àThis€is€an€appeal€from€a€final€divorce€decree.€€Appellant€Gordon€Lee€WhisenhuntÏ(ð ðHusbandðð)€challenges,€òòò òinter€aliaó óóó,€the€amounts€awarded€to€Appellee€Glenda€Joan€CollinsÏWhisenhunt€(ð ðWifeðð)€for€child€support,€alimony,€marital€debts,€and€attorneysðð€fees.€€We€affirm€asÏmodified.Ìà àHusband€and€Wife€were€married€for€twenty€years.€€They€have€two€children€together,€oneÏof€whom€reached€the€age€of€majority€prior€to€the€trial€of€this€case.€€The€remaining€child€was€aÏminor€at€the€time€of€the€trial,€and€reached€majority€in€May€1996.€€Wife€was€approximately€fifty„four€years€old€at€the€time€of€the€trial€and€œhad›€worked€outside€the€home€for€only€a€few€weeks€duringÏthe€marriage.€€She€suffers€from€severe€osteoarthritis,€which€prevents€her€from€obtaining€outsideÏemployment.€€During€the€marriage,€she€cared€for€the€home,€cooked€and€cleaned,€and€took€care€ofÏtheir€children.€Husband€was€approximately€fifty„three€years€old€at€the€time€of€the€trial€and€hasÏworked€for€Buckeye€Cellulose,€formerly€Proctor€&€Gamble€Cellulose,€for€over€twenty„two€years.€Ïà àBy€decree€entered€on€August€4,€1994,€the€trial€court€granted€a€divorce€to€Wife,€citingÏHusbandððs€inappropriate€marital€conduct.€€Based€on€his€1993€W„2€form,€showing€an€income€ofÏ$49,480.56,€the€trial€court€ordered€the€Husband€to€pay€$143.53€per€weekò ò€ó óin€child€support€for€theÏremaining€minor€child,€beginning€on€August€1,€1994.€€The€1993€W„2€form€included€overtimeÏincome.€€The€trial€court€awarded€Wife€$350€per€week€in€rehabilitative€alimony,€with€paymentsÏbeginning€on€August€1,€1994€and€continuing€until€Husband€reaches€the€age€of€sixty„two.€€Ìà àThe€trial€court€also€awarded€the€marital€home€to€Wife,€making€her€responsible€for€theÏremaining€mortgage€payments.€€The€court€then€ordered€Husbandððs€retirement€account,€credit€unionÏaccount,€and€other€accounts€to€be€divided€with€Wife€as€marital€property.€€The€trial€court€furtherÏordered€that€Husband€receive€the€first€$10,000€out€of€these€accounts€to€compensate€him€for€hisÏequity€in€the€house.€€The€joint€marital€debts€and€Wifeððs€attorneysðð€fees€and€litigation€expenses€wereÍalso€to€be€paid€out€of€these€accounts.€€The€court€ordered€the€remaining€funds€in€the€accounts€splitÏbetween€Husband€and€Wife€equally.Ìà àIn€affidavits€filed€with€the€court,€Wife€listed€monthly€expenses€totaling€$2158.96œ× ƒ0 ××  ×›€and€theÏmarital€debts€totaling€$13,163.87.€€In€addition,€the€record€indicates€that€Wifeððs€attorneysðð€fees€andÏlitigation€expenses€totaled€$17,865.œ× ƒ1 ××  כ̀€€€à àSubsequently,€the€trial€court€entered€a€Qualified€Domestic€Relations€Order€(ð ðQDROðð)€toÏimplement€its€ruling€with€respect€to€Husbandððs€profit€sharing€account€with€Proctor€&€Gamble.€€InÏthe€QDRO,€the€court€awarded€Husband€the€first€$10,000€in€the€account€and€then€awarded€WifeÏ$43,200,€apparently€to€cover€the€marital€debts€as€well€as€her€attorneysðð€fees€and€litigationÏexpenses.€€The€record€reflects€that€Proctor€&€Gamble€is€required€to€deduct€twenty€percent€of€ÏWifeððs€award€for€withholding€taxes,€which€would€leave€her€with€a€net€sum€of€$34,560.