ðHusbandðð)€on€the€grounds€of€adultery.€€Pursuant€to€aÏconsent€decree€of€divorce,€custody€of€the€partiesðð€minor€child€was€awarded€to€Wife.€ÏWife€agreed€to€obtain€medical€insurance€coverage€for€the€child€through€her€employer,Ïand€the€parties›€agreed€to€œdivide€equally›€the€medical€expenses€of€the€child€which€wereÏnot€covered€by€insurance.€€œWife›€was€awarded€an€IRA€account€valued€at€$29,000€whichÏwas€titled€in€Husbandððs€name.€€œIn›€exchange€for€Wifeððs€receipt€of€the€IRA€account,ÏHusband€was€forgiven€any€child€and€spousal€support€arrearage€existing€through€JuneÏ30,€1995,€and€Wife€relinquished€any€claim€she€might€have€against€Husband€forÏdissipation€of€the€marital€assets€on€any€person€other€than€Wife.€€Wife€was€furtherÏawarded€the€Memphis€residence€and€the€automobile€in€her€possession.€€œHusband›Ïwas€awarded€the€Murfreesboro€residence,€all€interest€in€the€Pan€American€AirlinesÏretirement€income€plan,€the€Stones€River€Country€Club€membership,€and€theÏautomobile€in€his€œpossession.€Each›€party€agreed€to€pay€their€own€attorney€fees.€€œAfter›Ïthe€parties€were€unable€to€come€to€an€agreement€as€to€alimony,€child€support,€and€theÍamount€of€life€insurance€œthat€Husband›€would€provide€for€the€benefit€of€Wife€and€child,Ïthe€trial€court€ordered€Husband€to€pay€Wife€$1,000€per€month€in€rehabilitative€alimonyÏfor€seven€years,€$1099€per€month€in€child€support,€and€$9,000€in€accrued€alimony.€ÏœHusband›€was€ordered€to€purchase€and€maintain€a€$50,000€life€insurance€policy€for€theÏbenefit€of€Wife€and€a€$100,000€life€insurance€policy€for€the€benefit€of€the€partiesðð€minorÏchild.€€œHusband›€was€further€ordered€to€supply€Wife€a€statement€of€Husbandððs€totalÏincome€at€the€end€of€each€quarter€or€three„month€period,€and€in€the€event€thatÏHusbandððs€income€increases€to€more€than€$7,500€per€month,€Wife€may€petition€theÏcourt€for€an€increased€award€of€alimony.€€œWife›€€appeals€the€judgment€of€the€trial€courtÏarguing€that€the€trial€judge€erred€in€declining€to€recuse€himself,€in€awarding€her€$1,000Ïper€month€in€rehabilitative€alimony€for€seven€years,€in€admitting€into€evidence€aÏFlorida€child€support€order,€and€in€determining€the€amount€of€life€insurance€thatÏHusband€was€to€purchase€and€maintain€in€order€to€secure€Wifeððs€award€of€alimonyÏand€child€support.€€For€the€reasons€stated€hereafter,€we€affirm€the€judgment€of€the€courtÏbelow€in€all€respects€except€as€to€Wifeððs€award€of€alimony€and€the€amount€ofÏinsurance€that€Husband€shall€purchase€and€maintain€for€the€benefit€of€Wife.ÌÌà@ àò òFACTSó óÌÌà àAfter€a€twenty„seven€and€a€half€year€marriage,€the€parties€entered€into€aÏconsent€decree€of€divorce€on€the€stipulated€grounds€of€Husbandððs€adultery.€€œAt›€theÏtime€of€trial,€Husband€was€fifty„six€years€of€age,€and€Wife€was€fifty„two.€ÌÌà àTwo€sons,€who€are€presently€beyond€the€age€of€majority,€and€one€daughter,€aÏminor€child€born€on€May€28,€1990,€were€born€of€the€partiesðð€marriage.