ÐHusbandððs€tax€returns€for€the€previous€years,€was€between€$225,000€and€$250,000€per€year.€Ð ûK ÐÌà  àWife€holds€an€undergraduate€degree€in€business€administration€with€a€major€in€accountingÐ Í Ðfrom€the€University€of€Tennessee€at€Martin.€€Additionally,€Wife€has€taken€some€courses€for€creditÐ ¶ Ðtowards€her€masterððs€degree.€€At€the€time€of€the€partiesðð€marriage,€Wife€was€employed€by€DyersburgÐ Ÿï ÐState€Community€College€(ð ðDSCCðð),€working€as€the€director€of€continuing€education€and€earningÐ ˆØ Ðbetween€$31,000€and€$32,000€per€year.€€Subsequently,€after€the€second€mortgage€on€the€VCÐ qÁ Ðproperty€was€paid€off,€Wife€resigned€from€her€position€at€DSCC€and€began€to€work€for€Husband€atÐ Zª ÐVC€and€VO.€€Wife€testified€that€she€worked€four€to€five€days€a€week€for€two€to€three€hours€per€dayÐ C“ Ðat€the€optometry€clinic.€€Although€the€trial€court€found€that€most€of€the€business€decisions€wereÐ ,| Ðmade€by€Dr.€Robinson€and€Husband,€it€found€that€Wife€prepared€payrolls,€conducted€interviews,€andÐ e Ðorganized€staff€meetings.€€Since€December€2000,€Wife€has€worked€for€the€University€of€TennesseeÐ Ðproperty€involves€the€marital€property€division,€we€address€that€issue€here.€€In€this€case,€the€partiesÐ ¢#ò" Ðattempted€to€present€evidence€of€the€value€of€the€partiesðð€household€goods.€€The€trial€court€refusedÐ ‹$Û# Ðto€take€evidence€on€those€items€and€stated€that€the€parties€should€either€agree€on€a€division€or€theÐ t%Ä $ Ðcourt€would€order€a€sale€of€such€items€and€divide€the€proceeds.€€The€parties€were€unable€to€reachÐ ]&­!% Ðan€agreement€for€division€of€the€household€items,€and,€subsequently,€the€court€awarded€Wife€allÐ F'–"& Ðhousehold€goods,€furniture,€and€appliances€in€her€possession€except€for€Husbandððs€items€of€separateÐ /(#' Ðproperty,€without€taking€any€evidence€of€the€values€of€such€household€items.€€As€a€result,€this€CourtÐ )h$( Ðcannot€determine€whether€such€division€of€the€household€items€was€equitable€in€accordance€withÐ *Q%) Ðthe€division€of€the€remainder€of€the€marital€estate.€€Therefore,€in€the€interest€of€judicial€economy,Ð ê*:&* Ðwe€remand€this€case€to€the€trial€court€for€a€determination€of€the€values€of€the€partiesðð€householdÐ Ó+#'+ Ðpersonal€property€alone,€consideration€of€the€factors€enumerated€in€Tenn.€Code€Ann.€ðð€36„4„121(c)Ð ° Ðfor€a€division€of€such€marital€household€items€only,€and€an€equitable€division€of€the€maritalÐ ™é Ðhousehold€items€in€accordance€with€the€division€of€the€remainder€of€the€partiesðð€marital€estate.Ð ‚Ò ÐÌÓ  Óò òImposition€of€the€Lienó óÐ T¤ ÐÌÓ  Óà  àNext,€Husband€argues€that€the€trial€court€erred€when€it€imposed€a€lien€on€the€VC€propertyÐ ' w Ðin€order€to€secure€Husbandððs€property€settlement€obligation€of€$183,692.50,€as€well€as€his€paymentsÐ  ` Ðof€child€support€and€alimony.