ðNolanðð)€as€her€attorney€in€fact.€€œOn›ÏMattieððs€behalf,€after€the€fire,€Nolan€submitted€a€proof€of€loss€statement€and€a€ð ðpersonal€propertyÏinventoryðð€list€to€Tennessee€Farmers.€€Mattie€also€provided€Tennessee€Farmers€with€a€supplementalÏproof€of€loss.€€After€a€request€from€Tennessee€Farmers,€Mattie€submitted€to€an€examination€underÐ ðone€or€more€of€theÏdefendants€had€opportunity€to€set€the€fires€and€motive€to€do€so.ðð€€Tennessee€Farmers€asserted€thatÏNolan,€by€submitting€forms€to€Tennessee€Farmers€on€behalf€of€Mattie,€and€Jackie,€by€entering€theÏpremises€and€obtaining€personal€property€of€Mattieððs,€acted€as€agents€on€Mattieððs€behalf.€€As€ÏMattieððs€agents,€Tennessee€Farmers€contended€that€Nolan€and€Jackie€had€a€duty€under€the€policy€toÏcooperate€with€Tennessee€Farmersðð€investigation€of€the€fire€and€that€they€breached€this€duty€byÏfailing€to€submit€to€examination€under€oath.€€Tennessee€Farmers€further€alleged€that€Mattie€breachedÏthe€duty€of€good€faith€and€fair€dealing€by€refusing€to€instruct€Nolan€and€Jackie€to€submit€toÏexamination€under€oath.Ìà ñ.›€€Mattie€also€filed€a€motion€to€œdismiss,›€arguing€that€the€policy€required€onlyÏthat€she€submit€to€an€examination€under€oath,€which€she€had€done,€and€that€consequently€she€wasÏentitled€to€be€compensated€for€her€loss€under€the€policy.€€On€June€12,€1997,€Mattie€filed€two€motionsÏfor€summary€judgment,€along€with€an€affidavit,€asserting€that€she€had€complied€with€the€terms€ofÏâ âthe€policy€and€that€she€had€no€duty€to€instruct€Nolan€and€Jackie€to€submit€to€examinations€underÐ P7 26 Ðoath.€€Mattie€also€argued€that€she€was€entitled€to€summary€judgment€on€her€counterclaim€againstÏTennessee€Farmers.Ìâ âà  àOn€June€25,€1997,€Nolan€and€Jackie€filed€a€motion€for€a€protective€order€to€preventÏTennessee€Farmers€from€inquiring€into€their€alleged€marital€problems€and€financial€condition€inÏorder€to€prove€a€motive€for€destroying€Mattieððs€home.€€Tennessee€Farmers€filed€an€answer€toÏMattieððs€counterclaim,€a€motion€to€amend€the€complaint€for€declaratory€judgment,€and€a€motion€forÏpermission€to€file€a€supplemental€œpleading.€€In€its€motion€to€amend€its€complaint,€Tennessee€FarmersÏset€forth€amended€language€to€a€policy€exclusion€which€was€in€effect€at€the€time€of€the€fire.€€TheÏamended€exclusion€provides:€ð ðAny€action€other€than€accidental,€committed€by€or€at€the€direction€ofÏany€insured€person€resulting€in€a€loss€or€with€the€intent€to€cause€a€loss.€€We€do€not€cover€such€a€lossÏfor€you€or€any€insured€person.ðð€€Tennessee€Farmers€supplemental€complaint€alleges€that€the€proofÏof€loss€statement€submitted€by€Mattie€was€ð ðpretextualðð€and€designed€to€prevent€Tennessee€FarmersÏfrom€investigating€Nolan€and€Jackieððs€alleged€role€in€the€fire.€€On›€July€14,€1997,€Nolan€and€JackieÏsigned€affidavits€stating€that€the€statements€in€their€recorded€interviews€given€to€Tennessee€FarmersÏwere€true€and€correct.€€Subsequently,€Tennessee€Farmers€filed€a€motion€for€summary€judgmentÏasserting€that€they€were€entitled€to€a€judgment€on€all€issues.