€€œHusband›Ïfathered€one€child€outside€of€wedlock€during€the€partiesðð€marriage€for€whom€HusbandÏis€currently€paying€$500€per€month€in€child€support.€€œThe›€child,€age€eight,€is€living€inÏFlorida€with€her€mother.€€Ìà àThroughout€the€partiesðð€marriage,€Husband€worked€in€the€aviation€industry.€ÏFrom€1982€through€1989,€Husband€was€President€of€Air€Tech€œServices,€a€companyÏlocated€at€›€the€Miami€airport€which€overhauls€commercial€aircraft.€œ€While›€working€forÏAir€Tech€Services,€Husband€participated€in€marketing€and€sales€and€served€as€aÏmanager.€€€During€the€period€between€1986€and€1989,€Husband€earned€$140,000€perÏyear€in€salary€and€bonuses.€ÌÌà àIn€1990,€Husband€went€to€work€for€Greenwich€Air€Services,€a€company€involvedÏin€the€maintenance,€repair€and€overhaul€of€aircraft€engines€and€aircraft€components.€ÏHusband€was€the€vice„president€of€marketing€and€sales€for€the€company€and€earnedÏan€annual€salary€of€$80,000.€€œHusband›€left€Greenwich€Air€Services€at€the€end€of€1990.€ÌÌà àFollowing€his€departure€from€Greenwich€Air€Services,€Husband€moved€toÏSmyrna,€Tennessee€and€became€the€President€of€Cross€Continental€Aircraft€Services,Ïa€commercial€aircraft€overhaul€company.€€œResponsible›€for€marketing€and€salesÏactivities,€Husband€served€as€President€of€Cross€Continental€Aircraft€Services€from€theÏend€of€1990€through€1993.€€œHusbandððs›€annual€base€salary€in€1990€and€1991€wasÏ$100,000.€€In€1992€and€1993€Husband€earned€$80,000€as€an€annual€base€salary.ÍœAfter›€earning€œ$84,350›€in€1993,€Husband€left€Cross€Continental€Aircraft€Services.€ÌÌà àIn€1994,€Husband€began€work€for€F.F.V.€Aerotech,€a€company€in€the€NashvilleÏairport€that€repairs€and€overhauls€commuter€aircraft.€€œAs›€the€vice„president€ofÏmarketing€and€operations,€Husband€made€a€base€salary€of€$80,000€per€year.€€œOn›ÏDecember€14,€1994,€Husband€was€laid€off€from€his€job€with€F.F.V.€Aerotech.€€œHusband›Ïwas€paid€an€additional€two€months€salary€as€severance€pay.€ÌÌà àIn€1995,€Husband€started€his€own€consulting€business,€Towne€YoungÏAssociates.€€œIn›€November€1995,€Husband€entered€into€a€consulting€contract€withÏTelecel€whereby€Telecel€paid€Husband€$15,000€per€month€for€five€months.€€œAfter›Ïsubtracting€approximately€$5,000€per€month€in€job€expenses€which€Husband€wasÏobligated€to€pay,€Husband€received€a€net,€pre„tax€income€of€$10,000€€per€month€fromÏTelecel.€€œOn›€April€26,€1996,€Husband€entered€into€a€job€extension€agreement€withÏTelecel€which€extended€his€contract€through€the€end€of€July€1996.€€œUnder›€theÏextension€agreement,€Telecel€paid€Husband€a€net,€pre„tax€amount€of€$7500€perÏmonth,€and€Telecel€paid€Husbandððs€job€expenses.€€œAt›€trial€on€June€18,€1996,€HusbandÏtestified€that€his€contract€with€œTelecel€may€be›€extended€a€month€or€more€beyond€JulyÏ1996.€Ìà àÌà àAfter€his€contract€with€Telecel€ends,€Husband€planned€to€seek€furtherÏemployment€in€the€aviation€industry.€€œHe€testified€that€his€current€earning€capacity€wasÏ$60,000.