DanielP.Taylor( claimant)filedthissuitagainsttheStateofTennessee( defendantor State)intheTennesseeClaimsCommissionfordamagesheallegedlysustainedduetothemalpracticeofhiscourtappointedattorney.TheClaimsCommissiongranteddefendantsmotiontodismissforlackofsubjectmatterjurisdiction.Thesoleissuepresentedbythisappealiswhetherthecommissionererredinsodoing.Wefindnoerrorandaffirm.̀ In1989,theShelbyCountyCriminalCourtappointedHarryU.Scruggstorepresentclaimantinapostconvictionreliefproceeding.Mr.Scruggshandledclaimantssuitforapproximatelyfouryears.InSeptember1994,Scruggsfiledamotiontowithdrawascounselandhavenewcounselsubstituted,whichwasgranted.Thissuitfollowed. ClaimantcontendsthatScruggswasguiltyoflegalmalpractice,andasaresultnegligentlydeprivedhimofhisstatutoryandconstitutionalrights.DefendantfiledamotiontodismisspursuanttoT.R.C.P.12.02(1)&(6)onthegroundsthattheClaimsCommissionlackedsubjectmatterjurisdictiontoentertaintheaction,whichwasgranted. Article1Section17,oftheTennesseeConstitutionstatesinpartthat SuitsmaybebroughtagainsttheStateinsuchamannerandinsuchcourtsastheLegislaturemaybylawdirect.Tenn.Const.art.1,17.Inaddition,T.C.A.2013102(a)(1994)statesinpertinentpart:8 Nocourtinthestateshallhaveanypower,jurisdiction,orauthoritytoentertainanysuitagainstthestate,oragainstanyofficerofthestateactingbyauthorityofthestate,withaviewtoreachthestate,itstreasury,funds,orproperty....OurlegislaturehasexpresslygrantedtotheTennesseeClaimsCommissionexclusivejurisdictiontodetermineallmonetaryclaimsagainstthestate,classifyingsuchclaimsintovariouscategories.T.C.A.98307(a)(1)(Supp.1995). ClaimantcontendsthatScruggs,asacourtappointedattorney,wasastateemployee,whichtherebygavetheClaimsCommissionjurisdictiontoentertainhissuit.ClaimantreliesuponT.C.A.842103(b)forthisproposition,whichreadsasfollows:8 Fortheexclusivepurposeofthissection, stateemployeealsoincludesattorneysappointedbyacourt,orotheragencyauthorizedbylawtomakesuchappointments,torepresentanindigentwhenacivilactionfordamagesiscommencedagainstsuchattorneyforanyactoromissioninthecourseofrepresentingsuchindigent.8 Notwithstandinganyprovisionoflawtothecontrary,suchattorneyshallnotbeconsideredastateemployeeforanyotherpurposeincluding,butnotlimitedto,98112and98307.̜ T.C.A.842103(b)(Supp.1995)(emphasisadded). ClaimantsinterpretationofandrelianceuponT.C.A.842103(b)isinerror.ThecruxofTitle8,Chapter42oftheCodeisfoundinT.C.A.842103,entitled DefenseCounselforStateEmployees.Thissectionstatesthatundercertaindefinedconditions,astateemployeewhoissuedinacivilactionfordamagesforanyactoromissioninthecourseofhisemploymentwillbeprovideddefensecounselbythestate.T.C.A.842103(b)statesinsimpletermsthatacourtappointedattorneyassignedtorepresentanindigentwhoisthereaftersuedbytheindigentfordamagesarisingasaresultofthisrepresentationisa stateemployee,andmayavailhimselfofdefensecounselprovidedbythestate.Asnoted,T.C.A.842103(b)specificallyprovidesthatsuchattorneywillnotbeconsideredastateemployeeforanyotherpurpose,including,butnotlimitedto,T.C.A.98307,whichdelineatesthejurisdictionoftheTennesseeClaimsCommission.
