€policy€of€terminatingÏpersons€who€have€not€worked€for€ninety€days.Ìà àSargent€filed€a€claim€for€unemployment€compensation€on€March€15,Ï1994.€€The€Tennessee€Department€of€Employment€Security€(TDES)€denied€theÏclaim€on€the€grounds€that€she€was€on€a€leave€of€absence€and€was€ineligible€underÍT.C.A.€ðð€50„7„302(a)(4).× ƒ' ××  ×€€Sargent€appealed€this€denial€and€a€hearing€was€heldÏon€June€8,€1994€before€the€Appeals€Tribunal.€€The€Appeals€Tribunal€found€thatÏSargent€was€unemployed€under€T.C.A.€ðð€50„7„302€and€remanded€the€case€backÏto€TDES€to€adjudicate€the€separation€issue€under€T.C.A.€ðð€50„7„303.€€OnÏremand,€TDES€found€that€Sargent€was€ineligible€for€unemploymentÏcompensation€under€T.C.A.€ðð€50„7„303(a)(1)€because€she€was€not€released€byÏher€doctor€to€perform€her€usual€duties.€€Sargent€again€appealed€to€the€AppealsÏTribunal€who€affirmed€the€TDES€decision.€€The€decision€of€the€AppealsÏTribunal€states€in€part€pertinent€to€this€appeal€as€follows:ÌÓÓà8 àà8 àFINDINGS€OF€FACT:€Claimantððs€most€recentÏemployment€prior€to€filing€this€claim€was€with€RoaneÏHosiery,€Inc.,€as€a€folder,€from€July€26,€1993,€untilÏMay€16,€1994,€when€she€was€discharged.€€On€March€1,Ïclaimant€came€to€the€foreman,€indicating€she€couldÏnot€work€eight€hours€a€day,€but€only€six€hours.€€SheÏwas€pregnant.€€He€informed€claimant€the€employerÏdid€not€have€part„time€work.€€She€went€to€theÏsupervisor€and€the€time€keeper.€€Claimant€had€aÏdoctorððs€certificate€which€indicated€that€due€toÏpregnancy€she€could€not€work€nine€hours€a€day.€ÏClaimantððs€last€day€was€February€14.€€She€was€left€onÏinsurance€coverage€until€May€16,€due€to€policy.€€AtÍthat€point€claimant€was€terminated.€€The€employer€isÏwilling€to€rehire€claimant€as€they€do€not€consider€herÏseparation€wrongful.€€Claimant€is€able€to€work,€butÏcannot€work€nine€hours€a€day.€€Claimant€filed€forÏunemployment€benefits€on€March€[15].Ìà8 àà8 àCONCLUSIONS€OF€LAW:€The€Agency€finds€thatÏclaimant€left€due€to€a€medical€condition€not€caused€byÏher€work.€€Before€she€can€be€considered€eligible€forÏunemployment€benefits€she€must€show€she€hasÏcomplied€with€the€medical€exception€provisions€ofÏT.C.A.€ðð€50„7„303(a)(1).€€Claimant€must€be€releasedÏby€her€doctor€as€able€to€return€to€her€former€dutiesÏand€is€not€eligible€for€unemployment€under€T.C.A.€ððÏ50„7„303(a)(1).€€After€release€by€her€doctor€to€returnÏto€her€former€duties,€and€employer€has€no€workÏavailable,€claimant€may€reapply€for€benefits€ifÏotherwise€eligible.€€Claim€is€denied€effective€MarchÏ15,€under€T.C.A.€ðð€50„7„303.€€The€Agency€decisionÏwhich€denied€this€claim€is€affirmed.Ìà8 àÌÓÓSargent€appealed€this€decision€to€the€Board€of€Review.€€The€Board€of€ReviewÏadopted€the€Appeals€Tribunalððs€findings€of€fact€and€conclusions€of€law€andÏaffirmed€the€decision.€€On€November€15,€1994,€Sargent€appealed€this€finding€toÏthe€Roane€County€Chancery€Court.€€The€Chancellor€found€that€there€wasÏsubstantial€and€material€evidence€to€support€the€decision€of€the€AppealsÏTribunal€and,€therefore,€affirmed€the€decision€of€the€Board€of€Review.€€SargentÏhas€appealed€to€this€Court,€and€the€issue€we€must€decide€is€whether€the€BoardÍof€Reviewððs€decision€that€Sargent€is€not€entitled€to€unemploymentÏcompensation€benefits€pursuant€to€T.C.A.€ðð€50„7„303(a)(1)€is€supported€byÏsubstantial€and€material€evidence.Ìà óóó,€813€S.W.2d€141,€144€(Tenn.€App.€1991).€€In€òòò òSabastian€v.€Bibleó óóó,€649ÏS.W.2d€593,€594„5€(Tenn.€App.€1983),€we€stated:ÌÓÓà8 àà8 àIn€order€to€sustain€the€Board€of€Review's€applicationÏof€the€provisions€of€the€statute,€we€need€not€find€thatÏits€construction€is€the€only€reasonable€one€or€evenÏthat€it€is€the€result€we€would€have€reached€had€theÏquestion€arisen€in€the€first€instance€in€a€judicialÏproceeding.€€€The€reviewing€court's€function€is€severelyÏlimited.