àIn€this€divorce€case€the€husband€contests€the€trial€judgeððs€award€ofÏrehabilitative€alimony,€the€division€of€marital€property,€and€the€order€to€pay€privateÏschool€tuition€for€the€wifeððs€child€by€a€former€marriage.€€The€wife€insists€that€theÏtrial€judge€erred€in€amending€the€final€decree€based€on€inadmissible€evidenceÏand€in€ordering€the€wife€to€pay€one„half€of€the€mortgage€payment€for€JanuaryÏ1995.€€We€modify€the€award€of€rehabilitative€œalimony€and€the€order€allowing€theÏhusband€to€recover€one„half€of€the€property€held€jointly€with€the€wifeððs€daughter;›Ïotherwise€we€affirm.ÌÌà@ àò òI.ó óÌÌà àà àMr.€and€œMs.›€Smith€were€married€for€eleven€years.€€œMs.›€Smith€hadÏbeen€married€once€before€and€had€a€seven€year€old€daughter€at€the€time€of€theÏmarriage.€€Both€parties€owned€a€home,€a€car,€and€some€furniture.€€They€were€bothÏemployed,€and€each€continued€to€work€after€the€marriage.€€After€the€marriage€œMs.›ÏSmith€sold€her€home€and€moved€into€Mr.€Smithððs€home.€€When€that€home€burnedÏthey€bought€a€condominium,€where€they€lived€until€the€separation.ÌÌà àà àœMs.›€Smith€worked€as€an€assistant€to€the€Commissioner€ofÏConservation,€as€a€sales€representative€for€National€Car€Rental,€and€for€aÏresidential€mortgage€company€selling€equity€mortgage€loans.€€In€all,€her€incomeÏranged€from€$17,000€to€$34,700€per€year.€€In€1991€the€parties€agreed€that€œMs.›ÏSmith€would€go€back€to€school€to€pursue€a€career€in€health€care.€€She€wasÏaccepted€at€a€local€college€for€a€two€year€program€in€physical€therapy,€but€theÏcollege€lost€accreditation€for€the€program€and€œMs.›€Smithððs€efforts€were€delayed€aÏyear.€€At€the€time€of€the€divorce,€she€was€in€school€in€anticipation€of€joining€a€twoÏyear€program€in€occupational€therapy.ÌÌà àà àMr.€Smith€œis€a€graduate€engineer.›€€After€nine€years€of€employmentÏhe€moved€into€residential€œdevelopment,€and›€œat›€the€time€of€the€divorce€he€wasÏpresident€of€Villages€of€Mt.€Juliet€and€vice„president€of€Fox€Ridge€Homes.€€HisÏannual€salary€was€approximately€$87,500€at€the€time€of€the€trial.ÌÌà àà àBeginning€in€1987,€both€parties€became€involved€in€the€ChurchÏUniversal€and€Triumphant,€a€œchurch€with€a€very€charismatic€leader,€whichÏstresses€survivalist€practices.€€Mr.€and€Ms.€Smith€funded€two€bomb€shelters€inÏMontana,€and€Mr.€Smith€supervised€the€construction€of€a€shelter€on€another€pieceÏof€property.€€Eventually,€however,€Mr.€Smith€came€to€view€the€organization€as€aÏdangerous€cult.€€Ms.€Smith€continued€her€interest€in€the€church€and€conductedÏmeetings€in€her€home.€€Because€of€the€religious€items€displayed€in€the€home,€Mr.ÏSmith€did€not€invite€business€associates€or€friends€to€visit.€€Ms.€SmithððsÏparticipation€in€this€religious€organization€was,€apparently,€the€chief€cause€of€theÏtension€that€developed€in€the€marriage.ÌÌà àà àThe€trial€judge€declared€the€parties€divorced€pursuant€to€Tenn.€CodeÏAnn.€ðð€36„4„129(b)€and€entered€a€decree€dividing€the€marital€property.€€InÏaddition,€the€decree€ordered€Mr.€Smith€to€pay€Ms.€Smith€rehabilitative€alimony€ofÏ$1500€per€month€for€three€years,€as€long€as€Ms.€Smith€was€a€full€time€student€withÏa€ð ðCðð€average.€€Mr.€Smith€was€also€ordered€to€pay€the€private€school€tuition€forÏMs.€Smithððs€daughter€for€the€1994„95€school€year.ÌÌà àà àMr.€Smith€filed€a€motion€for€a€new€trial€and,€in€the€alternative,€to€alterÏor€amend.€€The€motion€included€many€factual€statements€about€the€variousÏproperties€in€the€marital€estate€and€was€sworn€to€by€Mr.€Smith.€€The€trial€judgeÍamended€the€final€decree€in€various€respects€and€ordered€that€Mr.€Smith€payÏalimony€for€two€and€one„half€years€instead€of€three.ÌÌà@ àò òII.ó óÌà@ àò òòòRehabilitative€Alimonyó óóóÌÌà àà àMr.€Smith€argues€that€the€court€erred€in€awarding€Ms.€SmithÏrehabilitative€alimony€because€she€is€already€a€highly€skilled€person€and€doesÏnot€need€to€further€her€education.€€While€it€is€true€that€Ms.€Smith€has€a€successfulÏemployment€history,€she€testified€that€she€was€ð ðburned€outðð€on€the€most€lucrativeÏjob€she€held.€€She€wished€to€spend€more€time€with€her€family,€and€she€and€Mr.ÏSmith€agreed€that€she€should€go€back€to€school€to€pursue€a€professional€career.