ðHusbandðð).€ÏFollowing€a€bench€trial€the€chancellor€entered€a€decree€awarding€Wife€aÏdivorce€on€the€grounds€of€irreconcilable€differences.€€The€divorce€decreeÏalso€incorporated€therein€by€reference€a€Marital€Dissolution€AgreementÍœ(ð ðMDAðð)›€awarding€custody€of€the€partiesðð€minor€child€to€Wife€as€well€asÏproviding€that€Husband€would€pay€child€support€along€with€rehabilitativeÏalimony€to€Wife.€€Thereafter€Husband€filed€a€motion€to€modify€the€divorceÏdecree€relative€to€the€payment€of€child€support€and€alimony.€€WifeÏresponded€with€a€counter„petition€seeking€to€have€Husband€held€inÏcontempt€for€failure€to€abide€by€the€terms€of€the€MDA.€€Following€aÏhearing€the€chancellor€denied€Husbandððs€petition€to€modify€relative€to€theÏpayment€of€alimony€and€child€support.€€The€court€also€found€Husband€inÏcontempt€of€court€for€failing€to€abide€by€the€provisions€of€the€MDA,Ïordered€Husband€to€disperse€funds€from€the€trust€account€of€the€partiesððÏminor€son€to€satisfy€an€outstanding€tuition€balance€at€the€sonððs€privateÏschool€and€ordered€Husband€to€pay€Wifeððs€attorney€fees,€approximatingÏ$15,000.00.€€Ìà àOn€appeal€Husband€presents€four€issues€for€our€consideration:Ïwhether€the€chancellor€erred€in:€(1)€denying€Husbandððs€petition€to€modifyÏthe€MDA€relative€to€paying€alimony€and€child€support;€(2)€finding€HusbandÏin€contempt€of€court€for€failure€to€pay€child€support€and€alimony;€(3)Ïrequiring€Husband€to€pay€his€minor€sonððs€high€school€tuition€from€a€trustÏfund€under€his€control;€and€(4)€awarding€Wife€attorney€fees.€€For€theÏreasons€hereafter€stated,€we€reverse€the€decree€of€the€chancellor€in€partÏand€otherwise€affirm.€Ìà àThe€basic€facts€are€not€in€dispute.€€The€parties€were€married€forÏtwenty„six€years€prior€to€their€separation€and€divorce€in€the€spring€ofÏ1993.€€A€son€was€born€to€the€marriage,€who€was€sixteen€years€old€at€thatÏtime.€€At€the€time€of€the€separation,€Husband€was€employed€as€SeniorÏVice„President€of€Retail€Banking€at€Community€Bank€in€Germantown,€andÏwas€earning€$79,500.00€per€year.€€Husband€had€been€employed€in€theÏbanking€business€since€1966.€€He€had€worked€his€way€up€in€the€industry€atÏbanks€throughout€the€nation,€having€changed€jobs€ten€Ñ7€MXXdðXXdð7Ñtimes€over€theÏcourse€of€twenty€years.€€Wife,€slightly€younger€than€Husband,€remained€aÏhomemaker€during€the€course€of€the€marriage.€€Following€the€divorce,€WifeÏwas€granted€a€four„year€college€scholarship€at€Carnegie„Mellon€UniversityÏin€Pittsburgh,€Pennsylvania,€which€necessitated€that€she€and€the€partiesððÏson€move€to€Pennsylvania.€€Upon€moving€to€Pittsburgh,€Wife€enrolled€theirÏson€in€a€private€high€school.€€The€annual€tuition€approximated€$7,500.00Ïper€year.€€Ìà àSome€six€months€following€the€divorce€in€September€1993,€HusbandÏwas€involuntarily€terminated€from€his€position€at€Community€Bank.€€HeÏnegotiated€a€severance€package€worth€$21,000.00€that€was€paid€to€himÏtwo€weeks€after€his€termination.€€Three€days€after€termination€HusbandÏsigned€a€Petition€to€Temporarily€Suspend€Child€Support€and€AlimonyÍPayments€and€to€Modify€the€Final€Decree,€which€was€filed€three€weeksÏlater.€€Husband€asserted€his€involuntary€terminationÔ€Ô€as€grounds€forÏmodification.