CharlesWileywasatrusteeintheannexatNortheastCorrectionalCenterinMountainCity,Tennessee.Byhisownaccount,hewalkedofffromthefacilityonNovember30,1992,butturnedhimselfinvoluntarilyfifteenhourslater.Whenhereturnedtohiscell,hefoundthatanelectricfan,atelevisionsetandotheritemsofhispersonalpropertyweremissing.  Mr.Wileyfiledagrievancewiththeinstitution.Reliefwasdenied,andthecorrectionalofficerwhodismissedthegrievancesuggestedthatifMr.Wileywantedtopursuethematterfurther,hehadtofileaclaimwiththeState.OnDecember22,1992,Mr.WileyfiledhisclaimwiththeBoardofClaims,seekingdamagesof$400.TheTennesseeClaimsCommission,whichhearsanddeterminescasesreferredtoitbytheBoardofClaims,deniedhisclaim,andonApril30,1993,Mr.WileyfiledanoticewiththeCommission,appealingthatdenial.Mr.Wileysappealwassupportedbytheaffidavitofhiscellmate,totheeffectthatprisonofficershadadmittedpackingupandremovingtheappellantspropertywhilethecellmatewasbeingquestionedelsewhereaboutMr.Wileysescape.  ApparentlynoactionwastakenonMr.Wileysappeal,andonOctober4,1995hefiledhisPetition(whichwascaptioned ComplaintforDeclaratoryJudgment)inChanceryCourt.HenamedasdefendantstheDepartmentofCorrection,WardenHowardCarlton,andtheClaimsCommissionertowhomhisappealhadbeenassigned,Mr.MichaelS.Lacy.OnNovember3,1995,theChanceryCourtdismissedthecaseforlackofjurisdiction.Thisappealfollowed.@ II.   AlthoughindividualdefendantsarenamedinMr.Wileyspetition,theyareimmunefrompersonalliabilityunderthecircumstancesofthissuit.Tenn.CodeAnn.98307(h).TheactionmustbeconstruedasonedirectedagainsttheState,fortheactsoromissionsofitsemployeesandagents.  ThecommonlawruleofsovereignimmunityprohibitedallsuitsagainsttheState.TheTennesseeConstitutionmodifiedthecommonlawrulebystatingthat [s]uitsmaybebroughtagainsttheStateinsuchmannerandinsuchcourtsastheLegislaturemaybylawdirect,ArticleI,17.Kirbyv.MaconCounty,892S.W.2d403,406(Tenn.1995).Coxv.State,399S.W.2d776(Tenn.1965).ThustheStatemaybeheldliablefordamagescausedbythetortiousactsofitsagents,butonlyunderconditionsestablishedbythelegislature.  ThepresentcaseiscontrolledbylegislativeenactmentscodifiedatTenn.CodeAnn.98301etseq.,whichestablishthejurisdictionoftheTennesseeClaimsCommission,anddictatetheproceduresitistofollow.Tenn.CodeAnn.98307readsinrelevantpart: 0    (a)(1)Thecommissionoreachcommissionersittingindividuallyhasexclusivejurisdictiontodetermineallmonetaryclaimsagainstthestatefallingwithinone(1)ormoreofthefollowingcategories: (A)... ... (F)Negligentcare,custodyorcontrolofpersonalproperty.      Tenn.CodeAnn.98403(a)requiresthecommissiontomaintaintwoseparatedocketsforclaims, [a]regulardocketsimilartothosemaintainedbycourtsofrecord,and [a]smallclaimsdocketconsistingofclaimssatisfyingthemonetarylimitapplicabletothegeneralsessionscourtofDavidsonCounty.AppealfromadecisionofthecommissionregardingaclaimontheregulardocketistotheCourtofAppeals,pursuanttotheRulesofAppellateProcedure.However,Tenn.CodeAnn.98403(a)(2)specificallystatesthat [n]oappealmaybetakenfromacommissionersdecisionregardingclaimsappearingonthesmallclaimsdocket.WeaccordinglyfindthattheChanceryCourtwascorrectinrulingthatitdidnothavejurisdictiontoconsiderMr.Wileyspetition. $     ThemonetarylimitcurrentlyapplicabletothegeneralsessionscourtofDavidsonCountyis$10,000.Tenn.CodeAnn.1615501(d)(1).Mr.Wileysclaimwasfor$400.Wedonotbelievethatthe$50,000claimfor mentalanguishthathehasincludedinhispetitionwouldhavealteredtheplacementofMr.Wileysclaimonthesmallclaimsdocket,astheCommissionisnotauthorizedtohearsuchclaims.WethereforealsoholdthatitwouldnothavebeenappropriatefortheChanceryCourttotransferthiscasetotheCourtofAppeals,forourjurisdictionoverappealsfromtheClaimsCommissiononlyextendstothoseclaimswhichcanbeheardontheregulardocket,notthoseproperlyonthesmallclaimsdocket.@ III.
