Someoftheseareindeed"facts"andsomeareinsteadconclusionsdrawnbythePlaintiff.#X XXX]'#X]XXX ԛ   ` Plaintiffarguesthattheresolutionofanyoralloftheseissuesoffactinhisfavor x8  wouldestablishDefendants'liabilityfortheremovalofhishousefromthecemeteryproperty.Plaintiff'sargumentfailsbecausethosefactswhichhecontendsaredisputedarenotmaterialtotheoutcomeofthiscase.ImplicitinthePlaintiff'sreasoningistheassumptionthathehadarighttobethereinthefirstplace.However,theundisputedfactisthatthepropertyhasbeenusedasafamilycemeteryforoveronehundredyears.   ` Whenlandhasbeendefinitelyappropriatedtoburialpurposes, H    ` itcannotbeconveyedordevisedasotherproperty,soastointerfere t4    ` withtheuseandpurposestowhichithasbeendevoted.Whenonce   ` dedicatedtoburialpurposes,andintermentshavetherebeenmade,   ` thethenownerholdsthetitletosomeextentintrustforthebenefit   ` ofthoseentitledtoburialinit,andtheheiratlaw,devisee,orvendee   ` takesthepropertysubjecttothistrust.Therightofburialextendsto   ` alldescendantsoftheownerwhodevotedthepropertytoburial   ` purposes,andtheymayexerciseitwhenthe#X XXX]-#X]XXX necessityarises.Hines !    ` v.State,126Tenn.1,149S.W.2d1058,1059(1911)[emphasis "    ` added]. #  М̛   ` Thereisnodisputeastothematerialanddeterminativefactsinthiscase.Theland %X" involvedhadbeenappropriatedforburialpurposesandhadbeenusedasthefamilycemeteryforoveronehundredyears.AsthePlaintiffwasincarcerated,hecouldnolongerprovideanycaretakerservices.Itisundisputedthathewasgivennoticethathishousemustberemovedfromthecemeteryproperty.AfterthePlaintiffdidnotremovethestructure,theDefendantsremovedit.Thelandhadbeenappropriatedforburialpurposes.;IitcouldnothavebeenconveyedtothePlaintiffbyhisfatherforuseasahomestead.   ` ThisCourthaspreviouslyheldthatrecoveryformistakenimprovementstolandiscontingentuponthepresenceoffourelements:(1)permanentimprovements;(2)possession;(3)goodfaith;and(4)coloroftitle.Uhlhornv.Keltner,723S.W.2d131,137(Tenn.App.1986). 06/4 МPlaintiffisnotinpossession.;moreover,Iitisundisputedthathedidnotbuildthedwellingundercoloroftitle.("AtnotimehasthisPlaintiffallegedthathehadadversepossessionorsuperiorpossessoryrights 938 overtheYoungGrahamCemeteryProperty.")Atmosthearguesthathisfathergavehimpermissiontobuildthere.Heneverclaimshewasgivenanyownershipinterest.Havingfailedtosatisfythenecessaryfourelementsforrecovery,hecannot,asamatteroflaw,prevail.   ` ThePlaintiffcontendsthattheTrialCourterredinrefusingtomaintainhiscaseonacontinuousdocketduringhisperiodofimprisonment.ThisCourthaspreviouslyaddressedthisϜissue.WhenacaseisbeforeaTrialCourtonamotionforsummaryjudgmentandthecauseisnottothepointoftrial,Plaintiff'spersonalattendanceisnotrequiredbecausehistestimonycanbepresentedtothecourtviadepositionoraffidavit,andhehassufficientmeansofconveyinghisargumentstothecourtviamemoranda.Moffittv.Smith,No.02A019705CV00095(Tenn.Ct.
