×€violated€his€ConstitutionalÏrights€by€confining€him€to€a€cell€with€a€smoker.€€Appellant€alleged€he€firstÏrequested€placement€in€the€non„smoking€guild€upon€entering€the€Facility€on€1ÏMarch€1995.€€Appellant€explained€to€Appellees€and€Dr.€Butler€that€doctors€hadÏdiagnosed€him€with€chronic€sinusitis€and€that€inhaling€second„hand€cigaretteÏsmoke€caused€him€to€suffer€nosebleeds,€migraine€headaches,€and€a€swollenÏtongue.€€Finally,€Mr.€Sweat€alleged€that€he€filed€numerous€grievances.€ÏUltimately,€the€Facility€transferred€Appellant€to€the€non„smoking€guild€on€11ÏApril€1995.€€In€his€petition,€however,€Appellant€alleged€he€was€still€forced€toÏbreathe€second„hand€smoke€despite€his€transfer€because€Appellees€allowed€ð àThe€court€filed€an€order€on€31€May€1996€addressing€Dr.€Butlerððs€motion.€ÏThe€court€dismissed€the€action€ð ðon€the€grounds€that€venue€does€not€lie€inÏDavidson€County,€Tennessee.ðð€€On€17€June€1996,€the€court€filed€an€orderÏgranting€Appellantððs€motion€for€leave€to€file€an€amended€complaint€andÏoverruling€Appelleesðð€motion€to€dismiss€for€lack€of€venue.€€The€court€did€notÏexplain€the€basis€for€its€decisions.€€Appellees€filed€a€motion€to€dismiss€for€failureÏto€state€a€claim€upon€which€relief€can€be€granted€on€9€July€1996.ÌÌà àIn€the€complaint€there€is€no€allegation€that€the€petitioner€sought€anyÏrelief€from€the€agency€before€he€invoked€the€jurisdiction€of€thisÏCourt.€€Accordingly,€any€claim€the€petitioner€is€making€underÏTennessee€Code€Annotated€section€4„5„224(b)€must€be€dismissed€onÏthe€grounds€that€this€Court€does€not€have€jurisdiction€under€thatÏstatute€where€that€agency€has€not€been€first€petitioned.ÌÓ€ÓÌÓ€ÓIt€is€the€opinion€of€this€court€that€the€chancery€court€correctly€concluded€that€itÏlacked€subject€matter€jurisdiction.ÌÌà àEvery€person€who,€under€color€of€any€statute,€ordinance,€regulation,Ïcustom,€or€usage,€of€any€State€or€Territory€or€the€District€ofÏColumbia,€subjects,€or€causes€to€be€subjected,€any€citizen€of€theÏUnited€States€or€other€person€within€the€jurisdiction€thereof€to€theÏdeprivation€of€any€rights,€privileges,€or€immunities€secured€by€theÏConstitution€and€laws,€shall€be€liable€to€the€party€injured€in€an€actionÏat€law,€suit€in€equity,€or€other€proper€proceeding€for€redress€.€.€.€.€ÌÓ€ÓÌÓ€Ó42€U.S.C.A.€ðð€1983€(Supp.€1997).€€Thus,€a€petitioner€must€at€the€very€leastÏallege:€1)€he€or€she€is€a€citizen€of€the€United€States€or€within€the€jurisdiction;€2)Ïhe€or€she€possesses€a€right,€privilege,€or€immunity€secured€by€the€Constitution€orÏlaws€of€the€United€States;€3)€a€person€acting€under€color€of€state€law€deprived€theÏpetitioner€of€that€right,€privilege,€or€immunity.€€It€is€the€opinion€of€this€court€thatÏAppellant€met€these€requirements.€€He€alleged€Appellees€violated€hisÏconstitutional€rights€when€they€refused€to€transfer€him€to€a€non„smoking€guildÏand€then€refused€to€enforce€the€non„smoking€policy€once€they€had€transferredÏAppellant.€€In€addition,€Appellant€alleged€in€detail€the€position€held€by€eachÏrespondent€and€their€role€in€depriving€Appellant€of€his€constitutional€rights.€ÏAppellant€stated€a€claim€under€title€42€section€1983€of€the€United€States€Code.ÌÌà àAppellees,€however,€also€raise€the€issue€of€venue€in€their€brief.€€It€is€theirÏcontention€that€Appellantððs€petition€failed€to€allege€facts€establishing€that€venueÏlies€in€the€Davidson€County€Chancery€Court.€€The€chancery€court€overruledÏAppelleesðð€motion€to€dismiss€for€improper€venue€in€its€17€June€1996€order.€ÏUnfortunately,€the€court€did€not€provide€any€explanation€for€its€decision.