àOn€numerous€occasions,€Plaintiff€talked€withÏDefendant€Howard€by€telephone€and€attempted€to€obtain€assistance€forÏrelocation.€€During€these€conversations,€Defendant€Howard€was€rudeÏand€condescending€to€Plaintiff,€and€on€one€occasion,€Defendant€HowardÏtold€Plaintiff€that€he€was€going€to€ð ðthrow€your€damn€black,€squatting€assÏout.ððÌÌà8 àà à10.à àDefendant€MDHA€obtained€title€to€the€property€at€521ÏSouthgate€Avenue€on€July€13,€1992,€through€a€Court€Order€which€did€notÏbecome€final€until€August€13,€1992.€€Plaintiff€did€not€become€aware€of€thisÏchange€of€title€until€July€13,€1992,€when€he€received€a€letter€fromÏ[MDHAððs€Executive€Director]€dated€July€10,€1992,....€€[The]€letterÏinformed€Plaintiff€that€it€was€the€intention€of€MDHA€to€remove€all€PlaintiffððsÏpossessions€from€the€premises€on€July€14,€1992.ÌÌà8 àà à11.à àOn€July€14,€1992,€Plaintiff€filed€a€lawsuit€in€theÏChancery€Court€for€Davidson€County€seeking€to€enjoin€MDHA€fromÏtaking€possession€of€the€property€located€at€521€Southgate€Avenue.ÌÌà8 àà à12.à àOn€July€14,€1992,€and€without€any€notice€to€Plaintiff,ÏDefendant€Jennings,€acting€on€behalf€of€MDHA,€obtained€a€criminalÏwarrant€against€Plaintiff€alleging€that€Plaintiff€had€committed€the€crime€ofÏcriminal€trespass.€€On€July€15,€1992,€Defendants€Howard€and€Jennings,Ïand€several€other€unknown€officers€and€employees€of€MDHA,€executedÏthe€warrant€and€arrested€Plaintiff€at€his€home€at€521€Southgate€Avenue.€ÏBecause€Plaintiff€could€not€post€bond€in€the€amount€of€$5,000.00,€heÏremained€in€custody€for€approximately€36€hours,€until€General€SessionsÍJudge€Gale€Robinson,€Junior€released€Plaintiff€on€his€own€recognizance.€ÏOn€October€26,€1992,€the€State€of€Tennessee,€through€its€AssistantÏDistrict€Attorney€General,€dismissed€the€criminal€action€against€Plaintiff.ÌÌà8 àWhile€Plaintiff€was€incarcerated,€agents€of€the€MDHAÏremoved€numerous€possessions€of€Plaintiff€from€the€property€which,€toÏthis€date,€have€not€been€returned€to€Plaintiff.€€This€property€included,€butÏis€not€limited€to,€irreplaceable€business€records€in€the€form€of€computerÏdata,€programs,€correspondence,€books,€microfilm,€video€and€audioÏtapes,€compact€discs,€tools,€computer€and€other€[electronic]€equipment,Ïhousehold€furniture,€appliances,€personal€clothing,€and€many€childhoodÏand€family€mementos.ÌÌà8 àPlaintiff€then€negotiated€by€and€through€his€counselÏSam€Lipshie€with€MDHA€attorney€George€Barrett€an€agreement€underÏwhich€MDHA€agreed€to€allow€Plaintiff€to€recover€what€property€was€left€atÏ521€Southgate€Avenue€prior€to€September€9,€1992.€€Despite€thisÏagreement,€and€in€direct€breach€of€this€agreement,€MDHA,€on€SeptemberÏ8,€1992,€looted€and€bulldozed€the€premises€at€521€Southgate€Avenue,Ïthereby€causing€the€Plaintiff€further€and€substantial€harm€and€damages€toÏhis€property.€œÌ›ÌÌÌÓÓà