Ìœà  àIn›€its€motion€for€summary€judgment,€Tennessee€Farmers€described€the€statements€given€byÏNolan€and€œJackie.€€Tennessee€Farmers€alleged€that€both€Jackie€and€Nolan€had€a€key€to€MattieððsÏhouse,€that€Jackie€had€incurred€substantial€credit€card€debt€in€the€past€which€was€discharged€inÏbankruptcy,€that€Nolan€had€utilized€the€power€of€attorney€executed€by€Mattie€to€change€some€of€herÏcertificates€of€deposit€to€his€name,€and€that€Jackie€admitted€being€in€Mattieððs€home€at€2:00€p.m.€onÏthe€day€of€the€fire.€€Tennessee€Farmers€asserted€that€the€fire€was€reported€by€an€unknown€person€atÏ2:36€p.m.€after€Jackie€left,€and€that€evidence€indicated€clearly€that€the€fire€was€deliberately€set.Ìà  àIn€its€motion,€Tennessee€Farmers€did€not€allege€that€Mattie€participated€in€setting€fire€to€herÏhome.€€Rather,€Tennessee€Farmers€alleged€that€she€had€a€duty€under€the€policy€to€ð ðrequireðð€her€sonÏand€daughter„in„law€to€submit€to€examination€under€oath€by€Tennessee€Farmers,€and€that€her€refusalÏto€do€so€precluded€her€from€recovering€for€her€loss€under€the€policy.€Ìà  àOn€July€21,€1997,€the€trial€court€conducted€a€hearing€regarding€the€numerous€pendingÏmotions.€€In€an€order€filed€September€3,€1997,€the€trial€court€granted€Nolan€and€Jackieððs€motion€toÐ 09€48 Ðdismiss€for€failure€to€state€a€claim.€€Having€dismissed€the€case€as€to€Nolan€and€Jackie,€the€trial€courtÏdeemed€moot€their€motions€relating€to€discovery.€€The€trial€court€also€granted€Tennessee€FarmersÏpermission€to€file€a€supplemental€pleading€and€amend€the€complaint€for€declaratory€judgment.€ÏFinally,€the€trial€court€found€that€it€was€premature€to€hear€Mattieððs€motion€to€dismiss€and€motion€forÏsummary€judgment,€as€well€as€Tennessee€Farmersðð€motion€for€summary€judgment;€these€were€heldÏin€abeyance.€Ìà  àOn€October€2,€1997,€Tennessee€Farmers€filed€a€motion€for€leave€of€court€to€file€a›€third€partyÏcomplaint€against€Nolan€and€œJackie,›€alleging€that€the€fire€ð Ðagainst€Nolan€and€Jackie€is€understandable.€€Once€the€claim€is€paid€to€Mattie,€Tennessee€FarmersÏmay€suspect€that€Nolan€could€access€the€insurance€proceeds€by€utilizing€the€power€of€attorneyÏexecuted€by€Mattie.€€There€is€factual€basis€for€the€assertion€that€the€fire€was€deliberately€set€and€thatÏNolan€and€Jackie€had€both€motive€and€opportunity€to€set€the€fire.€€€However,€given€the€proceduralÏposture€of€this€case,€we€cannot€conclude€that€the€trial€court€erred€in€its€rulings.€€There€are€no€factsÏindicating€that€Mattie€participated€in€setting€the€fire€or€had€knowledge€of€the€alleged€plan€by€NolanÏand€Jackie€to€set€the€fire.€€The€only€allegation€against€Mattie€stems€from€her€refusal€to€ð ðdirectðð€NolanÐ 09€48 Ðand€Jackie€to€submit€to€examination€under€oath;€however,€the€policy€does€not€require€Mattie€to€doÏso.€€Thus,€Mattie€is€entitled€under€the€policy€to€be€compensated€for€her€loss.€€Until€Mattie€is€paid,ÏTennessee€Farmersðð€claim€against€Nolan€and€Jackie€does€not€arise.€€Therefore,€we€cannot€say€thatÏthe€trial€court€œabused€its€discretion›€in€denying€Tennessee€Farmersðð€motion€for€leave€to€file€a€thirdÏparty€complaint€against€Nolan€and€Jackie.€€Ìà