€€The€courtÏthen€split€the€remaining€funds€equally.€€Husband€appeals€the€trial€courtððs€decision.€€Ìà àOur€review€of€this€case€is€ò òòòde€novoó óóó€upon€the€record€with€a€presumption€of€correctness€ofÏthe€findings€of€fact€by€the€trial€court.€€Absent€error€of€law,€the€trial€courtððs€decision€will€beÏaffirmed,€unless€the€evidence€preponderates€against€the€factual€findings.€€Tenn.€R.€App.€P.€13(d).€ÏNo€presumption€of€correctness€attaches€to€the€trial€courtððs€conclusions€of€law.€€€òòò òSee€Carvell€v.ÏBottomsó óóó,€900€S.W.2d€23,€26€(Tenn.€1995).€€€Ìà àOn€appeal,€Husband€argues€that€the€judgment€of€the€trial€court,€as€set€forth€in€the€transcriptÏof€the€proceedings,€is€ambiguous,€unsupported€by€the€evidence,€and€not€accurately€reflected€in€theÏfinal€decree€of€divorce€and€the€QDRO€entered€œby€the›€trial€court.€€In€addition,€he€contends€œthat€the›Ïtrial€court€erred€in€including€his€overtime€pay€as€income€for€determining€the€amount€of€childÍsupport€and€alimony€payments.€€Husband€also€maintains€that€the€alimony€award€is€excessive.€€TheÏgranting€of€the€divorce€itself€is€not€an€issue€in€this€appeal.Ìà àHusband€first€seeks€a€review€of€the€oral€statements€made€by€the€trial€court,€arguing€thatÏthey€are€inconsistent€with€the€written€final€decree€of€divorce.€However,€it€is€well€settled€that€a€courtÏð ðspeaks€only€through€its€written€judgments.ðð€€ò òòòSparkleó óóó€òòò òLaundry€&€Cleaners,€Inc.€v.ÏKeltonó óóó,€595€S.W.2d€88,€93€(Tenn.€App.€1979).€€Consequently,€the€oral€statements€of€the€trialÏcourt€are€of€no€effect€unless€those€oral€statements€are€made€a€part€of€a€written€order.€€ò òòòId.ó óóó;òòò ò€ShelbyÏv.€Shelbyó óóó,€696€S.W.2d€360,€361€(Tenn.€App.€1985).€€€Therefore,€we€are€limited€to€reviewingÏthe€trial€courtððs€written€orders.€€à àÌà àIn€this€case,€the€trial€court€ordered€Husbandððs€profit€sharing€plan€to€be€divided€with€WifeÏso€as€to€pay€off€the€marital€debts,€as€well€as€her€attorneysðð€fees€and€litigation€expenses.€€As€notedÏabove,€the€record€indicates€that€the€joint€marital€debts€totaled€$13,163.87,€while€Wifeððs€attorneysððÏfees€and€litigation€expenses€totaled€$17,865,€resulting€in€a€€net€sum€of€$31,028.87.€€In€the€QDRO,Ïthe€trial€court€awarded€Wife€$43,200€to€pay€off€these€expenses.€€The€source€of€this€figure€isÏunclear.€€Under€the€QDRO,€after€€a€twenty€percent€deduction€for€withholding€taxes,€Wife€wouldÏreceive€a€net€sum€of€$34,560.€€However,€the€record€supports€an€award€to€Wife€which€would€netÏonly€a€sum€of€$31,028.87.€€Ìà àConsequently,€the€QDRO€shall€be€modified€to€result€in€an€award€which€would€net€to€Wife€aÏtotal€equal€to€the€amount€of€marital€debts,€attorneysðð€fees,€and€litigation€expenses€that€are€supportedÏby€the€record.€€The€award€is€hereby€reduced€to€$38,786,€which,€with€a€twenty€percent€withholdingÏtax€deduction€of€$7757,€will€net€Wife€a€sum€of€$31,029.€€The€trial€courtððs€decision€is€affirmed€asÏmodified€on€this€issue.