Theevidenceshowsasfollows.Atthemotiontosuppresshearingandattrial,TrooperJimmyLamberttestifiedthatontheeveningofSeptember28,1997,heparkedhispatrolcaronthesideoftheroadtorunstationaryradar.Acivilianvehiclestopped,andthedrivercomplainedthataredFordRangerwasdrivingrecklessly.HethenobservedaredFordRangerpass,andhepulledontotheroadtoinvestigate.AccordingtoTrooperLambert,theredFordRangerwasmovingslowly,approximatelyfifteenmilesperhourunderthefortyfivemilesperhourspeedlimit.WhenheobservedtheRangercrosstheyellowcenterlineandthencrossthewhitefogline,hedecidedtoinitiateastop.Heactivatedhislights,buttheRangerdidnotstop.AfterfollowingtheRangerforapproximatelythreequartersofamile,TrooperLambertactivatedhissiren.TheRangertraveledanadditionalonehalfmilebeforeitstopped.  TrooperLambertidentifiedthedefendantasthedriveroftheRanger.AccordingtoTrooperLambert,thedefendantsmelledstronglyofanintoxicatedbeverageandhereyeswerewateryandred.Whenaskedifshehadbeendrinking,thedefendantadmitted, Alittlebit.TrooperLambertaskedthedefendanttoexitthevehicle,andwhenshedid,shestaggeredandhaddifficultywalking.Whenthedefendantcouldnotperform <8.4 anyroadsidesobrietytests,TrooperLambertarrestedherforDUI.TrooperLamberttestifiedthatinhisopinion,thedefendantwasintoxicated.  TrooperLambertaskedthedefendanttosubmittoabloodalcoholtest,andthedefendantagreed.Hetransportedthedefendanttotheemergencyroomofalocalhospitaltohaveherblooddrawn.Hetestifiedthatafterthesamplewasdrawn,itwasgiventohimandheimmediatelysealeditandmaileditbyU.S.postalmailtotheTennesseeBureauofInvestigation(TBI)crimelabinJackson.  TBISpecialAgentRobertMarshalltestifiedheconductedthebloodalcoholtestinthiscase,whichyieldedaresultof.22gramspercentofethylalcohol.Hetestifiedthatwhenbloodsamplesarriveatthelaboratory,theyareassignedanidentificationnumberandplacedinasecurerefrigerator.AccordingtoAgentMarshall,whenheretrievedthebloodsamplekitinthiscasefromthesecure,lockedrefrigerator,itwassealedwithtamperresistanttape.Thevialwaslabeledwiththeassignedidentificationnumber,thedefendantsname,thetimeanddateofcollection,andtwosetsofinitials.Thepaperworkaccompanyingthevialmirroredmuchofthisinformation,indicatingthatthesamplewascollectedbyJaneGoodman,M.T.,   X_SXXX_S  1      ׀onSeptember28,1997,inMcNairy '" CountyandsenttothelaboratorybyTrooperLambert.ThepaperworkcontainednoinformationregardingwhetherMs.Goodmanwaslicensedortrainedtocollectbloodsamplesortheproceduresheusedtocollectthesampleinthiscase.AgentMarshallalsotestifiedhedidnotreceiveasubmissionformsignedbythedefendantindicatingthatthebloodwashers;accordingtoAgentMarshall,itisthetroopersresponsibilitytocompletesuchpaperwork.AgentMarshallacknowledgedthatwipingalcoholacrosstheareafromwherebloodistobedrawnmightcompromisetheintegrityofthebloodsample 4 +0 andthetestresults,forwhichreasonnonalcoholswabsaregenerallyrecommended.  Thedefendanttestifiedthatbeforeherbloodwasdrawnatthehospital,herarmwasswabbedwithawhitepatchthatsmelledofalcohol.Shealsoadmittedthatinthehoursprecedingherarrest,shewasatabarwheresheconsumedatleastsixbeersand atepartofabagofchips.  