€ÌÌà àIn€December€1995,€Husband€married€Judy€Hagerman.€€Hagerman€earnsÏapproximately€$12,000€per€year.€€Husband€and€Hagermanððs€1995€joint€tax€returnÏrevealed€a€joint€income€of€$61,500.€€With€Hagermanððs€income€contribution€of€$11,854,ÏHusbandððs€1995€reported€taxable€income€was€approximately€$50,000.€ÌÌà àHaving€worked€for€Pan€American€Airlines€for€seventeen€years,€Husband€beganÏreceiving€$347€per€month€in€retirement€benefits€from€Pan€American€Airlines€sometimeÏin€1996.Ìà àÌà àWife€has€worked€as€a€first„grade€teacher€for€twelve€years.€€Wife€currentlyÏteaches€first„grade€children€at€a€private€school€in€Memphis,€Tennessee,€earning€a€netÏsalary€of€approximately€$1,500€per€month.€€Wife€stated€that€she€was€not€pursuing€aÏmasterððs€degree€in€education€because€her€salary€would€not€increase€proportionatelyÏwith€the€amount€of€time€and€money€that€would€be€required€for€her€to€attain€a€masterððsÏdegree.€ÌÌà àWife€testified€that€she€lives€in€a€house€over€fifty€years€old€which€requiresÏadditional€maintenance,€that€she€does€not€have€a€clothes€dryer€in€her€house,€and€thatÏher€car€has€117,000€miles€on€it€and€is€in€need€of€$1,400€worth€of€work€on€theÏtransmission.€€Wife€testified€that€her€house€payment€is€$943€per€month€and€that€sheÏhas€a€total€of€€$4,595€in€monthly€expenses.€Ìà àÌà àSince€July€1995,€Husband€testified€that€he€has€visited€the€partiesðð€minor€childÏonce€every€six€weeks.€Since€December€1994,€Wife€stated€that€Husband€has€spentÏseventeen€days€with€the€child.€Ìà à€€€à àÌà àDuring€the€trial€of€this€matter,€the€trial€court€allowed€Husband€to€file€as€a€late„filed€exhibit,€a€certified€copy€of€the€Florida€judgment,€ordering€Husband€to€pay€$500Ïper€month€for€his€child€born€out€of€wedlock.€ÌÌà àBased€on€the€foregoing€facts,€the€trial€court€found€that›€Wifeððs€statement€ofÏincome,€needs€and€expenses€is€not€œrealistic.€The€trial€court€also€found€that€both›€partiesÏare€in€good€health€and€in€good€mental€œcondition›€and€œHusbandððs›€earning€capacity€isÏalmost€three€times€that€of€the€Wifeððs€earning€capacity.€ÌÌà àœThe€judicial€ethics€committee›€faced€an€issue€similar€to€the€issue€in€the€case€atÏbar.€€In€œJudicial›€Ethics€Opinion€No.€94„2,€œthe€Committee›€addressed€the€issue€ofÏwhether€a€judge€should€recuse€himself€from€a€particular€case€where€the€judge€hadÏbeen€represented€by€an€attorney€of€one€of€the€parties€in€an€uncontested€divorce€actionÏten€years€earlier.€€In€holding€that€the€judge€did€not€have€a€duty€to€recuse€himself,€œtheÍCommittee›€stated:ÌÓÓà8 àœà8 àCertainly›€the€passage€of€ten€years€after€an€uncontestedÏdivorce,€with€no€further€representation€during€that€time,Ïcompletely€obviates€the€need€for€recusal.Ìà8 àœà8 àA€wife€whose€marriage€has€been€shattered€by€her€husbandððs€misconductÏshould€not€be€left€in€a€financial€condition€inferior€to€her€economic€situation€prior€to€theÏpartiesðð€divorce.€€òòAaronóó,€909€S.W.2d€at€410„11;€òòGilliamóó,€776€S.W.2d€at€86;€òòShacklefordÏv.