AStatementoftheEvidencewasfiledbytheplaintiffs.Itwasobjectedtobythedefendants,actingprose,withnorulingbythetrialjudge.SeeTenn.R.App.P.24(f).Ordinarily,aremandwouldbenecessary,buttheobjectionsdonotquestiontheaccuracyorcompletenessoftheevidenceandforthisandotherreasonsweelecttotreattheobjectionsashavingbeendenied. InJuly1992,thesepartiesenteredintoaprolixcontractstyled AgreementtoPurchasearesidenceintheDeepwoodEstatesinWilsonCounty.Paraphrasingtheagreement,theplaintiffsagreedtoconveytheirresidencetothedefendantsinconsiderationof$3,000.00cashandthepaymentof$900.22monthlydirectlytotheholderoftheexistingmortgageindebtednessfor60months,whentheplaintiffswoulddelivertheirdeedtothedefendants,whoagreedto payofforassumethebalanceofthemorgageindebtedness. Thecontractthenprovidesthatifthedefendantsfailtomakethemonthlypayments,thecontractshall,after30daysnotice,beforfeited,andallmortgagepayments shallberetainedby[theplaintiffs]infullsatisfactionandinliquidationofalldamagessustained. ThedefendantsceasedmakingthemonthlypaymentsinSeptember1994.TheycontinuedtooccupythepropertyuntilJune1995whentheholderofthemortgageindebtednessforeclosedandtookpossession.Atthattime,thedefendantswereten(10)monthsinarrearswiththemortgagepayments. TheStatementoftheEvidenceissilentonthepoint,andwedonotknowwhethertheforeclosureresultedinadeficiencyowingtotheholderofthemortgageindebtedness. Theplaintiffsarguethatthedefendantsareclearlyliabletothemforthepaymentstheyfailedtomakeeitherpursuanttothecontractorasreasonablerentsincetheycontinuedtooccupytheproperty.Thecontractaffordsnocomfort,sinceitmerelyprovidesthatincaseofdefault,themonthlypayments shallberetainedbytheplaintiffs,andnoevidencewasofferedastothereasonablerentalvalueoftheproperty.Wecannotassumethattherentalvalueisequatabletothemortgagepayments;neithermayweassumetheplaintiffssuffereddamagesasaresultoftheforeclosure.Thecontractualprovisionthatthemonthlypaymentsshallbe retainedasliquidateddamagesreferstopaymentsactuallymade,andwearenotinclinedtoappendjudicialglosstheretoormakeunwarrantedassumptions.Weconstruethecontractaswefindit.Pettyv.Sloan,277S.W.2d355,359(Tenn.1955). Theargumentoftheplaintiffsthatthedefendantscannotbeallowed10monthsfreeoccupancyhas,ofcourse,muchpersuasiveforce.Underthecontract,thedefendantswerenotinprivitywiththeholderofthemortgageindebtedness,andanyresultantliabilityforadeficiencyafterforeclosurewillfallupontheplaintiffs.Thetrialjudgerecognizedthiscontingencybyholdingthatdamagescouldnotpresentlybeascertained.Weagree,butthisfactinnowayrelievesthedefendantsoftheobligationtopayareasonablemonthlyrentfortheirhabitation.SeeGreenwoodv.Maxey,231S.W.2d315(Tenn.1950).Forthisreason,thejudgmentisvacatedandthecaseisremandedforthepurposeofdeterminingthefairrentalvalueofthepropertyduringitsoccupancybythedefendants.
