OPINION         INMAN,SeniorJudge Theseplaintiffsjointlyfiledasinglecomplaintagainsttheappelleesfordamagesallegedlyarisingoutoftheirrefusaltoremainsilentconcerningortoparticipateinallegedillegalactivitiesconnectedwiththeiremployment.Theyallegedcollectivelyorsingly(1)breachofcontract,(2)violationsoftheTennesseeHumanRightsAct,Tenn.CodeAnn.421101etseq.,(3)invasionofprivacy,(4)intentionalinflictionofemotionaldistress,(5)tortiousinterferencewithcontractualandnoncontractualrightsofemployment,and(6)retaliatorydischargeinviolationofcommonlawandthePublicProtectionActof1990,Tenn.CodeAnn.501304,etseq.󛀀Theplaintiffswereadmittedlyatwillemployees.  Thecomplaintwasincourseorderedtobesevered.Ineachcasealloftheassertedclaimsweredismissedeitheronmotionorvoluntarily.Eachplaintiffappealsonlytheadverserulingonherclaimforcommonlawretaliatorydischarge,theproprietyofwhichispresentedforreview.IntheinterestofeconomyandgoodϜpractice,theseappealswerebyconsentconsolidated. TheretaliatorydischargeactionwasdismissedpursuanttoRule12.02,T.R.C.P.forfailuretostateaclaim.SinceaRule12motionteststhelegalsufficiencyofacomplaint,allproperlypleadedallegationsareassumedtobetrue.Alexanderv.Inman,825S.W.2d102(Tenn.Ct.App.1991).Eachplaintiffrestatedhercomplaint,buttheprolixityofeach(18pages)remainedconstantundertheassertedguiseofpragmatism.Totheextentpossible,wehavesoughttoextractthewellpleadedallegationsrelevanttotheissueofretaliatorydischarge. TheplaintiffKinseyallegesshewas retaliatedagainstformakingclaimsofsexdiscriminationinviolationoftheTennesseeHumanRightsAct,andforcomplainingaboutoverloadingtheadolescentpsychiatricprogramwhichsheallegedwasinviolationoftheregulationspromulgatedbytheJointCommissiononAccreditationofHealthCareOrganizationsandtheStateDepartmentofMentalHealth. ThelatterallegationpromptedthefilingofanaffidavitofthedefendantϜKestner,PresidentofthedefendantKestnerGroups,Inc.Hedeposedthat(1)theLighthouseTreatmentCenterisnotanentity,butmerelyatradename,(2)itisexemptfromtherequirementtoobtainaCertificateofNeed,(3)itisaccreditedbytheJCAHO,eventhoughsuchaccreditationwasnotrequired. Nocountervailingaffidavitsorotherdocumentaryevidencewerefiledbytheplaintiffs,andtheChancellorapparentlytreatedtheRule12.02motionasoneforsummaryjudgmentunderRule56,whichprovides,asparaphrased,thatinRule12.02motionsallegingfailuretostateaclaimwheremattersoutsidethepleadingarepresentedtotheCourthere,theKestnerAffidavitthemotionshallbetreatedasoneforsummaryjudgment. Thecasesareclearonthepointthatwhenapartyis facedwithamotionforsummaryjudgmentbaseduponaffidavits,thatpartymaynotrestuponherpleadings  todefeatthemotion.Masonv.Pearson,668S.W.2d656(Tenn.Ct.App.1983). Wesayapparentlytreated,sincethememorandumopinion,incorporatedinthejudgment,recitesthattheaffidavitwasconsidered,notwithstandingtheOpinionprimafaciereferredtothemotiontodismissortostrikewithoutexpresslytreatingitasoneforsummaryjudgment. Inreviewingasummaryjudgment,thecourtmustviewallthepleadingsandaffidavitsinalightmostfavorabletotheopponentofthemotionandallconclusionsoffactderivedtherefrommustbesimilarlyconstrued.Wyattv.WinnebagoIndustries,566S.W.2d276(Tenn.App.1976). Weconclude,therefore,thatthemotionforsummaryjudgmentwasproperlygrantedastothespecificallegationthattheretaliatorydischargeswereinresponsetotheplaintiffscriticismthattheadolescentpsychiatricprogramwasoverloaded. Theappellantsarguethattheallegationsoftheircomplaints,assumedtobetrueunderRule12.02,aresufficienttoestablishaprimafaciecaseofactionableretaliatorydischarge.Theydonotbrieftheissueofsummaryjudgment,whichisessentiallydispositive;rather,theyarguethattheallegedviolationsoflawsandregulationsconcerningtheaccreditationprocessinvolveconsiderationsofpublicpolicy.InAndersonv.StandardRegisterCo.,857S.W.2d555(Tenn.1993),theSupremeCourtrecognizedthatanemployeesrefusaltoviolatepublicpolicyresultinginhisatwilldischargewasactionable.Anderson,atruckdriver,wasdischargedforrefusingtoviolatetheMotorCarriersAct.ThehurdleconfrontingtheplaintiffsistheunrefutedKestnerAffidavit,previouslydiscussed.Thusitisthattheplaintiffsaccusethedefendantsofviolatinglaws,rulesandregulationstowhichtheyarenotsubject.Hence,publicpolicyisnotimplicated.Moreover,wearemindfulofthemandatedinstructioninHarveyv.MiddlebrookNursingHome,784S.W.2d921(Tenn.1990)thatthecourtshavenolicensetoenlargeontheemployeeatwillruleorcreateotherexceptionstopublicpolicyorcommonlawintheabsenceofsomeconstitutionalorlegislativeprecedent. TheissueofwhetherthecommonlawclaimofretaliatorydischargeispreemptedbytheHumanRightsCommissionActisnotbriefedbytheappellants,andwethereforepretermitit.
