Theplaintiff/appellantinthiscause,DebbieVanCleaveϜ( VanCleave),appealsthetrialcourtsgrantofsummaryjudgmentinfavorofDefendants/Appellees,MatthewandDianeMarkowski.OnOctober3,1993,VanCleavewasaguestattheMarkowskihouse.DianeMarkowskiandVanCleavewentintotheMarkowskisbackyardtothedeckareaaroundtheswimmingpool.Theywalkedonthedeckandlookedatthelandscapinginthebackyard. Thedeckareanearthepoolnormallycontainedaskimmerusedtocleanthepool.Duringthefallandwinterthepoolwascoveredandtheskimmerremoved,leavinganopeningapproximately18incheswideand3feetlong.AsVanCleavewalkedbehindMarkowski,VanCleavefellandherrightkneewentintotheopening,resultingininjuriestoherleftankle.ShelaterfiledalawsuitagainsttheMarkowskis,allegingnegligenceandseekingcompensatorydamages.̀ Afterdiscovery,theMarkowskisfiledamotionforsummaryjudgment,arguingthattheopeninginthedeckwasopenandobviousandthatVanCleavehadadmittedthisinherdeposition.Thetrialcourtfoundthat:8 ...[T]heplaintiffwasinjuredonanopeninginthedeckwhichwasclearlyvisibleandnotconcealedandthatanyonewalkingonthepremisesshouldhavebeenabletoobserveit.Consequently,thetrialcourtenteredsummaryjudgmentinfavoroftheMarkowskis. Ourreviewofthetrialcourtsordergrantingsummaryjudgmentis denovo ontherecordbeforethisCourt,withnopresumptionofcorrectness. Carvellv.Bottoms ,900S.W.2d23,26(Tenn.1995).Fromourexaminationoftherecord,itappearsthattheopeningonwhichtheplaintiffwasinjuredwas clearlyvisibleandnotconcealed,andthatthetrialcourtappropriatelyenteredsummaryjudgmentinfavoroftheMarkowskis.