€€€Ìà àThree€weeks€after€his€termination€Husband€left€Memphis€forÏPompano€Beach,€Florida,€where€he€moved€in€with€his€paramour,€Ms.€GwynÏHuggins.€€In€January€1994,€Husband€accepted€a€job€as€a€securities€brokerÏselling€stocks€and€bond€mutual€funds€on€a€straight€commission.€€HusbandÏearned€approximately€$8,000.00€from€this€employment€over€the€next€threeÏmonths.€€At€that€time€he€accepted€a€similar€position€with€the€brokerageÏsubsidiary€of€First€Union€Bank,€where€he€was€paid€a€draw€of€$3,000.00€perÏmonth.€€In€addition€he€received€nearly€$15,000.00€in€March€1994€from€theÏsale€of€stock€options€he€held€in€Community€Bank,€his€former€employer.€€Ìà àBy€March€1994,€Husband€had€fallen€behind€in€making€his€child€supportÏand€alimony€payments€to€Wife.€€Wife€filed€a€counter„petition€to€HusbandððsÏpetition€to€modify,€seeking€to€have€Husband€held€in€contempt€of€court€forÏfailing€to€timely€comply€with€the€terms€of€the€MDA,€as€well€as€seekingÏattorney€fees€and€costs€incurred€in€contesting€Husbandððs€petition.€€Ìà àFollowing€a€hearing€the€chancellor€entered€an€order€denyingÏHusbandððs€petition€to€suspend€or€modify€alimony€and€child€supportÏpayments,€finding€that€Husband€failed€to€carry€the€burden€of€proof€showingÍa€substantial€and€material€change€in€circumstances,€and€also€finding€thatÏwhile€Husband€showed€a€reduction€in€income,€he€failed€to€show€a€reductionÏor€alteration€in€his€earning€capacity.€€The€chancellor€found€Husband€inÏcontempt€of€court,€but€held€punishment€in€abeyance.€€The€amount€of€pastÏdue€alimony€and€child€support€was€reduced€to€judgment,€totalingÏ$8,075.00.€€At€that€hearing€the€chancellor€failed€to€act€on€Wifeððs€requestÏfor€attorney€fees.Ìà àWife€subsequently€filed€a€motion€œseeking›€to€have€the€court€orderÏHusband€to€disperse€funds€from€their€childððs€trust€account€to€pay€anÏoutstanding€balance€for€tuition€owed€to€a€private€school€in€Pittsburgh.€ÏHusband€filed€a€notice€of€appeal€from€the€original€order€of€the€trial€court.€ÏThis€court€dismissed€Husbandððs€appeal€on€the€grounds€that€the€orderÏappealed€from€was€not€a€final€judgment.Ìà àAfter€the€court€granted€Wifeððs€motion€to€require€Husband€to€payÏtheir€sonððs€delinquent€high€school€tuition,€Wife€filed€a€motion€calling€uponÏthe€court€to€issue€a€final,€appealable€order,€noting€that€the€court€had€notÏruled€on€the€matter€of€Husbandððs€contempt,€nor€had€the€court€acted€uponÏWifeððs€request€for€attorney€fees.€€The€motion€additionally€recited€thatÏHusband€was€still€in€contempt€and€that€he€had€married€his€paramour.€€Ìà àFollowing€a€hearing€the€chancellor€entered€a€final€order€thatÍreaffirmed€his€previous€orders,€found€Husband€in€contempt€of€the€orders€ofÏthat€court,€with€punishment€set€at€three€days€confinement€in€the€ShelbyÏCounty€jail,€with€sentence€suspended.€€In€addition,€the€court€orderedÏHusband€to€pay€Wifeððs€attorney€fees€in€the€amount€of€$14,859.67€andÏordered€Husband€to€encroach€upon€the€investment€funds€in€his€control€toÏpay€the€delinquent€tuition€œfees›€relative€to€his€childððs€education.€€ThisÏappeal€followed.Ìà@ àò òI.€The€Failure€to€Reduce€Alimony€and€Child€Support.ó óÌà àFor€the€sake€of€judicial€convenience€and€economy€we€will€considerÏHusbandððs€first€two€issues€togetherð"ðthat€of€the€trial€courtððs€refusal€toÏmodify€the€alimony€and€child€support€payments.