€Shacklefordóó,€611€S.W.2d€598,€601€(Tenn.€Ct.€App.€1980).€€However,€in€recognizingÏthe€premise€that€a€divorce€should€not€economically€prejudice€an€innocent€spouse,€thisÏidea€must€be€tempered€by€the€statutory€factors€set€forth€in€T.C.A.€ðð€36„5„101(d)(1).€ÏòòBrownóó,€913€S.W.2d€at€169„70.€ÌÌà àBased€upon€the€evidence€presented€at€trial,€we€conclude€that€an€award€ofÏrehabilitative€alimony€is€not€appropriate€in€this€case.€€In€consideration€of€the€disparityÏin€the€partiesðð€earning€capacities,€Wifeððs€limited€earning€capacity,€Wifeððs€limitedÏresources,€Wifeððs€age,€the€twenty„seven€and€one„half€year€duration€of€the€marriage,Ïthe€partiesðð€standard€of€living€established€during€the€marriage,€the€tangible€andÏintangible€contributions€that€Wife€made€during€the€partiesðð€marriage,€and€the€relativeÏfault€of€Husband€in€precipitating€this€action€for€divorce,€we€agree€that€this€is€anÏappropriate€case€for€an€award€of€alimony€òòin€futuroóó.€€We,€therefore,€modify€the€trialÏcourtððs€award€of€rehabilitative€alimony€of€$1,000€per€month€for€seven€years€to€provideÍthat€Wife€receive€an€award€of€permanent€alimony€in€the€amount€of€$1,000€per€month,Ïwhich€will€terminate€upon€Wifeððs€death€or€remarriage.ÌÌà àNet€income€is€calculated€by›€subtracting€from€gross€incomeÍof€the€œobligor›€FICA€(6.2%€Social€Security€plus€1.45%ÏMedicare€for€regular€wage€earners€and€12.4%€SocialÏSecurity€plus€2.9%€Medicare€for€self„employed,€as€of€1991,Ïor€any€amount€subsequently€set€by€federal€law€as€FICA€tax)Ïthe€amount€of€withholding€tax€deducted€for€a€single€wageÏearner€claiming€one€withholding€allowance€(copies€ofÏappropriate€table€will€be€provided€to€courts€with€guidelines),Ïand€ò àBecause€the€Guidelines€expressly€provide€that€the€amount€of€child€supportÏordered€pursuant€to€a€previous€order€of€œsupport›€shall€be€deducted€from€an€obligorððsÏgross€income€in€determining€the€amount€of€child€support€an€obligor€owes,€the€trialÏcourt€did€not€err€in€deducting€$500€per€month,€the€amount€of€child€support€HusbandÏcurrently€pays€for€the€support€of€another€child€born€outside€the€partiesðð€marriage,€fromÏHusbandððs€gross€income€for€purposes€of€determining€the€amount€of€child€supportÏHusband€owes€Wife.€€ÌÌà àIn€addressing€whether€the€trial€judge€erred€in€ordering€Husband€to€purchaseÏand€maintain€$50,000€worth€of€life€insurance€in€order€to€secure€Wifeððs€award€ofÏalimony€and€$100,000€worth€of€life€insurance€in€order€to€secure€Husbandððs€childÏsupport€payment,€T.C.A.€œ36„5„101(g)(1996)(emphasis€added)€provides€that:›ÌÓÓà8 àœà8 àThe›€court€ò òmayó ó€direct€either€or€both€parties€to€designate€theÏother€party€and€the€children€of€the€marriage€as€beneficiariesÏunder€any€existing€policies€insuring€the€life€of€either€partyÏand€maintenance€of€existing€policies€insuring€the€life€ofÏeither€party,€or€the€purchase€and€maintenance€of€lifeÍinsurance€and€designation€of€beneficiaries.