OnAugust21,1995,thedefendantsmovedforsummaryjudgmentsupportedbyaffidavitthatthecomputationoftheprojectedtimeofplaintiffsincarcerationwascorrectlycomputedtoextendtotheyear2027subjecttofutureentitlementtoPrisonerSentenceReductionCredits. Noevidencewasfiledbyplaintiff;and,onOctober30,1995,theTrialCourtentereda MemorandumandOrdersettingoutundisputeddispositivefactsandthelawapplicabletheretoandgrantingsummaryjudgmentinfavorofalldefendants.Thejudgmentcontainsthefollowingprovision:8 8 ...Becausethepetitionerfiledhisoathasapauper,theCourtdeterminesthatonlystatelitigationtaxisassessedagainstthepetitioner.̛̜ Onappeal,plaintiffpresentsthefollowingissues:8 8 I.DidtheChanceryCourterrindismissingtheapplicationforadeclaratoryorderwithoutallowingprosepetitionerahearing?8 8 II.WastheChanceryCourtcorrectindenyingpetitionerthereliefherequested, earnedsentencecredits,towhichheisentitledasamatteroflaw?̛̜ TRCPRule56providesforsummaryjudgments.Rule56.05providesinpertinentpartasfollows:8 8 FormofAffidavitsFurtherTestimonyDefenseRequired. ...Whenamotionforsummaryjudgmentismadeandsupportedasprovidedinthisrule,anadversepartymaynotrestuponthemereallegationsordenialsofhispleading,buthisresponse,byaffidavitsorasotherwiseprovidedinthisrule,mustsetforthspecificfactsshowingthatthereisagenuineissuefortrial.Ifhedoesnotsorespond,summaryjudgment,ifappropriate,shallbeenteredagainsthim....̛̜ Onceamovingpartyhasmadeaproperlysupportedmotionforsummaryjudgment,theburdenofproductionofevidenceshiftstothenonmovingpartytoproduceevidencewhichwillproduceagenuineissueastoamaterialfact.Braswellv.Carothers,Tenn.App.1983,863S.W.2d722. Unswornallegationsoffactinpleadingorbriefdonotcreateanissueastofactsshownbyswornevidence. Forlackofademonstratedissueastoamaterialfact,andunderthelawapplicablethereto,thedefendantsareentitledtosummarydismissal. ThequotedprovisionofthejudgmentrelievingplaintiffofcostsisnotconsonantwithϜTCA2012133whichprovides:8 8 Judgmentagainstpauper. Onfailure,foranyreason,toprosecutetheactionorsuitwitheffect,judgmentordecreeshallbegivenagainstsuchpoorpersons,andexecutionawarded,asinothercases.̛̜ ThejudgmentoftheTrialCourtismodifiedtorenderjudgmentagainstplaintiffforcostsforwhichexecutionmayissue.Asmodified,thejudgmentisaffirmed.PursuanttoϜTCA271122,thisappealisherebydeclaredtobeafrivolousappeal.UponremandtheTrialCourtwillhearevidenceandfixtheamountofdamages.Justdamages.Costsofthisappealareassessedagainsttheplaintiff.