€€The€MDA€entered€intoÏbetween€the€parties€provided€that€Husband€would€pay€Wife€rehabilitativeÏalimony€in€the€amount€of€$1,750.00€a€month€for€two€months,€followed€byÏ$1,500.00€per€month€for€the€next€46€months.€€Thereafter,€Husband€wouldÏpay€Wife€$1,800.00€per€month€as€periodic€alimony€for€72€months,€with€theÏpayments€then€reduced€to€$1,200.00€per€month€for€the€next€60€months.€ÏPayments€wouldÔ€Ô€thereafter€be€reduced€to€$700.00€per€month€and€would€beÏpaid€as€alimony€òòin€futuroóó,€with€a€condition€that€the€monthly€paymentsÏwould€decrease€dollar€for€dollar€as€Wifeððs€earnings€exceeded€$1,200.00Ïper€month.€€Ìà àParagraph€9€of€the€MDA€provides€in€pertinent€part€as€follows:ÌÓÓÌà8 àIt€is€the€express€intention€of€the€parties€that€this€award€ofÏalimony€is€for€the€purpose€of€rehabilitating€Wife,€assistingÏwith€her€education€and€living€expenses€while€she€prepares€forÏher€career.€€The€parties€expressly€intend€that€this€award€shallÏnot€be€modifiable€for€any€future€circumstances,€except€that€allÏpayments€will€cease€in€the€event€of€the€Wifeððs€death.€€SaidÏtemporary€alimony€may€be€subjected€to€modification€in€theÏevent€of€an€involuntary€termination€of€Husbandððs€currentÏemployment.ÌÌÌÓÓà àHusband€contends€that€in€accordance€with€the€language€in€theÏparagraph€set€forth€above,€inasmuch€as€the€proof€shows€that€he€wasÏinvoluntarily€terminated€from€his€employment,€the€provisions€ofÏparagraph€9€became€effective€leaving€as€the€only€matter€left€for€the€courtÏto€determine€how€much€his€alimony€payments€would€be€reduced.€€HeÏcontends€in€the€alternative€that€should€his€interpretation€of€thisÏagreement€be€incorrect,€then€and€in€that€event€he€has€shown€a€substantialÏand€material€change€in€circumstances.Ìà àIn€finding€that€Husband€had€failed€to€carry€his€burden€of€proof€in€thisÏregard,€the€trial€courtÔ€Ô€obviously€did€not€construe€this€paragraph€in€theÏsame€manner€as€Husband€did.€€We€agree€with€the€construction€rendered€byÏthe€trial€court.€€The€language€in€question€merely€provided€that€if€HusbandÏwas€involuntarily€terminated,€he€could€petition€the€court€to€modify€theÍalimony€payments.€€Accordingly,€this€court€will€look€at€this€matter€inÏlight€of€the€statutory€and€case€law€of€this€stateð"ðthat€is,€whether€HusbandÏhas€carried€the€burden€of€proving€that€there€had€been€a€substantial€andÏmaterial€change€in€his€financial€circumstances.€€Ìà àWe€give€wide€latitude€to€an€alimony€award€of€a€trial€court.€€òòCranfordÏv.€Cranfordóó,€772€S.W.2d€48,€50€(Tenn.€App.€1989).€€Our€scope€of€review€ofÏfindings€of€the€trial€court€in€this€regard€is€òòde€novoóó€review€of€the€recordÏpresented€to€us.€€Absent€an€error€of€law,€the€findings€of€fact€of€the€trialÏcourt€come€to€this€court€with€a€presumption€of€correctness€and€we€mustÏaffirm€unless€we€find€that€the€preponderance€of€evidence€is€otherwise.€Ï13(d)€T.R.A.P..Ìà àHusbandððs€motion€before€the€trial€court€sought€to€temporarilyÏsuspend€his€alimony€and€child€support€payments€for€a€reasonable€period€ofÏtime€until€he€obtained€new€employment€and,€in€addition,€to€modify€theÏchild€support€and€alimony€payments€that€were€to€begin€some€time€in€theÏfuture€ð ðto€a€reasonable€amount€based€upon€the€financial€circumstances€ofÏthe€parties.