JayneMooreTrew,nowCornwell,(Mother)andGlenAllenTrew,Sr.(Father)weredivorcedin1993bydecreeoftheChanceryCourtforWilliamsonCounty,Tennessee.MotherwasawardedcustodyofthepartiestwominorchildrenandmovedtoSouthCarolinain1994.InJuly,1995,FatherfiledapetitionintheChanceryCourtforWilliamsonCountyseekingtomodifyorchangecustody. Wifemovedtodismissonthebasisoflackofjurisdiction,contendingthatSouthCarolinahadbecomethechildrenshomestate.ThechancellorgrantedthemotiononthebasisthatjurisdictioninthiscauseisinthestateofSouthCarolinaandHusbandappealed.Thesoleissuepresentedonappealiswhetherthetrialcourterredindismissingforlackofjurisdiction. OralargumentwaspresentedtothisCourtonMarch5,1996.Subsequently,MotherfiledamotionpursuanttoRule14T.R.A.P.askingthisCourttoconsiderasapostjudgmentfactanorderenteredInTheFamilyCourtfortheEleventhJudicialCircuitintheStateofSouthCarolina.FatherrespondedtotheRule14motionconcedingthatthepartieshadinfactreachedanagreementwhichwasapprovedbytheSouthCarolinacourtandthisCourtgrantedtheRule14motiontoconsidertheSouthCarolinaproceedingsasapostjudgmentfact. TheSouthCarolinaorderwasapprovedbythepartiesaswellastheirrespectiveSouthCarolinaattorneys.ThedocumententeredbytheSouthCarolinacourtisentitledOrderApprovingCompleteCustody,Visitation,andChildSupportAgreement.Theorderrecitesthatthepartieshavereachedanagreementandseektohaveitapprovedbythecourt,thatFatherisaresidentofTennesseeand,subsequenttothedivorce,MotherwasallowedtoremovethechildrenfromTennesseetoSouthCarolina.InJanuary1996,sheannouncedthattherewouldbeanothermovetotheStateofLouisiana.TheorderfurtherprovidesthatFatherisvestedwithsolecustodyofthepartiestwominorchildren,GlenAllenTrew,Jr.andJessieMooreTrew.Motherisallowedvisitationasspecifiedintheorder.TheorderfurtherstatesthattheSouthCarolinacourthassubjectmatterjurisdictiontomodifythepreviouscustodyandvisitationawardsandthatthepartieshavevoluntarilysubmittedthemselvestothe inpersonam jurisdictionoftheSouthCarolinacourt.Obviously,byhispositiontakenintheSouthCarolinacourt,Fatherhasabandonedhisposition,whichhearguedbeforethisCourt,thatjurisdictionlieswiththeTennesseecourt.