ThedefendantfirstarguesthatthetrialcourterredindenyinghermotiontosuppressbecauseTrooperLamberthadneitherprobablecausenorreasonablesuspiciontostophervehicle.ShecomplainsthatsheposednothreatofviolenceandthatTrooperLambertbasedhisstopuponananonymoustipofrecklessdriving,amisdemeanor,withoutinformationregardingthecredibilityoftheinformantorthebasisoftheinformantsknowledge.ShealsocomplainsthatthestopviolatedT.C.A.407103,whichsheclaimsprohibitsstopsbasedsolelyuponanonymoustipsofminortrafficviolations,becauseTrooperLamberthadnoindependentbasisforstoppinghervehicle.  Insupportofherargument,thedefendantreliessolelyupontheuniformcitationcompletedbyTrooperLambert,whichstatesthedefendant wasstoppedafteracomplaintofrecklessdrivinganddoesnotmentionanyotherbasisforthestop.TrooperLamberttestifiedatthesuppressionhearing,however,thatthedefendantwastravelingbetweenthirtyandthirtyfivemilesperhourinafyortyfiveymileperhourzone,whichgavehim reasonforconcern.Healsotestifiedattrialthatitwasonlyafterheobservedthedefendantsvehicletravelingslowlyandcrossingtheyellowcenterlineandwhitefoglinethathedecidedtoinitiatethestop.Statev.Henning,975S.W.2d290,299 2T). (Tenn.1998)(holdingthat inevaluatingthecorrectnessofatrialcourt'srulingonapretrialmotiontosuppress,appellatecourtsmayconsidertheproofadducedbothatthesuppressionhearingandattrial).Thus,contrarytothedefendantscontentions,these 8.4 personalobservationsprovidedTrooperLambertwithgroundsindependentfromtheanonymoustipuponwhichtoformreasonablesuspiciontojustifyaninvestigatorystopofthedefendantsvehicle.SeeStatev.CarlSeawardAllen,No.01C01-9707-CC-00272,   RobertsonCounty(Tenn.Crim.App.filedAugust7,1998,atNashville)(findingreasonablesuspicionwhereanofficerobservedthedefendantdrivercrossingthefoglineatleasttwicewhiledrivingavanwithTexaslicenseplatesaroundmidnight);seealso \  Terryv.Ohio,392U.S.1,21(1968)(holdingthataninvestigatorystopofamotorvehicle (  isjustifiedwhentheofficerhasareasonablesuspicion,supportedbyspecificandarticulablefacts,thatacriminaloffensehasbeenorisabouttobecommitted);Griffinv. ` State,604S.W.2d40,42(Tenn.1980)(same).Thus,thedefendantscontentionslack , merit.  Thedefendantalsoarguesthatthetrialcourtabuseditsdiscretioninallowingtheresultsofthebloodalcoholtestintoevidence.ThedefendantcomplainstheStatefailedtoprovideproofverifyingtheidentificationofJaneMs.񛀜Goodman,M.T.,theindividualwhodrewherblood,andtheprocedureMs.Goodmansheused.ShesuggeststhatchainofcustodycannotbeestablishedbecauseAgentMarshalldidnotreceiveaformsignedbythedefendantacknowledgingthatthebloodsamplewashers,andsheclaimsthattheStatefailedtoprovethebloodsamplearrivedattheTBIlaboratoryinanunalteredstate.  Thedecisiontoadmitorexcludetheresultofabloodalcoholtestlieswithinthesounddiscretionofthetrialcourtandwillnotbedisturbedabsentabuseofdiscretion.SeeStatev.JimSmith,No.03C01-9312-CR-00398,KnoxCounty(Tenn.Crim.App.filed 0', July11,1994,atKnoxville);seealsoStatev.Ballard,855S.W.2d557,562(Tenn.1993). 2T). WeagreethatchainofcustodywouldhavebeenbetterprovenbyawitnessstestimonythatthebloodsampletakenfromthedefendantinthehospitalwasthesamebloodsamplepackagedbyTrooperLambert.Evenso,anyerrorinadmittingthebloodalcohol 8.4 testresultsinthiscasewasharmlessbeyondareasonabledoubtbecausetherecordcontainsothercompetentevidence,includingthedefendantsownadmissionsattrial,sufficienttosustainthejurysdeterminationthatthedefendantwasdrivingwhile{underthei{|nfluence|{intoxicated{.Tenn.R.Crim.P.52(a);seeStatev.Stowers,649S.W.2d607,609 0 (Tenn.Crim.App.1983).