ðð€€In€his€argument€before€the€œchancellor›€Husbandððs€attorneyÏconceded€that€there€was€no€question€but€that€the€needs€as€shown€by€WifeÏwere€real€and€deserving.€€Therefore€in€examining€this€sub„issue€we€lookÏonly€at€any€real€changes€in€the€ability€to€pay€on€the€part€of€Husband€and€toÍascertain€whether€or€not€these€changes,€if€any,€were€both€substantial€andÏmaterial.Ìà àIt€is€undisputed€that€immediately€following€his€loss€of€employmentÏwith€Community€Bank€in€September€1993,€that€his€earnings€declinedÏsubstantially.€€The€record€reflects€thatÔ€Ô€at€this€time€Wife€and€the€partiesððÏson€had€moved€to€Pittsburgh,€where€she€had€begun€her€college€education.€ÏShortly€after€his€employment€was€terminated€Husband€broke€the€lease€onÏhisÔ€Ô€apartment€in€Memphis€and€moved€to€Pompano€Beach,€Florida€where€heÏmoved€in€with€his€girlfriend.€€Husband€testified€thatÔ€Ô€after€reaching€FloridaÏhe€sent€out€resumes€all€over€the€southeast,€but€received€no€favorableÏresponses.€€Ìà àEventually€he€obtained€a€job€with€a€brokerage€firm€in€Florida€whereÏhis€only€compensation€was€straight€commission,€with€no€draw.€€HeÏtestified€that€for€the€first€three€months€of€1994€he€earned€$500.00,Ï$3,600.00€and€$3,000.00,€respectively.€€In€May€1994,€Husband€took€aÏsimilar€job€with€the€brokerage€division€of€First€Union€Bank,€which€paid€aÏ$3,000.00€per€month€draw€for€the€first€three€months.€€Also€during€thisÏperiod€he€exercised€his€stock€options€on€Community€Bank€stock,€receivingÏapproximately€$33,000.00€from€the€sale€of€that€stock.€€Of€this€amount€heÏpaid€$17,000.00€to€his€brother€to€repay€a€loan€taken€out€to€purchase€theÍstock.€€He€paid€no€alimony€in€February,€but€paid€some€child€support.€€WithÏthe€money€from€the€sale€of€the€bank€stock,€while€he€paid€some€arrearage,Ïhe€used€a€substantial€amount€to€pay€debts€and€loans.Ìà àHusband€admitted€that€shortly€after€his€termination€Community€BankÏpaid€him€$21,000.00€in€severance€pay,€but€that€nevertheless€he€proceededÏto€file€this€petition.€€He€further€admitted€that€the€total€deposits€to€hisÏbank€account€from€October€6,€1993€to€August€15,€1994€were€$61,262.00.€ÏHe€states€that€of€this€amount€$32,250.00€came€from€the€exercise€of€hisÏstock€option€with€the€ensuing€sale€thereof,€with€$17,000.00€as€aforesaidÏbeing€paid€to€brother.€€He€paid€$6,800.00€to€American€Express.€€He€statedÏfurther€that€he€was€current€at€that€time€on€child€support€and€alimony,€butÏfrom€March€1994€to€the€date€of€trial€in€August€1994,€he€fell€into€arrearsÏsome€$7,600.00.€€The€record€reflects€that€for€the€period€January€throughÏAugust,€he€owed€a€total€of€$12,500.00€in€combined€alimony€and€childÏsupport,€but€paid€only€$4,900.00.€€Ìà àWhile€Husbandððs€monthly€income€had€been€substantially€reduced,Ïnonetheless,€during€this€period€of€time€Husband€found€himself€withÏsubstantial€amounts€of€cash€on€hand,€both€from€his€severance€pay€and€theÏsale€of€Community€Bank€stock.€€Husband,€along€with€Wife,€negotiated€andÏagreed€to€the€provisions€in€the€MDA€relative€to€the€payment€of€alimony.€ÍWhile€he€had€petitioned€the€court€for€temporary€termination€and€reduction,Ïhe€had€no€clearance€from€the€court€to€renege€on€his€obligation€to€hisÏformer€Wife€for€the€sake€of€paying€debts.