(a)Acounterclaimorthirdpartycomplaintorcrossclaimisnotbarredbytheapplicablestatuteoflimitationsoranystatutorylimitationoftime,howevercharacterized,ifitwasnotbarredatthetimetheclaimsassertedinthecomplaintwereinterposed.      AftertheChancellorrenderedhisopinion,whichrelieduponappellatedecisionsofsisterstates, n   ׀ourSupremeCourt,inWeaverv.Hamrick,907S.W.2d385(Tenn.1995),heldthatpendencyofabankruptcyproceedingdidnotsuspendtherunningofalienenforcementperiodand,consequently,suitmustbefiledwithinthe30daylimitsetoutin11U.S.C.A.108(c).  InlightofWeaver,counselfortheDefendantsalsoconcedesthattheChancellormaynotbesustainedonthefirstground.  Astothesecondground,WestPointeinsiststhatthecounterclaimdidnotmeetthe30dayrequirementofT.C.A.282111asthetimeshouldbecountedfromthedatetheBankruptcyJudgepronouncedhisopinioninthepresenceofcounselfortheDefendantsonDecember1,ratherthanwhenitwasentered,onDecember2.  Wenotethattherecorddoesnotdisclose,asevidencedbystipulation20,hereinbeforesetout,andexhibit30,referredtotherein,thattheDefendantsandtheircounselwerepresentonNovember1.Wewill,however,assumethistobethecase.  ItisWestPointe'sinsistencethatthe30dayperiodsetoutinU.S.C.A.108(c)beganonDecember1,thedatetheϜBankruptcyJudgeannouncedthathewasdismissingthepetition.Hisorder,however,wasnotentereduntilthenextday.  Wehavenodifficultyinfindingthatthetimeshouldbecalculatedfromthedatetheorderwasenteredratherthanthedateitwaspronounced.This,inourview,makesforamoreorderlyprocedureinthatthereisnoquestionwhenanorderhasbeenenteredandtheremaybeaquestionwhenitispronouncedorwhetherthepartiestobechargedhadnoticeofthepronouncement.  InreachingourconclusionwearenotunmindfulofthecaseofNoliv.C.I.R.,860F.2d1521(9thCir.1988),citedbyWestPointe.Inthatcasethebankruptcyjudgeorallyliftedastaysothatataxcourtproceedingagainstthedebtor,whichwasinprogress,couldcontinue.Onthesamedaytheorderwasliftedthetaxcourtproceedingcontinuedandonappealthedebtorinsistedtheproceedingswereinvalidbecausetheordermemorializingthecourt'sactionwasnoteffectiveuntilenteredinaccordancewiththerequirementsofRule59 o   ׀oftheFederalRulesofCivilProcedure.̜  Indisposingofthisissueandgivingsupporttoourresolutionofthequestion,the9thCircuitstatedthefollowing(atpage1525):     Petitioners'argumentsconcerningthelegalproprietyoftheTaxCourttrialproceedingsaredevoidofmerit.First,theyarguethatthebankruptcycourt'soralordergrantingrelieffromtheautomaticstaywasneitherproperlyrenderednordocketedbythebankruptcycourt.Thus,theycontendnovalidjudgmentexistedwhichwouldallowtheTaxCourttocontinuethetrialproceedings. ThisargumentmisperceivesboththepurposeofFed.R.Civ.P.58,andthebindingeffectofanordernotwithstandingtheissuingcourt'sfailuretoenteritonthedocket.The"separatedocument"requirementofRule58wasintendedprimarilytoclearupuncertaintiesindetermining,forpurposesofappellatereview,whenthereisafinalappealablejudgment.SeeBankersTrustCo.v.Mallis,435U.S.381,384,98S.Ct.1117,1120,55L.Ed.2d357(1978)(The"solepurpose"oftheseparatedocumentrequirementis"toclarifywhenthetimeforappeal...beginstorun").Similarly,thebankruptcycourt'sorderliftingthestaywaseffectiveandbindingupontheparties.Thepetitionersmakenoclaim,norcouldthey,thattheywereprejudicedbythebankruptcycourt'sfailuretoenteraseparatejudgment.See,e.g.,Harrisv.McCarthy,790F.2d753,757(9thCir.1986).Theywerepresentwhentheoralorderwasissuedandclearlyhadnoticeofitsexistenceandcontent.Moreover,petitionersunderstoodandacceptedtheorderasfinalforpurposesofappeal.TheyfiledatimelyappealfromthatorderandthereasonforapplicationofRule58issimplynotapplicablehere.      WealsonotethatthedebtorinNoliwasusingeverymeansavailabletohinderanddelayproceedingsinthetaxcourt.Moreover,thatcasedidnotinvolveadeterminationofthebeginningdateofaperiodwhenactionmustbetaken.  Finally,astotheissuerelativetotheenforceabilityofthelien,wehaveexaminedtheothercontentionsofWestPointeoriginalmortgagorsnotmadeapartytothesuit,equitableestoppel,publicpolicyunderlyingT.C.A.282111(a)andfindthemtobewithoutmerit.  WestPointealsocontendsthattheonlyattorneyfeesandexpensestowhichtheDefendantsareentitledarethoseincidenttotheforeclosureofthetrustdeedandnotthoseincurredinconnectionwiththedefenseofthepresentsuit.Wedonotchoosetonarrowlyconstruetheprovisionsofthetrustdeedrelativetoattorneyfeesandexpenses,observingthatitwasabsolutelynecessarythatthiscasebedefendedbeforetheDefendantscouldforeclosethetrustdeed.  Lastly,WestPointearguesthattheTrialCourtwasinerrorinadjudgingtheamountthelienofthetrustdeedsecured,insistingthatitonlysecurestheprincipalamountandtheinterestaccruinguntilthenotebecametimebarred.Noauthorityiscitedforthisinsistenceandwecannotconceiveofareasonalienwouldremainviableastoadebtandinterestaccruingbeforebeingtimebarredbythesixyearstatuteoflimitations,butnotastointerestaccruingthereafter.  Inconclusion,wepointoutthatwecannotfindonesingleequityinthiscasefavoringWestPointe.  FortheforegoingreasonsthejudgmentoftheTrialCourtisaffirmedandthecauseisremandedfordeterminationofattorneyfeesandexpensesincidenttothisappeal,collectionofcostsbelow,andsuchotherproceedingsasmaybenecessary.CostsofappealareadjudgedagainstWestPointeanditssurety.      _______________________________      HoustonM.Goddard,P.J.CONCUR:________________________________HerschelP.Franks,J.________________________________CharlesD.Susano,Jr.,J.