€€In€its€final€decree€of€divorce,€the€trial€court,€when€discussing€theÐ ù I Ðproperty€settlement€payment€of€$183,692.50€from€Husband€to€Wife,€stated€that€ð ð[a]€lien€on€theÐ â 2  ÐVision€Center,€P.C.€property€is€imposed€to€secure€the€payment€of€[Wifeððs]€share€of€marital€propertyÐ Ë   Ðalong€with€the€payments€of€any€child€support€and€alimony.ðð€€We€note€that€ð ð[t]he€imposition€of€a€lienÐ ´  Ðon€property€is€an€extraordinary€and€harsh€remedy€that€must€be€exercised€with€caution€lest€injury€beÐ í  Ðdone€to€the€obligor€spouse€and€his€or€her€property,€and€should€not€be€resorted€to€where€less€onerousÐ †Ö  Ðremedies€are€available.ðð€€24A€Am.€Jur.€2d€òòDivorce€and€Separationóó€ðð€885€(1998).€€This€Court€hasÐ o¿  Ðpreviously€upheld€the€imposition€of€a€lien€on€a€partyððs€property€where€there€was€evidence€that€theÐ X¨  Ðobligor€spouse€had€committed€fraud€against€the€obligee€spouse.€€òòNorman€v.€Normanóó,€No.€03A01„Ð A‘ Ð9702„CV„00047,€1998€Tenn.€App.€LEXIS€204,€at€*6„8€(Tenn.€Ct.€App.€Mar.€25,€1998).€€However,Ð *z Ðthis€Court€has€also€upheld€a€trial€courtððs€denial€of€imposing€a€lien€on€an€obligor€spouseððs€propertyÐ c Ðwhere€such€a€lien€would€hamper€the€business€operations€of€the€obligor€spouse€and€place€theÐ üL Ðobligorððs€source€of€income€in€jeopardy.€€òòManis€v.€Manisóó,€49€S.W.3d€295,€306€(Tenn.€Ct.€App.€2001)Ð å5 Ð(upholding€the€trial€courtððs€denial€of€wifeððs€request€for€a€lien€on€dividends€distributed€fromÐ Î Ðhusbandððs€corporations€or€to€require€husband€to€obtain€court€approval€before€consenting€to€sales€ofÐ · Ðcorporate€property€until€husband€paid€wife€her€interest€in€the€marital€estate).€€Ð  ð ÐÌà  àUnder€the€circumstances€of€this€case,€we€do€not€think€the€imposition€of€a€lien€on€the€VCÐ r Ðproperty€is€appropriate€to€secure€the€property€settlement€and€support€obligations.€€In€a€temporaryÐ [« Ðorder€for€support,€Husband€was€ordered€to€pay€all€the€bills€associated€with€the€marital€home,Ð D” Ðincluding€the€payments€on€the€loan€secured€by€the€marital€home.€€Additionally,€Husband€wasÐ -} Ðordered€to€pay€$1,000€per€month€to€Wife€as€child€support.€€Finally,€Husband€was€ordered€to€payÐ f ÐWife€alimony€in€the€amount€of€$500€per€month.€€Such€order€was€filed€in€August€2000,€and€there€isÐ ÿO Ðno€evidence€that€Husband€failed€to€make€one€payment€pursuant€to€this€order.€€After€our€review€ofÐ è 8 Ðthe€record,€we€cannot€say€that€an€imposition€of€a€lien€on€the€VC€property€was€justified.€€Therefore,Ð Ñ!!  Ðwe€remand€this€case€to€the€trial€court€to€revisit€this€issue€and€to€impose€a€less€onerous€method€ofÐ º" ! Ðand€intangible;й" !` x` x Ðà0  àà0` xxà(H)€The€provisions€made€with€regard€to€the€marital€property€asÐ ¢#ò" Ðdefined€in€ðð€36„4„121;Ћ$Û#` x` x Ðà0  àà0` xxà(I)€The€standard€of€living€of€the€parties€established€during€theÐ t%Ä $ Ðmarriage;Ð]&­!