€€We€resolve€this€issue€in€favorÏof€Wife.Ìà àWe€now€address€the€other€sub„issue€involved€in€this€particularÏmatter,€that€of€the€refusal€of€the€chancellor€to€grant€Husband€relief€in€hisÏchild€support€payments,€which€had€been€set€by€the€MDA€at€$1,000.00€perÏmonth.€€In€the€chancellorððs€order€on€the€petition€to€temporarily€suspendÏand€modify,€the€court€said:ÌÓÓÌà8 àThe€Court€further€finds€that€the€Petition€to€Suspend€or€ModifyÏAlimony€and€Child€Support€Payments€should€be€denied.€€Again,Ïin€so€finding,€the€Court€notes€that€the€burden€of€showing€aÏsubstantial€and€material€change€in€circumstances€was€not€met.Ï.€.€.ÌÌÌÓÓà àIn€òòJones€v.€Jonesóó,€870€S.W.2d€281€(Tenn.€1994),€our€supreme€courtÏheld€that€the€Child€Support€Guidelines€(hereafter€ð ðœCSG›ðð)€codified€as€T.C.A.Ïðþÿð€36„5„101(e)(1)€òòet€seqóó.,€expressly€provide€that€they€are€to€be€applied€inÏany€action€brought€to€establish€or€modify€child€support.€€Prior€to€July€1,Ï1994,€trial€courts€could€modify€existing€child€support€orders€based€upon€aÏshowing€of€ð ða€substantial€and€material€change€in€circumstances.ðð€€òòSeeóóÏT.C.A.€ðþÿð€36„5„101(a)(1)(1991)(Amended€1994).€€However,€the€legislatureÍreplaced€this€standard€in€1994€with€a€more€precise€one€now€popularlyÏknown€as€the€ð ðsignificant€variationðð€test,€which€requires€the€court€toÏdecree€ð ðan€increase€or€decrease€of€such€allowance€when€there€is€found€toÏbe€a€significant€variance,€as€defined€in€the€Child€Support€Guidelines€.€.€.€Ïbetween€the€guidelines€and€the€amount€of€support€currently€ordered.€.€.€.ðð€ÏòòTurner€v.€Turneróó,€919€S.W.2d€340,€343€(Tenn.€App.€1995).€Ìà àIn€accordance€with€the€amended€statute,€the€Department€of€HumanÏServices€promulgated€a€public€necessity€rule€that€set€forth€a€ð ðsignificantÏvariationðð€rule€for€the€courts€to€employ€under€these€circumstances.€€BothÏthe€amended€statute€and€the€amended€rule€became€effective€July€1,€1994.€€Ìà àThe€earlier€of€the€two€hearings€that€led€to€the€trial€courtððs€orderÏtook€place€on€August€18,€1994.€€It€is€conceded€by€Wife€in€her€brief€and€weÏlikewise€affirm€that€the€ð ðsignificant€variationðð€test€set€out€in€theÏcurrent€CSG€as€amended€should€have€been€applied€by€the€chancellor,€ratherÏthan€the€earlier€guideline€of€ð ðsubstantial€and€material€change€inÏcircumstances.ðð€€Accordingly,€we€reverse€the€decree€of€the€chancellorÏdenying€Husbandððs€petition€to€temporarily€terminate€and€modify€the€MDAÏas€it€relates€to€child€support,€and€upon€remand,€respectfully€direct€theÏchancellor€to€conduct€an€evidentiary€hearing€under€the€current€CSG€inÏorder€to€ascertain€what,€if€any,€modifications€need€to€be€made€in€the€childÍsupport€payments€for€the€specific€period€involved€under€the€proof€asÏpresented.€€While€we€see€nothing€in€this€record€to€justify€a€completeÏtemporary€termination€of€child€support€payments,€we€leave€this€matter€toÏthe€chancellor€as€well.Ìà@ àò òII.€The€Contempt€of€Court€Issue.ó óÌà àHusband€contends€that€the€trial€court€erred€in€finding€him€inÏcontempt€of€court€for€failure€to€timely€pay€alimony€and€child€supportÏpursuant€to€the€MDA.€€At€the€time€of€trial€the€record€reflects€that€HusbandÏowed€$3,040.00€for€child€support€and€$4,560.00€for€alimony.