Ìà àHusband€next€argues€that€the€trial€court€erred€in€including€his€overtime€pay€as€income€toÏdetermine€the€amount€of€child€support€that€he€should€pay,€citing€ò òòòIn€re€Linebaughó óóó,€No.€03A01„9309„JV„00310,€1994€WL€17074€(Tenn.€App.€Jan.€24,€1994).€€In€that€case,€a€husband€challengedÏthe€amount€of€child€support€awarded€by€a€trial€court.€€ò òòòId.€ó óóóat€*1.€€At€the€time€of€trial,€the€husbandÍhad€been€in€his€new€job€only€a€few€months.òòò ò€€óóó óThe€husband€had€received€two€commission€paymentsÏtotaling€$900.€€ò òòòId.ó óóó€at€œ*2,3.›€€The€husbandððs€unrefuted€testimony€was€that€the€commissions€wereÏnot€on€a€regular€basis€or€in€any€œdefinite›€amounts.€€ò òòòId.€€óóó óat€œ*3.›€€Despite€this,€the€trial€court€averagedÏthe€two€payments€to€arrive€at€a€figure€of€$450€and€then€ordered€the€husband€to€pay€supportÏaccording€to€the€Child€Support€Guidelines€based€on€his€fixed€salary€plus€an€additional€$450€perÏmonth.€€ò òòòId.€ó óóóat€œ*3.›€€On€appeal,€this€Court€noted€that€commissions€are€included€in€gross€incomeÏunder€the€guidelines,€but€only€those€commissions€that€are€actually€received.€€ò òòòId.€ó óóóat€œ*3.›€€œIt›€held€thatÏthe€trial€court€erred€in€assuming€that€the€husband€would€draw€$450€per€month€in€commissions.€ÏThe€judgment€was€œÇmodified›€to€exclude€commissions€œfrom›€the€amount€used€to€calculate€the€monthly€child€supportÏpayments.€€ò òòòId.€ó óóóat€œ*3,›€œ5.›€€It€was€further€modified€to€provide€for€the€payment€of€child€support€basedÏon€commissions€as€they€were€received.€€ò òòòId.ó óóó€at€œ5.›€€Ìœà à›€œHusband›€argues€that,€because€he€is€not€guaranteed€overtime,€overtime€income€is€analogousÏto€commission€income.€€Thus,€under€ò òòòIn€re€Linebaughó óóó,€he€argues€that€his€overtime€income€isÏspeculative€and€should€not€be€considered€in€determining€the€amount€of€the€alimony€and€childÏsupport€awards.€€Ìà àWife€contends€that€overtime€pay€is€properly€included€as€income€in€determining€childÏsupport€obligations,€noting€that€the€legislature€recently€amended€the€Child€Support€Guidelines€toÏspecifically€include€overtime€income€within€the€definition€of€gross€income.€€ò òòòSee€óóó óTenn.€Comp.€R.Ï&€œRegs.,›€ch.€1240„2„4„.03(3)(a)€œ(1994);›€œò òòòsee›€also€Hastings€v.€Hastingsó óóó,€No.€œ01A01„9603„CH„00128,€slip€op.€at€3›€(Tenn.€App.€Nov.€27,€œ1996).›€€€€Even€before€this€legislative€change,€sheÏmaintains€that€case€law€and€the€guidelines€in€effect€at€the€time€of€trial€support€her€argument€thatÏovertime€pay€should€be€considered€when€determining€the€amount€of€a€child€support€award.€€Ìà àIn€ò òòòHopkins€v.€Hopkinsó óóó,€No.€02A01„9202„JV„00045,€1993€WL€112523€(Tenn.€App.ÏœApr.€€13,›€1993),€the€wife€appealed€the€trial€courtððs€refusal€to€include€all€of€the€husbandððs€overtimeÏpay€in€calculating€his€income€under€the€Child€Support€Guidelines.€€ò òòòId.€ó óóóat€*2.€€In€its€Opinion,€thisÏCourt€noted€that€the€guidelines€in€effect€at€that€time€defined€gross€income€to€include€income€fromÏany€source€and€did€not€exclude€overtime€income.€€ò òòòId.€€óóó óThe€guidelines€also€provided€that€childÏsupport€payments€should€be€based€on€a€percentage€of€a€yearððs€net€income.