Heraisesthefollowingtwoissuesonappeal: ` I.WhethertheTrialCourterredingrantingthepartiesadivorcefromoneanotheronstipulatedgroundswhenonlyonepartywasrepresentedbycounselandtheComplaint,proseAnswer,andFinalJudgmentofDivorcewereallfiledwiththeCourtonthesameday? ` II.WhethertheTrialCourterredindenyingtheAppellantsMotiontoSetAsidepursuanttoRule60.02oftheTennesseeRulesofCivilProcedurewheretheAppellantsoughtreliefwithinthirtydaysofentryoftheCourtsjudgment,wasunrepresentedbycounselinthedivorceproceedingalthoughthepartiesmarriage ;82@ wasofalmosttwentyfiveyearsinduration,andwasmisledintobelievingthatthegrosslyinequitablejudgmentrenderedwasincompliancewiththerequirementsofthelawsoftheStateofTennessee?   ` Wefirstobservethat,althoughthemotionaddressedinissuetwopurportstobeaRule60.02motion,becauseitwasfiledwithin30daysofentryofthefinaljudgment,itisunnecessarytoresorttosuchamotionbecauseallofthequestionsraisedcouldhavebeenraisedinaconventionalmotionforanewtrial.Inthisregard,wenotethatinthelattercaseapartywouldnotbeconstrainedbytheissuelimitationsofRule60.   ` Inanyevent,itappearsthatMr.Stewartwasnotrepresentedbycounselatthefinalhearingwhich,asnotedbythefirstissueonappeal,washeldonthesamedaythecasewasfiled.  #  1      ׀ItisalsotruethatcounselforMs.Stewart,although !8 sheneverpersonallytalkedtoMr.Stewart,preparedhisanswerwhichMs.Stewartapparentlytooktohimandheagreedtosign.Moreover,thetranscriptofthehearinggrantingthedivorceisnotapartoftherecord,butitappears,ashereinaftersetoutintheTrialJudgesorderoverrulingthepostjudgmentmotion,Mr.Stewartappearedatthedivorcehearingandfullyagreedtothetermscontainedinthefinaldecree.   ` Althoughnowitnesseswerecalledinthehearingonthepostjudgmentmotion,counselstatedtotheCourttherespectivepositionoftheparties,andinresponsetheTrialJudgemadethefollowingdetermination: 5,9  ` THECOURT:Irecallthedaythatthismatterwas `  broughtupforanannouncement.Irecallhavingpreviouslyonthatdayreviewedthefileandconsideredthefactsandthemattersassetoutinthecomplaint,andthathewashere,thathedidacknowledgethatheunderstoodandagreedwiththeagreement. ` TheCourtfavorsagreements.Thepartiesagreetocontractonewiththeother.Inthiscase,wehaveanagreementwhichwasessentiallyworkedoutbetweentheseparties.Onehadanattorney.TheattorneydidnotnegotiatethiswithMr.Stewart.Henegotiatedthisessentiallyonhisownwithhiswifedirectly. ` Thematterssetforthintheagreementaresubstantial.Theobligationsaresubstantial.Butthiswasasubstantialmarriagewhereeightchildrenwereborn.Thisladydoesnothavetheeducationalbackground,theabilitytoearnaliving,ashedoes;boreeightchildrenoverthis25yearmarriage,andstillhasfourtoraise. ` InlookingatthefactorsthattheCourtwouldconsiderifithadtomakeaninitialdetermination,consideringhisincome,consideringtheamountsthatwerebaseduponhisincomeasdiscussedbetweentheparties,Icannotsayasamatteroflawanyreasonwhythisshouldbesetaside. ` Thesepartiesagreetocontractwithoneanother.Hehadtheopportunitytotalkitoverwithan attorney.Hesaneducatedman.Hesnotanattorney, 09/3 buthecertainlyknewthatifhefeltheneededanattorneytoconsultwithonhisown,hecouldhave.  ` ForallthesereasonsIcannotsaythatthisagreementshouldbesetaside.Thepartieswerebothhere,theyacknowledgedincourttheagreement,soIwillnotsettheOrderaside,baseduponthat. ` Itisreservedthatinthefutureasthesechildrengrowolder,andthingscanchange,circumstancescanchange.TheresbeennoshowingorevensuggestionthatanycircumstanceshavechangedsincetheentryofthisOrder,andthatsalwaysoutthereinthefuture.Amaterialchangeofcircumstancewouldaffectit,butforallthesereasonsIwillnotdenythemotion.   #  2       p  ` Bothpartiesdonowhaveattorneys,andthismatteristheirs.Certainly,thepartiescantalktotheattorneysandfreelycontractagainiftheychooseto,butforthepresenttime,theorderwillstand.Thankyou.   ` OurreviewoftherecordpersuadesusthatthereisnothingcontainedincounselsrepresentationstoimpeachtheTrialCourtsfindingsoffactandconclusionsoflaw.   ` Beforeconcluding,weobservethatzthezaward{s{ofchildsupporttothefourminorchildrenofthepartieswhichwillbeconvertedtoalimonyaseachreacheshisorhermajorityand|the|}of}Ϝ~awardof~alimonyisareneverfinalbutmaybemodifiedfromtimetotimeaswarrantedbychangingcircumstances.   ` FortheforegoingreasonsthejudgmentoftheTrialCourtisaffirmedandthecauseremandedforsuchfurther p5,/ proceedings,ifany,asmaybenecessaryandcollectionofcostsbelow.CostsofappealareadjudgedagainstMr.Stewartandhissurety.   `     h   _______________________________   `     h   HoustonM.Goddard,P.J.CONCUR:________________________________HerschelP.Franks,J.̜________________________________񀀀(NotParticipating)  DonT.McMurray,J.