€€Ìà àA€finding€of€contempt€by€the€trial€court€comes€to€us€on€appeal€withÏthe€presumption€of€correctness.€€òòJohnson€v.€Johnsonóó,€499€S.W.2d€268€(Tenn.ÏApp.€1973).€€In€addition,€a€failure€to€comply€with€a€decree€for€the€paymentÏof€alimony€places€the€obligor€òòprima€facieóó€in€contempt€of€court€and€putsÏupon€him€the€burden€of€proving€his€inability€to€make€the€payments€asÏdirected.€€òòChappell€v.€Chappellóó,€261€S.W.2d€824,€831€(Tenn.€App.€1952).Ìà àFollowing€the€hearing€on€contempt,€as€well€as€other€matters,€theÏchancellor€entered€an€interim€order,€which€contained€the€followingÏpertaining€to€the€contempt€charge:ÌÓÓÌà8 à1.€That€the€Petitioner€James€R.€Virostek€is€in€òòwillful€contemptóóÏof€this€Courtððs€Order€on€the€payment€of€alimony€and€childÍsupport.€€In€so€finding,€the€Court€specifically€notes€that€theÏburden€of€proof€was€upon€Mr.€Virostek€to€show€his€inability€toÏmake€the€Court€Ordered€payments,€and€that€Mr.€Virostek€failedÏto€show€an€ability€to€make€payments,€while€clearly€showingÏthe€ability€to€discharge€his€personal€debts.Ì€Ìà8 àà àIn€so€finding,€the€Court€further€notes€that€the€publicÏpolicy€of€Tennessee€is€to€punish€by€contempt€the€party€who,Ïthrough€willful€disobedience€or€obstinacy,€refuses€to€complyÏwith€a€Court€Order.ÌÌÓÓThe€chancellor€held€in€abeyance€the€specific€punishment€for€contemptÏpending€further€orders€of€the€court.€€In€its€final€order,€the€chancellorÏsentenced€Husband€to€three€days€confinement€in€the€Shelby€County€jail,Ïbut€with€the€sentence€to€be€suspended.€€Ìà àFrom€reviewing€this€record,€we€are€of€the€opinion€that€the€evidenceÏdoes€not€preponderate€against€the€finding€of€the€chancellor€that€HusbandÏwas€in€willful€contempt€of€that€courtððs€orders€relative€to€the€payment€ofÏalimony€as€well€as€child€support.€€This€failure€by€Husband€is€a€ð ðcivilÏcontempt€proceedingðð€and€the€court€had€no€authority€in€our€opinion€toÏcommit€Husband€to€jail€for€a€definite€period€of€time,€but€only€could€haveÏcommitted€him€for€an€indeterminate€sentence€until€the€amount€of€alimonyÏin€arrears€was€paid.€€While€the€chancellor€did€not€ever€place€the€labelÏð ðcriminal€contemptðð€on€the€conduct€of€Husband,€by€this€determinateÏsentence€he€did€affix€such€a€label.€€In€addition,€the€appropriate€noticeÍrequirements€pertaining€to€a€criminal€contempt€proceeding€were€notÏcomplied€with.€€Accordingly,€we€are€of€the€opinion€that€while€theÏchancellor€was€correct€in€finding€Husband€in€contempt€of€court,€he€was€inÏerror€in€making€the€contempt€criminal€in€nature.€€We€therefore€reverse€theÏchancellor€insofar€as€the€determinate€jail€sentence€is€concerned,Ïnotwithstanding€the€fact€that€it€was€suspended.Ìà@ àò òIII.€The€Custodial€Trust€Fund.ó óÌà àHusband€contends€that€the€trial€court€was€in€error€in€requiring€himÏto€encroach€upon€a€trust€fund€of€the€partiesðð€son€for€the€purpose€of€payingÏan€outstanding€tuition€balance€incurred€at€a€private€high€school€after€WifeÏand€son€moved€to€Pittsburgh.€€Husband€contends€that€the€funds€in€thisÏaccount€were€a€gift€to€their€son€from€a€great„aunt€for€the€express€purposeÏof€assisting€the€parties€in€paying€the€sonððs€college€education.€€Ìà àDuring€the€marriage€the€parties€had€by€choice€sent€their€son€to€aÏprivate€high€school€in€MemphisÔ€Ô.