ÌÌÓÓœBecause€the€statute€expressly€provides€that€the€trial€judge€may€direct€a€party€toÏpurchase€and€maintain€a€life€insurance€policy€for€the€benefit€of€the€other€party€andÏchildren€of€the€marriage,€the€legislature€specifically€left€the€determination€of€whether€toÏorder€a€party€to€procure€insurance€for€the€benefit€of€the€other€party€and€children€of€theÏmarriage€to€the€discretion€of€the€trial€court.€€We€will€not€interfere€with€the€trial€courtððsÏexercise€of€its€discretion€absent€a€showing€of€abuse.€€Because€the€trial€court€did€notÏabuse€its€discretion€in€directing€Husband€to€purchase€and€maintain€$100,000€worth€ofÏlife€insurance€for€the€benefit€of€the€partiesðð€minor€child,€we€affirm€this€order€of€the€trialÏcourt.€€However,€because€we€modified€the€trial€courtððs€award€of€rehabilitative€alimonyÏto›€provide€Wife€with€an€award€of€permanent€alimony€in€the€amount€of€$1,000€perÏmonth,€œwe›€œmodify›€the€trial€courtððs€order€that€Husband€shall€purchase€and€maintainÏ$50,000€worth€of€life€œinsurance›€to€provide€that€Husband€shall€purchase€and€maintainÏ$100,000€worth€of€life€insurance€in€order€to€secure€Wifeððs€award€of€alimony.ÌÌÌà àIn€determining€whether€the€trial€judge€erred€in€denying€Wifeððs€motion€to€dismissÏor€œto€stay›€Husbandððs€post„judgment€petition€to€modify€child€support€and€alimonyÏpending€this€appeal€of€the€final€judgment,€Tenn.€R.€Civ.€P.€62.03€provides:ÌÓÓà8 àœà8 àWhen›€an€appeal€is€taken€from€an€interlocutory€or€finalÏjudgment€in€actions€specified€in€Rule€62.01€or€in€actions€forÏalimony€or€child€support,€the€court€in€its€discretion€mayÏsuspend€relief€or€grant€whatever€additional€or€modifiedÏrelief€is€deemed€appropriate€during€the€pendency€of€theÏappeal€and€upon€such€terms€as€to€bond€or€otherwise€as€itÏdeems€proper€to€secure€the€other€party.ÌÌÓÓThe€express€language€of€the€rule€gives€the€trial€court€the€discretion€to€suspend€or€grantÏwhatever€relief€is€deemed€appropriate€during€the€pendency€of€an€appeal€in€an€actionÏfor€alimony€or€child€support.€€We,€therefore,€affirm€the€trial€courtððs€order€denying€WifeððsÏmotion€to€dismiss€or€œto€stay›€Husbandððs€post„judgment€petition€to€modify€child€supportÏand€alimony€pending€this€appeal€of€the€final€judgment.ÌÌà àFinally,€Wife€requests€that€this€Court€award€attorney€fees€necessitated€by€thisÏappeal.€€€We€note,€however,€that€œpursuant€to›€the€consent€decree€of€œdivorce€both›€partiesÏagreed€to€pay€their€own€attorney€œfees.›€In€addition,€where€both€parties€are€partiallyÏsuccessful€on€appeal,€this€Court€has€held€that€no€attorney€fees€should€be€awarded€inÏrespect€to€the€appeal.€€œòòStorey€v.€Storeyóó,›€835€œS.W.2d€593,›€œ598€(Tenn.€Ct.€App.€1992);›ÏòòBaggett€v.€Baggettóó,€512€S.W.2d€292,€294€(Tenn.€Ct.€App.€1973).€€Thus,€because€bothÏparties€agreed€to€pay€their€own€attorney€fees€in€the€consent€decree€of€divorce€andÏbecause€both€parties€were€partially€successful€on€appeal,€we€decline,€in€this€case,€toÏaward€Wife€attorney€fees€incurred€on€appeal.Ìà
