JoanneSherrellslippedinapuddleofwaterinaislenineoftheFoodLionstoreinManchesterandsustainedaninjurytoherknee.Herclaimwassubmittedtoajuryoncomparativefaultprinciples,andthejuryfoundFoodLiontobe100%atfault.OnappealFoodLionarguesthatasamatteroflawMrs.Sherrellsownfaultcontributedtoherinjury.  TheproofshowedthatMrs.Sherrellhadshoppedinanotherpartofthestoreandwaswalkingupaisleninetowardthecashierstationswiththetwoitemssheintendedtopurchaseinonehandandherpurseinanother.Shewaswearingflipflopsandals.Hervisionwasnotobstructedandshewasnotdistractedinanyway.AboutonehalftothreefourthsofthewayuptheaisleMrs.Sherrellslippedinsomewateronthefloor.  Therewerethreeothercustomersinaislenine.Twoofthemwereattherearofthestoreandanotherwalkeddowntheaislefromthefronttotherear,wherehemetMrs.Sherrellcominguptheaisleintheoppositedirection.Allthreeoftheotherwitnessessawwateronthefloor.Thetwowitnessesattherearofthestoresawseveralpuddlesofwaterallupanddowntheaisle;theotherwitnesssawapuddleofwatereighteentotwentyinchesindiameteraboutfifteentotwentyfeetdowntheaisle.  TherewerefourstoreemployeespresentwhenMrs.Sherrellfell.Noneofthemwitnessedthefallbuttheyallgavedifferentversionsofhowmuchwaterwasonthefloorinaislenine,eitherjustbeforeorjustafterMrs.Sherrellfell.Twoofthemsawnowateratall;onesawasmallspotaboutthesizeofahalfdollar;anothersawasmallpuddle.  Thepicturesintroducedbythedefendantshowthatitmayhavebeendifficulttoseewateronthefloorbecauseofthefloorsglossyfinish.@ II.  WhetherMrs.Sherrellshouldhaveseenandavoidedthewateronthefloorinaislenineisordinarilyaquestionforthejury.Strawnv.SCOAIndustries,Inc.,804S.W.2d80(Tenn.App.1990).Theissuemaybewithdrawnfromthejuryonlyinthosecaseswherethefactsareestablishedbyevidencefreefromconflictandwouldsupportonlyoneinference.Fradyv.Smith,519S.W.2d584(Tenn.1974).