€€The€record€shows€that€on€previousÏoccasions,€while€yet€marriedÔ€Ô,€the€parties€had€invaded€this€trust€fund€inÏorder€to€pay€high€school€tuition€for€their€child€when€living€in€Memphis.€ÏThe€contention€by€Husband€that€this€fund€was€for€the€sole€use€of€the€sonððsÏcollege€education€is€not€persuasive.€€Under€the€circumstances,€we€are€ofÏthe€opinion€that€the€trial€court€did€not€abuse€its€discretion€in€directing€inÍthis€one€instanceÔ€Ô€that€the€balance€of€a€yearððs€tuition€be€paid€from€thisÏfund.€€This€issue€is€without€merit.Ìà@ àò òIV.€Wifeððs€Attorney€Fees.ó óÌà àThe€trial€court€is€given€wide€discretion€in€the€allowanceÔ€Ô€of€attorneyÏfees,€considered€in€divorce€cases€to€be€a€form€of€alimony.€€This€court€willÏnot€interfere€except€upon€a€showing€of€an€abuse€of€discretion€by€the€trialÏcourt.€€òòThreadgill€v.€Threadgillóó€740€S.W.2d€419,€426€(Tenn.€App.€1987).€€ItÏis€Husbandððs€contention€that€the€trial€court€abused€its€discretion€inÏdirecting€Husband€to€pay€Wifeððs€attorney€fees€incurred€in€defending€theÏpetition€to€modify€filed€by€Husband.€€Ìà àWe€are€of€the€opinion€that€this€issue€is€without€merit.€€In€òòCranford€v.ÏCranfordóó,€772€S.W.2d€48€(Tenn.€App.€1989)€this€court€reversed€the€trialÏcourtððs€decision€to€award€wife€only€one„half€of€her€attorney€fees€inÏconnection€with€her€resistance€to€husbandððs€efforts€to€terminate€theÏcourt„ordered€alimony,€and€awarded€wife€the€full€amount€of€her€attorneyÏfees,€including€those€fees€incurred€on€appeal,€noting€that€wife€in€that€caseÏlacked€the€resources€to€pay€her€legal€fees€and€incurred€them€only€becauseÏof€husbandððs€efforts€to€terminate€his€support€obligation.€€òòòòId.óóóó€at€52.€Ìà àIn€the€case€before€us,€the€record€is€clear€that€Wife€has€virtually€noÏassets€to€speak€of€from€which€to€pay€these€fees.€€She€is€currently€seekingÍto€obtain€a€college€degree€so€as€to€develop€her€financial€independence.€ÏWife€has€been€forced€to€incur€these€expenses€only€because€of€HusbandððsÏefforts€to€terminate€and/or€modify€his€child€support€and€alimonyÏobligations,€the€grounds€for€which€are€suspect,€to€say€the€least.€€In€ourÏopinion€the€trial€court€did€not€abuse€its€discretion€in€ordering€the€paymentÏof€Wifeððs€legal€fees€for€expenses€incurred.€Ìà àWife€has€also€asked€this€court€to€award€her€attorney€fees€for€legalÏexpenses€incurred€in€connection€with€this€appeal.€€We€are€of€the€opinionÏthat€she€is€entitled€to€be€compensated€for€these€expenses.€€Upon€remand,Ïthe€trial€court€is€directed€to€hold€an€appropriate€hearing€and€ascertain€theÏamount€of€her€attorney€fees€Husband€should€be€ordered€to€pay.ÌÔ€Ôà àThe€decree€of€the€trial€court€sentencing€Husband€to€three€days€in€jailÏis€reversed.€€The€decree€denying€Husbandððs€petition€to€terminate€andÏmodify€child€support€payments€is€reversed.€€This€matter€is€remanded€toÏthe€Chancery€Court€of€Shelby€County€for€a€hearing€in€keeping€with€theÏprovisions€of€this€opinion.€€The€decree€of€the€trial€court€is€otherwiseÏaffirmed.Ìà àWife€is€entitled€to€attorney€fees€for€service€rendered€on€appeal.€€TheÏchancellor€is€directed€on€remand€to€conduct€a€hearing€to€determine€theÏamount.€€Costs€in€this€cause€on€appeal€are€taxed€to€Husband,€for€whichÍexecution€may€issue,€if€necessary.Ìà