€€€All€that€is€needed€to€support€theÏcommission's€interpretation€is€that€it€has€warrant€inÏthe€record€and€a€reasonable€basis€in€law.€ÓÓÌà àThe€Board's€ruling€disqualifying€Sargent€for€benefits€was€based€uponÏT.C.A.€ðð€50„7„303(a)(1)€(Supp.€1996)€which€we€quote€in€pertinent€part:ÌÓÓà8 àà8 àò ò50„7„303.€€Disqualification€for€benefits.€„„€ó ó(a)ÏDisqualifying€Events.€€€A€claimant€shall€be€disqualifiedÏfor€benefits:Ìà8 àà8 à(1)€If€the€commissioner€finds€that€the€claimant€hasÏleft€such€claimantððs€most€recent€work€voluntarilyÏwithout€good€cause€connected€with€such€claimantððsÏwork.€€€Such€disqualification€shall€be€for€the€durationÏof€the€ensuing€period€of€unemployment€and€until€suchÍclaimant€has€secured€subsequent€employment€coveredÏby€an€unemployment€compensation€law€of€this€state,Ïor€another€state,€or€of€the€United€States,€and€was€paidÏwages€thereby€ten€(10)€times€such€claimantððs€weeklyÏbenefit€amount.€€€No€disqualification€shall€be€madeÏhereunder,€however,€if€such€claimant€presentsÏevidence€supported€by€competent€medical€proof€thatÏsuch€claimant€was€forced€to€leave€such€claimantððsÏmost€recent€work€because€such€claimant€was€sick€orÏdisabled€and€notified€such€claimantððs€employer€of€thatÏfact€as€soon€as€it€was€reasonably€practical€to€do€so,Ïand€returned€to€that€employer€and€offered€to€work€asÏsoon€as€such€claimant€was€again€able€to€work,€and€toÏperform€such€claimantððs€former€duties.ÌÌÓÓà à€Sargent€asserts€that€she€did€not€voluntarily€quit€her€job.€€She€claims€thatÏshe€was€discharged€by€Roane.€€She€argues€that€since€she€did€not€voluntarily€quit,ÏT.C.A.€ðð€50„7„303(a)(1)€is€inapplicable€and,€therefore,€the€Board€of€ReviewÏerred€in€applying€this€disqualification€provision.€€We€disagree.Ìà àSubstantial€and€material€evidence€supports€the€Boardððs€decision€thatÏSargent€voluntarily€quit€her€job.€€She€could€have€returned€to€work€at€Roane€fullÏtime€but€chose€not€to.€€In€her€applications€for€other€jobs,€Sargent€stated€theÏreason€for€leaving€Roane€as€ð ðwanted€something€part„time.ðð€€When€she€left,€herÏforeman€was€under€the€impression€that€she€quit.€€She€was€taken€off€of€theÏpayroll€after€she€failed€to€appear€at€work€for€90€days.€€In€our€view,€the€proofÏestablished€that€Sargent€voluntarily€left€Roane.€€€€Ìà àSargent€next€argues€that,€if€she€voluntarily€left€her€job,€she€has€compliedÍwith€the€requirements€of€the€medical€exception€to€T.C.A.€ðð€50„7„303(a)(1).€ÏThe€Board€found€that€Sargent€was€not€released€by€her€doctor€as€able€to€work€atÏher€former€duties.€€Sargent€voluntarily€left€her€job€due€to€medical€reasonsÏunrelated€to€her€work.€€She€presented€Roane€with€a€letter€from€her€doctor€thatÏshe€could€resume€work€only€on€a€limited€schedule.€€However,€Roane€was€unableÏto€accommodate€her€because€they€did€not€have€part„time€jobs.€€The€proofÏshows€that€Sargent€was€unable€to€resume€her€former€duties€because€of€aÏmedical€condition€not€related€to€her€employment.€€There€is€substantial€andÏmaterial€evidence€that€supports€the€Boardððs€findings€on€this€issue.€€In€addition,Ïthere€must€be€a€causal€connection€between€the€employment€and€the€illness€orÏdisability.€€ò òòòCawthron€v.€Scottó óóó,€400€S.W.2d€240€(Tenn.€1966).€€Obviously,€herÏpregnancy€is€unrelated€to€her€work€as€a€folder€for€Roane.€€Ìà àFinally,€Sargent€argues€that€she€was€able€and€available€for€work,€and,Ïtherefore,€should€be€eligible€for€unemployment€compensation€benefits.€€We€findÏno€merit€to€this€argument.€€T.C.A.€ðð€50„7„302€provides€the€ð ðBenefit€eligibilityÏconditionsðð€and€outlines€which€requirements€claimants€must€meet€to€be€eligibleÏfor€unemployment€compensation.€€One€of€the€conditions€that€must€be€met€isÏthat€the€ð ðclaimant€is€able€to€work,€available€for€work,€and€making€a€reasonableÏeffort€to€secure€work.ðð€€T.C.A.€ðð€50„7„302(a)(4)€(Supp.€1996).€€However,€T.C.A.Íðð€50„7„303€lists€the€events€that€disqualify€a€claimant€for€benefits€under€theÏheading€ð