€ÏAfter€giving€up€her€prior€employment€and€embarking€on€this€course€it€would€beÏunfair€to€make€Ms.€Smith€pick€up€the€old€career€she€and€Mr.€Smith€agreed€sheÏshould€abandon.ÌÌà àà àThe€court€ordered€Mr.€Smith€to€pay€the€alimony€for€two€and€one„halfÏyears€at€$1500€per€month,€a€total€of€$45,000.€€Taking€into€account€the€assetsÏawarded€to€Ms.€Smith€in€the€property€division€and€the€factors€listed€in€Tenn.€CodeÏAnn.€ðð€36„5„101(d)(1),€we€are€of€the€opinion€that€the€amount€is€excessive.€€Ms.ÏSmith€should€assume€some€of€the€burden€for€her€future€educational€pursuits.€ÏTherefore,€we€are€of€the€opinion€that€the€amount€of€rehabilitative€alimony€shouldÍbe€reduced€to€$750€per€month€for€a€period€of€three€years€from€the€date€of€theÏdivorce.ÌÌà@ àò òIII.ó óÌÌà àà àMr.€Smith€also€contests€the€trial€judgeððs€order€requiring€him€to€payÏone„half€of€the€private€school€tuition€for€Ms.€Smithððs€daughter,€for€the€semesterÏjust€after€the€separation€occurred.€€The€proof€showed€that€the€child€had€been€inÏprivate€schools€since€the€parties€married.€€Mr.€and€Ms.€Smith€voluntarily€paid€theÏexpenses€from€the€familyððs€joint€funds.€€It€also€appears€that€the€contract€obligatingÏthe€parties€for€the€tuition€payment€was€entered€into€prior€to€the€divorce.ÌÌà àà àUnder€these€circumstances,€we€think€the€trial€judge€correctlyÏconsidered€the€school€tuition€as€a€joint€debt.€€It€is€not€a€question€of€making€aÏstepparent€support€someone€elseððs€child,€which€the€court€in€òòPressley›€v.€œPressley›óó,ÏNo.€œ03„A„01„9311„CV„00400€(Court›€of€Appeals,€Knoxville,€February€10,€œ1995)Ïfound€improper.€€But€where›€the€parties€jointly€assume€an€obligation€benefitting€theÏwifeððs€daughter,€the€trial€judge€may€consider€the€obligation€as€a€marital€debt.ÌÌà@ àò òIV.ó óÌÌà àà àMr.€Smith€argues€that€the€trial€judge€erred€in€dividing€the€maritalÏproperty.€€It€appears€that€the€trial€judge€awarded€Mr.€Smith€property€having€a€netÏvalue€of€approximately€$110,000,€when€he€pays€the€marital€debts€allocated€toÏhim.€€œMs.›€Smithððs€share,€calculated€on€the€same€basis,€amounts€to€approximatelyÏ$99,000.€€Considering€all€the€factors€enumerated€in€Tenn.€Code€Ann.€ðð€œ36„4„121(c),›€and€the€discretion€given€trial€judges€in€dividing€marital€property,€weÏcannot€say€that€the€division€in€this€case€was€inequitable.ÌÌà àà àThe€final€decree€awards€Mr.€Smith€one„half€of€some€property€in€theÏname€of€œMs.›€Smithððs€daughter.€€One€account€is€in€the€name€of€Mr.€Smith€asÏcustodian€for€the€child€under€the€Uniform€Gift€to€Minors€Act,€Tenn.€Code€Ann.€ððÏœ35„7„101,›€et€œseq.€(repealed).›€€We€are€of€the€opinion€that€since€the€child€was€not€aÏparty€to€this€action,€the€trial€court€could€not€œalter›€her€title€to€the€property€inÏquestion.€€œòòSee€Reymann€v.€Reymannóó,€919€S.W.2d€615€(Tenn.€App.€1995).€€Thus,›Ïto€the€extent€that€the€division€of€the€marital€property€reflects€that€Mr.€Smith€is€toÏreceive€$4,134€from€this€source,€it€is€erroneous.€€The€property€in€the€childððs€nameÏshall€remain€in€her€name€œuntil›€some€court,€with€jurisdiction€over€all€interestedÏparties,€decides€otherwise.ÌÌà àà àWe€are€not€persuaded,€however,€that€the€removal€of€that€amount€ofÏassets€from€Mr.€Smithððs€side€of€the€ledger€automatically€requires€that€the€propertyÏdivision€be€adjusted.€€Making€an€equitable€distribution€of€marital€property€doesÍnot€involve€an€exact€science.€€Therefore,€we€do€not€think€that€the€œabsence€of€theseÏassets€from€Mr.€Smithððs€side€renders€the€distribution€inequitable.›ÌÌà@ àò òV.ó óÌÌà àà àœMs.›€Smith€argues€that€the€trial€judge€erred€in€basing€the€final€decreeÏon€inadmissible€evidence€supplied€by€Mr.€Smith€as€a€part€of€his€motion€to€alter€orÏamend.€€We€think,€however,€that,€while€the€procedure€used€was€unorthodox€andÏperhaps€erroneous,€any€error€committed€in€admitting€Mr.€Smithððs€post„trialÏaffidavit€was€harmless.€€See€rule€36(b)€Tenn.€R.€App.€Proc.€€The€parties€enteredÏthe€original€trial€as€if€most€of€the€facts€could€be€stipulated€and€only€a€limitedÏamount€of€proof€would€be€necessary.€€When€the€proof€turned€out€to€be€moreÏcomplicated,€the€supplemental€record€œwas€necessary€to€give€the€court€anÏaccurate€picture€of€the€marital€assets.›ÌÌà
