Plaintiff,anemployeeoftheTennesseeDepartmentofHumanServices,filedproceedingsagainsttheagencyassertingthatshewasentitledtobackpayforworkperformedoutsideherrequiredduties. ShethenfiledthisactionintheChanceryCourtofKnoxCountyforjudicialreviewoftheCommissionsaction.TheTrialCourtdeterminedthatthedisputeremainedbeforetheCommissionuntilitapprisedplaintiffofherrecourseforitsfindingthatthedisputewasnongrievable.  AmongthegroundssetforthinthemotiontodismisswasthatvenuewasimproperintheKnoxCountyChanceryCourt,andwhiletheTrialJudgepretermittedthisissueinhisorder,itisraisedagainonappealbydefendant.  DefendantarguesthatthecaseshouldbebeforetheChanceryCourtinDavidsonCounty.Venueisestablishedinthestatutesettingforthproceduresforjudicialreview:0 0 ProceedingsforreviewareinstitutedbyfilingapetitionforreviewinthechancerycourtofDavidsonCounty,unlessanothercourtisspecifiedbystatute...Apersonwhoisaggrievedbyafinaldecisionofthedepartmentofhumanservicesinacontestedcasemayfileapetitionforreviewinthechancerycourtlocatedeitherinthecountyoftheofficialresidenceofthecommissionerorinthecountyinwhichanyone(1)ormoreofthepetitionersreside.̜T.C.A.45322(b)(1).  ThelanguageregardingtheDepartmentofHumanServiceswasaddedtoaffordvenueforjudicialreviewoftheadministrativedecisionsmadebytheDepartment.Chapter478,PublicActs,1980(p.7879).However,thisamendmentdoesnotestablishvenueinplaintiffshomecountyinthiscase.  TheDepartmentofHumanServicesisthefinalarbiterinthegrievanceproceedingonlyfor permanent or executive employees.DepartmentofPersonnelRule112011.06. )   ;T.C.A.830328(7). +   ׀Thegrievancesof careeremployees and/or regularemployees areappealedbeyondtheagencytotheCommission.Accordingly,thelocalvenueoptionforDepartmentofHumanServicesdecisionsdoesnotapplyinallcasesduetothedistinctionsmadeintherelevantstatutesandregulations.ThiscasewasbroughtasanappealfromthedecisionbytheCommission,notfromadecisionoftheDepartmentofHumanServices.VenueisthereforeproperlyintheDavidsonCountyChanceryCourt.  WeaffirmtheTrialCourtsorderofdismissalunderthefamiliarrulethatajudgmentofaTrialCourtwhichiscorrectinresult,thoughrendereduponadifferent,incompleteorerroneousground,isaffirmed.Hopkinsv.Hopkins,572S.W.2d639(Tenn.1978).
