Thisactionwasprecipitatedwhendefendantsblockedplaintiff'smeansofingressandegresstotheirpropertyacrossdefendants'land.TheissuefortheTrialCourtwaswhethertheroadwaywasapublicroad,andtheTrialJudgegrantedplaintiff'ssummaryjudgment,stating:0 0 TherightofwayinquestionisapublicroadandthereisnoevidenceofanintenttoabandonthesamebyCampbellCounty,Tennessee,andthereisnocontroversyofmaterialfactsintherecord.  Defendantsappealed,insistingtherearedisputedissuesofmaterialfacts.Essentially,theyarguethereisevidencethattheroadhadlostitscharacterasapublicroad,duetononusebythegeneralpublicandneglectbytheCounty.Defendantfiledathirdpartypleadingagainst"CampbellCountyRoadDepartmentbyitsRoadSupervisorJ.T.LeachandArnstonSharp"inthisaction,andthenrequestedadmissionsfromtheRoadSupervisor.Essentially,theRoadSupervisoradmittedthathehadbeenRoadSupervisorinCampbellCountysinceSeptember1,1980,andadmittedthattheroaddidnot"appearonanylistofroadswhichiskeptbythisthirdpartydefendant".Further,thattheroaddepartmenthadnot"worked"theroadsinceSeptember1,1980.  Itisundisputedthatdefendantsacquiredtheirpropertyin1983,andtheirdeedfromthegrantor,alongwithanaccompanyingplat,showtheroadleadingacrossplaintiffs'property.CampbellCountyQuarterlyCourtin1951votedtoacquiretherightofwaytothisroad,andarightofwaywaspurchasedpursuanttotheresolution.Therecordalsoestablishedthattherewassomeuseoftheroadbythegeneralpublicuntildefendantsplacedacableacrosstheroadtopreventitsuse,givingrisetothisaction.InAugustof1993,defendantappearedbeforetheCountyCommission,requestingthataquitclaimdeedbemadetohimfortheroadrightofway.TheCommissionappointedacommitteetoconsidertherequest,andtheCommissionactedonOctober16,1993,unanimouslysaying:0 0 ...thattheroadinquestionremainasis,sincetheCourtdoesnotfavorablyconsidertherequestforthequitclaimdeed.  Plaintiffinhisdepositiontestifiedhehadlivedonthepropertysince1985,andacknowledged"afewpeople"haveusedtheroad.Hefurtherstatedthathehad"askedthem[RoadCommissioner]foryearstodosomethingwiththedamnthing".Weconcludethereisnotadisputedissueofmaterialfactrequiringaremandfortrial.SeeByrdv.Hall,847S.W.2d208(Tenn.1993).  Itisclearthattheremaybeanabandonmentofapublicroad,buttheburdenisonthepartiesassertingtheabandonmenttoestablishtheintentiontoabandon,andanabandonmentmaybeshownbyevidenceinpasaswellasbypublicrecord.SeeHargisv.Collier,578S.W.2d953(Tenn.App.1978).ThisCourtsaidinFarrv.Pentecost,1994WL12617(Tenn.App.):0 0 Tennesseecourtshaveheldthatevidenceofmerenonusealonedoesnotestablishabandonment,Jacowayv.Palmer,753S.W.2d675,67778(Tenn.App.1987),norwillacityorcounty'sfailuretomaintainapublicroadwhenitisbeingusedbythepublic.Cartwrightv.Bell,418S.W.2d463,46970(Tenn.App.1967).Theremustbeapositiveshowingofanintenttoabandon(Jacoway).  Plaintiffs'effortstosecurethevacationoftheroadwayconstitutesanadmissionthattheroadhasneverbeenabandoned.See39(a)CJSHighways,Section130,p.8478.  Defendantspurchasedtheirpropertybydeedshowingtheroad,soughtvacationbythecountyoftheroadin1993,andadmittedsomecontinuinguseoftheroadwayuntiltheyblockedtheroad.Thisisnotindispute,andestablishestheroadhasnotbeenabandoned,asdeterminedbytheTrialJudge.
