Ðlegal€malpractice€claim€concerning€alleged€erroneous€advice€given€in€connection€withÏthe€clientððs€profit€sharing€plan.€€The€trial€court€found€the€law€firm€liable€for€some€ofÏits€actions€in€connection€with€the€profit€sharing€plan€and€awarded€damages€therefor.€ÏHowever,€the€trial€court€held€that€the€claims€relative€to€the€rollovers€andÏcontributions€of€individual€retirement€account€funds€were€barred€by€the€one„yearÏstatute€of€limitations.€€The€Court€of€Appeals€affirmed€the€judgment€of€the€trial€court,Ïand€the€Supreme€Court€affirmed€the€two€lower€courts.Ìà ` àà8¸ ` ü!` ü!àEvidently,€Mr.€Huffstutter€had€advised€that€the€fundsÏheld€in€an€IRA€account€could€be€transferred€to€theÏpension€and€profit€sharing€account€and€the€IRS€isÏreviewing€the€transaction.€€Ð ¸ ¤¸ ¤ ÐÌò òòòKohlóóó ó,€977€S.W.2d€at€531.Ð ¼- )) ÐÌÓÓà ` àOn€May€1,€1990,€Kohl€filed€a€legal€malpractice€suit€against€Huffstutter€andÏDearborn€&€Ewing€alleging€that€they€committed€malpractice€in€connection€with€theÏprofit€sharing€plan€in€various€particulars.€€The€trial€court,€in€holding€that€the€statuteÏof€limitations€barred€the€claims€pertaining€to€the€rollover€and€contributions€to€theÏprofit€sharing€plan,€noted€that€the€October€24,€1988€letter€from€Kolarich€indicatedÏthat€both€Kohl€and€Kolarich€were€aware€of€the€problem,€and€it€was€so€severe€thatÐ ¾955 ÐKohl€was€changing€law€firms.Ô‡ X¤=XXX¤=ԀР° Ðà ` àThe€ò òòòKohlóóó ó€Court€began€by€reiterating€the€two„prong€rule€articulated€in€ò òòòCarvell,Ð ° Ðsupraó óóó.€€ò òòòId.óóó ó€at€532.€€In€discussing€the€actual€injury€prong,€the€Court€stated€that€ð ð[a]nÐ ´ Ðactual€injury€may€also€take€the€form€of€the€plaintiff€being€forced€to€take€some€actionÏor€otherwise€suffer€ððsome€actual€inconvenience,ðð€such€as€incurring€an€expense,€as€aÏresult€of€the€defendantððs€negligent€or€wrongful€act.ðð€€ò òòòId.ó óóó€€Moreover,€the€Court€stated:Ð ¸  ÐÓÓà8 ` àà8¸ ` ü!` ü!àA€plaintiff€may€not,€of€course,€delay€filing€suit€until€allÏthe€injurious€effects€or€consequences€of€the€alleged€wrongÏare€actually€known€to€the€plaintiff.€€Allowing€suit€to€beÏfiled€once€all€the€injurious€effects€and€consequences€areÏknown€would€defeat€the€rationale€for€the€existence€ofÏstatutes€of€limitations,€which€is€to€avoid€the€uncertaintiesÏand€burdens€inherent€in€pursuing€and€defending€staleÏclaims.Ð àAs€for€the€facts€before€them,€the€Court€noted€that€the€Kohls€needed€only€toÏbe€aware€of€facts€sufficient€to€put€them€on€notice€that€an€injury€had€been€sustainedÏas€a€result€of€erroneous€advice,€and€that€Kolarichððs€letter€established€that€the€KohlsÏhad€notice€of€a€problem€in€this€regard.€€The€Court€found€that€the€inquiry€by€the€IRSÏwas€sufficient€in€itself€to€satisfy€the€injury€prong€of€the€discovery€rule,€and€thatÏKolarichððs€letter€of€October€24,€1988€to€the€law€firm€satisfied€the€knowledge€prong.€ÏThe€Court€said:ÌÓÓà8 Ðpurposes€of€the€discovery€rule€when€they€began€to€incurÏexpenses,€or€at€least€had€to€take€some€action,€as€a€result€ofÏthe€defendantððs€negligent€advice.ó óóó€€This€would€have€been€onÐ Â,(( ÐOctober€19,€1988€when€their€accountant€had€to€respondÏto€the€IRSððs€request€for€information€after€it€noted€aÏconflict€between€the€amount€reported€by€the€plaintiffs€onÏtheir€tax€returns€and€the€amounts€reported€by€payers.€ÏThe€plaintiffsðð€arguments€to€the€contraryÏnotwithstanding,€the€fact€that€the€IRS€had€not€taken€anyÏformal€action€against€the€Kohls€as€of€that€date,€such€asÏfiling€suit€against€them€or€issuing€a€deficiency€notice,€isÏlargely€irrelevant€because,€as€noted€above,€it€wasÏunnecessary€for€the€plaintiffs€to€have€suffered€all€of€theÏinjurious€effects€or€consequences€of€the€defendantððsÏnegligence€in€order€for€the€statute€to€begin€running.€€Ð àMathes€asserts€that€Weber€suffered€an€injury€when€the€chancery€courtÏdismissed€his€action€on€January€18,€1994.€€We€agree.€This€appears€to€satisfy€the€firstÏprong€of€the€òòò òCarvelló óóó€test.€€Mathes€also€asserts€that€Weber€knew,€or€in€the€exerciseÐ °  Ðof€reasonable€diligence€should€have€known,€that€the€trial€courtððs€dismissal€of€hisÏaction€was€caused€by€her€negligence,€thus€satisfying€the€second€prong€of€the€òòò òCarvelló óóóÐ ´  Ðtest.׃×Ý ƒ##ÃÝòòÚ  Ú9Ú  ÚóóÝ  Ý×  ׀Р¸  Ðà ` àWhen€viewed€in€the€light€most€favorable€to€Weber,€the€non„moving€party,€theÏfacts€in€this€case€do€not€support€a€finding€that€Weber€knew€that€he€had€suffered€anÏinjury€as€a€result€of€Mathesððs€conduct€prior€to€the€Court€of€Appealsððs€affirmation€ofÏthe€trial€courtððs€dismissal.€€Weberððs€affidavit€makes€this€point€quite€clear:ÌÓÓà8