€€ò òòòId.€€ó óóóThe€husbandÏregularly€received€overtime€income€during€the€year€in€œquestion;€consequently,›€the€trial€courtððsÏdecision€to€exclude€overtime€income€from€the€calculation€of€child€support€was€reversed.€ò òòòId.óóó ó€at€*3.Ìà àIn€this€case,€the€trial€court€determined€Husbandððs€gross€income€based€on€the€incomeÏreflected€in€his€1993€W„2€form,€which€included€overtime€income.€€Husband€admitted€that€heÏregularly€receives€a€sixth€day€of€overtime€pay€for€every€three€weeks€of€work.€€Thus,€unlike€theÏhusband€œin€ò òòòIn›€re€Linebaughó óóó,€who€received€only€two€commission€payments€during€the€first€fewÍmonths€at€his€new€job€and€did€not€receive€them€on€a€regular€basis€or€in€any€definite€amounts,€theÏovertime€income€in€this€case€is€not€merely€speculative.Ìà àUnder€the€Child€Support€Guidelines€in€effect€at€the€time€of€trial,€the€definition€of€grossÏincome€included€income€from€any€source€and€did€not€exclude€overtime€income.€€Tenn.€Comp.€R.Ï&€œRegs.,›€ch.€1240„2„4„.03(3)(a)€(1989).€€The€guidelines€provided€that€the€amount€of€the€childÏsupport€payments€should€be€based€on€a€flat€œpercentage€of€›€the€obligorððs€net€income.€€œò òòòId.ó óóó›€ch.€1240„2„4„.03(5).€€Thus,€the€fact€that€overtime€income€is€not€guaranteed€is€not€determinative.€€Rather,€theÏfocus€is€on€income€regularly€received€by€the€obligor.€€ò òòòSee€œHopkinsó óóó€at€*3.›à àÌà àApplying€the€Child€Support€Guidelines€and€the€principles€discussed€in€ò òòòHopkinsó óóó€to€theÏfacts€of€this€case,€the€trial€court€did€not€err€in€considering€œHusbandððs›€overtime€income.€€The€Ïrecord€in€this€case€includes€Husbandððs€€1993€W„2€form,€which€included€overtime€income,€as€wellÏas€Husbandððs€admission€that€he€expects€to€continue€to€receive€such€overtime€income€on€a€regularÏbasis.€€Based€on€this€record,€the€trial€court€properly€included€Husbandððs€overtime€pay€as€income€inÏdetermining€the€amount€of€the€child€support€award.€Ìà àFinally,€Husband€argues€that€his€overtime€income€should€not€be€considered€in€determiningÏan€alimony€award€and€that€the€rehabilitative€alimony€award€is€excessive.€€A€trial€court€has€broadÏdiscretion€in€awarding€alimony.€€ò òòòLoyd€v.€Loydó óóó,€860€S.W.2d€409,€412€(Tenn.€App.€1993).€ÏTennessee€statutes€specifically€provide€that€the€trial€court€should€consider€the€partiesðð€ð ðrelativeÏearning€capacityðð€including€income€from€pensions€and€ð ðall€other€sources.ðð€€Tenn.€Code€œAnn.€ð𛀜36„5„101(d)(1)(A)€(1996);€ò òòòsee›€also€Storey€v.€Storeyó óóó,€835€S.W.2d€593,€596„97€(Tenn.€App.Ï1992)€(holding€that€a€husband€with€an€income€of€œ$1,600›€per€month€at€trial,€but€whose€incomeÏranged€from€$384,065€to€$711,239€in€the€four€years€preceding€trial,€had€sufficient€earning€capacity€Ïto€make€alimony€payments€of€€œ$2,500›€per€month).Ìà àIn€this€case,€the€record€is€unclear€as€to€whether€the€trial€court€considered€the€HusbandððsÏovertime€income€in€determining€the€alimony€award.€€However,€doing€so€would€not€have€been€errorÏbecause€such€income€would€have€been€indicative€of€Husbandððs€earning€capacity.€€Ìà