€€We€canÏonly€assume€the€court€based€its€improper€venue€determination€on€the€declaratoryÍjudgement€and€writ€of€mandamus€actions€because€these€were€the€only€actionsÏaddressed€by€the€court€when€deciding€Appelleesðð€motion€to€dismiss€for€failure€toÏstate€a€claim.€€Thus,€it€seems€the€chancery€court€did€not€determine€whether€venueÏwas€proper€given€the€fact€that€Appellant€stated€a€section€1983€claim.ÌÌà àIt€is€the€opinion€of€this€court€that€venue€in€the€Davidson€County€ChanceryÏCourt€is€improper.€€A€claim€for€a€violation€of€civil€rights€is€a€transitory€action.× ƒ1 ××  ×€ÏTennessee€Code€Annotated€section€20„4„101€provides€where€venue€lies€in€civilÏactions€of€a€transitory€nature.× ƒ2 ××  ×€€That€section€provides:€€ÌÓÓà8 àà à(a)€In€all€civil€actions€of€a€transitory€nature,€unless€venue€isÏotherwise€expressly€provided€for,€the€action€may€be€brought€in€theÏcounty€where€the€cause€of€action€arose€or€in€the€county€where€theÏdefendant€resides€or€is€found.Ìà8 à(b)€If,€however,€the€plaintiff€and€defendant€both€reside€in€theÏsame€county€in€this€state,€then€such€action€shall€be€brought€either€inÏthe€county€where€the€cause€of€action€arose€or€in€the€county€of€theirÏresidence.ÌÓ€ÓÌÓ€ÓòòTenn.€Code€Annóó.€ðð€20„4„101(a),(b)€(1994).€€There€are€no€statutes€specificallyÏproviding€for€venue€in€section€1983€actions.€€Thus,€the€proper€venue€in€this€caseÏis€either€in€the€county€where€the€cause€of€action€arose€or€in€the€county€whereÏAppellees€reside€or€are€found.€€òòò òSee€id.ó óóóÌÌà àIt€is€clear€from€the€petition€that€the€cause€of€action€arose€at€the€Facility€inÏLake€County.€€In€addition,€we€know€from€the€petition€that€Appellees€Calhoun,ÏBasham,€Roberts,€Moore,€and€Freeman€worked€in€Lake€County€and€AppelleeÏConley€worked€in€Lauderdale€County€at€the€time€Appellant€filed€the€petition.€ÏThere€are€not,€however,€any€allegations€regarding€the€residences€of€Appellees€orÏany€evidence€of€where€Appellees€were€found.€€It€is€reasonable€to€infer,€however,Ïthat€Appellees€did€not€reside€in€Davidson€County€and€were€not€found€in€DavidsonÏCounty€as€Lauderdale€and€Lake€Counties€are€on€the€western€boundary€of€the€StateÏand€Davidson€County€is€near€the€center€of€the€State.€€Because€the€cause€of€actionÏdid€not€arise€in€Davidson€County€and€Appellees€did€not€reside€in€or€were€notÏfound€in€Davidson€County,€venue€did€not€lie€in€Davidson€County.€€Thus,€theÏchancery€court€erred€when€it€overruled€Appelleesðð€motion€to€dismiss€forÏimproper€venue.€€Moreover,€pursuant€to€Rule€13(b)€of€the€Tennessee€Rules€ofÏAppellate€Procedure€this€court€holds€that€€venue€was€also€improper€as€to€thoseÏrespondents€added€as€a€result€of€the€amended€petition.€€Our€reasoning€being€theÏsame€as€that€stated€above.ÌÌà àIt€is€the€opinion€of€this€court€that€Appellant€failed€to€state€a€claim€for€writÏof€mandamus€and€that€the€Davidson€County€Chancery€Court€lacked€subject€matterÏjurisdiction€over€the€declaratory€judgment€actions.€€Appellant€stated€a€claim€for€aÏviolation€of€his€civil€rights€under€title€42€section€1983€of€the€United€States€Code,Ïbut€filed€his€claim€in€the€wrong€court.€€It€is€the€opinion€of€this€court€that€theÏmotion€to€dismiss€should€have€been€granted€for€the€above€stated€reasons.€€GivenÏour€decision,€it€is€our€opinion€that€the€claim€for€writ€of€mandamus€should€beÏdismissedÌwith€prejudice€and€the€declaratory€judgment€actions€and€the€section€1983€actionÏshould€be€dismissed€without€prejudice.€€òòò àThe€chancery€court€denied€Appellantððs€request.€€It€determined€the€issue€wasÏmoot€because€the€court€had€dismissed€the€case€for€failure€to€state€a€claim€uponÏwhich€relief€can€be€granted.€€We€agree€with€the€trial€courtððs€ruling.ÌÌò
