ThedefendantDonnaWarrenownedamobilehomewhichwasoccupiedbyPatriciaDunn.OnMay11,1995,GwendolynCockerhamandherdaughter,LisaTomlin,werevisitingPatriciaDunnatthetrailer.Atapproximately8:00p.m.AlphonsoBowers,armedwithasawedoffshotgun,arrivedatthetrailerandsaidhehadbeenhiredtoprotectthetrailerandtoactasabodyguard.About7:00thenextmorning,Mr.Bowersaccidentallydischargedtheshotgun,strikingLisaTomlininthefoot.  Ms.CockerhamsuedBowers,Dunn,andWarrenonbehalfofherselfandherdaughter.HertheoriesastoMs.Warrenwere(1)thatMr.BowerswasMs.Warrensemployeeandagent,and(2)thatMs.Warren,asownerinpossessionofthepremises,violatedadutyofcaretoLisaTomlinbyallowinganarmedmantooccupythepremises.OnappealtheappellantalsoarguesthatMs.Warrenwasnegligentperseinallowingasawedoffshotguntobepossessedonthepremises.  Ms.WarrenmovedforsummaryjudgmentandsupportedhermotionwithcopiesofherowndepositionandthedepositionsofMs.CockerhamandLisaTomlin.Ms.WarrensaidthatshehadmovedfromthetrailerbeforetheMay12incidentandhadleasedthetrailertoPatriciaDunninatransactionMs.Warrendescribedas leasetoown.PatriciaDunnwastopayasumofmoneyeachmonthasrentandwhenthepaymentsreachedacertainamountthetrailerwouldbehers.Ms.WarrendeniedhiringMr.Bowers,deniedknowinghewasonthepremiseswithagun,andspecificallydeniedbeingonthepremisesherselfonthedateinquestion.Shedeniedeverseeingeitheroftheappellants.ShesaidshewaslivinginLinden,TennesseeinMayof1995.  InoppositiontothesefactstheplaintiffsrelyontheirowndepositionsandanadmissionfromMs.WarrenthatsheknewwhoMr.BowerswasbecauseshehadseenhimatthetrailerafterMs.Dunnmovedin.Ms.CockerhamtestifiedinherdepositionthatMs.WarrenwaspresentatthetrailerontheeveningofMay11,1995;thatshetookashowerthereandchangedintosomeclothesshehadinthebackroom;andthatshewaspresentwhenMr.Bowerswasonthepremises.WhenpressedtodescribeMs.Warren,Ms.Cockerhamdescribedherasablackwomanwithperoxideblondehair.Ms.Warreniswhite.  Ms.CockerhamalsostatedthatMr.BowerstoldherthathehadbeenhiredbyMs.WarrenandMs.Dunntoguardthemandthetrailer.@ II.   Theappellantsarguethatthefactsbearingontheirtheoriesofliabilityareindispute.Wedisagree,andfindthattheundisputedfactsjustifysummaryjudgmentinfavorofMs.Warren.@ a.TheEmployeeRelation   ToMs.WarrenssworndenialthatshehiredMr.BowerstheappellantshaveofferedonlytheirhearsaytestimonyofwhatMr.BowerssaidtoϜthem.Rule56.05Tenn.R.Civ.Proc.,however,requiresthataffidavitssupportingoropposingsummaryjudgmentsshallsetforthfacts admissibleinevidence.ϜThetestimonyofappellantsastoMr.Bowersstatementaboutwhohiredhimisnotadmissiblebecauseitfitsthedefinitionofhearsay,Tenn.R.Evid.801(c)andisexcludedbyRule802.  Therefore,thereisnoadmissibleevidencethatMr.BowerswasnotMs.Warrensemployeeoragent.@ b.PossessionofthePremises   AgainstMs.WarrenssworndenialthatshewasinpossessionofthepremisesorwaspresentontheeveningofMay11,1995,theappellantsoffertheirsworntestimonythatMs.WarrenwaspresentonthatnightandthatMs.WarrenadmittedknowingMr.Bowers.TheappellantsalsoarguethatMs.WarrenstestimonyaboutleasingthetrailertoMs.DunnissuspectbecausethereϜarenodocumentstoshowthetransactiontookplace.  WedonotthinkanyoftheabovemakesadisputedquestionoffactonthecontrolofthepremisesonMay11,1995.Noinferencecanbedrawnfromthefactthatthetrailerwasleasedinanoraltransaction.Itisnotuncommonforthiscourttoseeoraltransactionsofamuchlargermagnitudebetweenhighlysophisticatedparties.So,Ms.Warrenstestimonyabouttheleaseisunrebuttedanditisobviouswhohadcontrolofthepremises.Afterall,theappellantswerethereattheinvitationofMs.Dunn.  TheappellantstestimonyaboutseeingMs.WarrenatthetraileronϜMay11,1995isobviouslyacaseofmistakenidentity.TheydescribedMs.Warrenasablackwomanwithperoxideblondehair.Ms.Warreniswhite.@ c.NegligencePerSe   OurdecisionwithrespecttotheemploymentofMr.BowersandwhowasincontrolofthepremisesalsodisposesoftheplaintiffsclaimthatMs.Warrenallowedasawedoffshotgunonthepremisesinviolationofthelaw.  Foranotherreason,however,thisclaimshouldbedismissed.Theappellantsfailedtoraiseitinthecourtbelow.Sincethiscourtsjurisdictionisappellateonly,Irvinv.Binkley,577S.W.2d677(Tenn.App.1978),wecannotconsiderissuesnotbroughttotheattentionofthetrialcourt.