%` x` x Ðà0  àà0` xxà(J)€The€extent€to€which€each€party€has€made€such€tangible€andÐ F'–"& Ðâ âintangible€contributions€to€the€marriage€as€monetary€and€homemakerÐ /(#' Ðcontributions,€and€tangible€and€intangible€contributions€by€a€party€toÐ ° Ðthe€education,€training€or€increased€earning€power€of€the€other€party;Йé` x` x Ðâ âà0  àà0` xxà(K)€The€relative€fault€of€the€parties€in€cases€where€the€court,€in€itsÐ ‚Ò Ðdiscretion,€deems€it€appropriate€to€do€so;€andÐk»` x` x Ðà0  àà0` xxà(L)€Such€other€factors,€including€the€tax€consequences€to€each€party,Ð T¤ Ðas€are€necessary€to€consider€the€equities€between€the€parties.Ð= ` x` x ÐÌÓ °LŒÓTenn.€Code€Ann.€ðð€36„5„101(d)(1)€(2001).€€The€most€important€factors€are€the€obligeeððs€need€andÐ  _ Ðthe€obligorððs€ability€to€pay.€€òòLancaster€v.€Lancasteróó,€671€S.W.2d€501,€503€(Tenn.€Ct.€App.€1984)Ð ø H Ð(citing€òòAleshire€v.€Aleshireóó,€642€S.W.2d€729,€733€(Tenn.€Ct.€App.€1981)).€€Ð á 1  ÐÌà  àHusband€relies€on€the€fact€that€the€marriage€was€very€short€in€duration,€and,€therefore,€WifeÐ ³  Ðwas€entitled€to€alimony€for€a€shorter€period,€if€any€at€all.€€Again,€Husband€ignores€the€other€factorsÐ œì  Ðwhich€favor€the€amount€and€duration€of€alimony€payments€awarded€to€Wife.€€In€this€case,€as€notedÐ …Õ  Ðabove,€Husbandððs€earning€capacity€far€exceeds€Wifeððs€earning€capacity.€€The€trial€court€found€thatÐ n¾  ÐHusband€has€the€ability€to€earn€between€$225,000€and€$250,000€per€year.€€On€the€other€hand,€theÐ W§  Ðtrial€court€found€that€Wife€has€the€ability€to€earn€between€$25,000€and€$45,000€annually.€€WhileÐ @ ÐWife€holds€an€undergraduate€degree€in€business€administration€with€a€major€in€accounting,€HusbandÐ )y Ðgraduated€from€the€Southern€College€of€Optometry€and€currently€practices€as€an€optometrist.€€Also,Ð b Ðas€noted€above,€while€Husband€has€contributed€to€the€marriage€as€the€primary€wage€earner,€WifeÐ ûK Ðhas€also€been€a€wage€earner€during€the€marriage.€€The€evidence€also€supports€the€fact€that€Wife€hasÐ ä4 Ðcontributed€as€a€homemaker€for€the€marriage.€€We€also€note€that€Wife,€though€awarded€the€maritalÐ Í Ðhome,€is€now€responsible€for€the€mortgage€payments€on€that€home€in€addition€to€her€other€monthlyÐ ¶ Ðexpenses,€increasing€her€need€for€alimony.€€Finally,€Husband€was€at€fault€for€the€divorce€becauseÐ Ÿï Ðof€his€adultery.€€Under€these€circumstances,€we€cannot€say€that€the€trial€court€erred€when€it€awardedÐ ˆØ ÐWife€alimony€of€$1,000€per€month€for€a€period€of€five€years.Ð qÁ ÐÌÓ  Óò òAttorneyððs€Feesó óÐ C“ ÐÌÓ  Óà  àFinally,€Husband€argues€that€the€trial€court€abused€its€discretion€when€it€awarded€WifeÐ f Ð$10,000€for€her€attorneyððs€fees.€€Specifically,€in€this€case,€the€trial€court€found€that,€if€Husband€paidÐ ÿO ÐWife€the€property€settlement€payment€of€$183,692.50€in€a€lump€sum,€Wife€would€have€sufficientÐ è 8 Ðfunds€to€pay€her€attorneyððs€fees.€€However,€because€the€trial€court€imposed€a€lien€on€HusbandððsÐ Ñ!!  Ðclinic€building,€Husband€argues€that€the€trial€court€precluded€Husbandððs€ability€to€pay€the€propertyÐ º" !
