àSome€settlement€negotiations€took€place€in€the€spring€of€1996.€Ð È"" ÐAlthough€I€made€an€offer€on€behalf€of€my€client,€the€parties€were€unableÏto€agree€to€resolve€the€case.Ð  Ð  Ð  ÐÌà8  àà ä à7.à  àAfter€careful€consideration,€I€made€a€tactical€decision€not€toÐ x&È!& Ðconcerning€scheduling€of€the€jury€trial.€€I€informed€the€Court€that€IÏwould€not€be€actively€participating€in€the€trial,€although€I€did€expect€toÏmonitor€portions€of€it.Ð  Ð  Ð  ÐÌà8  àà N à12.à  àWhen€I€left€the€office€on€the€afternoon€of€June€24,€1997,€itÐ Ô$  Ðwas€my€understanding€that€this€case€would€be€tried€to€a€jury€beginningÏon€June€25,€1997.€€At€that€time,€the€case€had€been€designated€as€a€juryÏcase€for€two€and€a€half€years.€€I€had€informed€all€parties€and€the€CourtÏthat€I€did€not€intend€to€participate€in€the€trial€of€the€case.€€At€no€pointÏhad€any€party€notified€me€of€any€intent€to€seek€a€nonjury€trial,€nor€hadÏany€party€or€the€Court€suggested€that€my€attendance€at€the€trial€wouldÏbe€necessary€in€order€to€ensure€that€the€case€proceeded€as€a€jury€trial.€ÏBefore€œ[June]›€25,€1997,€the€scheduled€jury€trial€date,€I€never€receivedÏany€notice€whatsoever€of€any€request€by€any€party€for€a€nonjury€trial.Ð  Ð  Ð  ÐÌà8  àà N à13.à  àI€had€not€been€notified€of€any€substantive€pretrial€matters€toÐ øH Ðbe€discussed€before€commencement€of€the€jury€trial.€€I€expected€thatÏvoir€dire€would€begin€at€9:00€a.m.€on€œ[June]›€25.€€Since€I€did€not€believeÏmy€presence€at€voir€dire€to€be€necessary€given€the€inactive€role€I€was€toÏplay€in€the€trial,€I€planned€to€go€by€the€Courthouse€in€the€late€morningÏof€œ[June]›€25€to€check€on€the€progress€of€the€trial.€Ð  Ð  Ð  ÐÌà8  àà N à14.à  àOn€the€a.m.€of€œ[June]›€25,€1997,€I€left€my€home€sometimeÐ l¼ Ðbetween€8:30€and€9:00€a.m.€€I€had€to€run€an€errand€on€the€way€to€theÏoffice€and€I€arrived€at€my€office€in€downtown€Nashville€around€9:15€orÏ9:20€a.m.€€After€I€arrived,€Thomas€H.€Peebles€III€told€me€that€heÏreceived€a€call€from€the€Court€a€few€minutes€earlier€and€had€beenÏinformed€that€the€other€parties€were€attempting€to€waive€the€jury€trial.€ÏMr.€Peebles€told€me€that€he€had€told€the€Court€that€a€nonjury€trial€wouldÏnot€be€appropriate€because€Tennessee€Farmers€had€demanded€a€jury.Ð  Ð  Ð  ÐÌà8  àà N à15.à  àI€telephoned€the€Court€and€spoke€to€one€of€the€judge's€courtÐ ¸'#& Ðofficers.€€She€told€me,€"We€tried€to€call€you.€€The€case€is€being€tried."€ÏI€asked€the€court€officer€whether€the€case€was€being€heard€by€the€CourtÏor€a€jury.€€She€indicated€that€a€bench€trial€was€in€progress.€€I€told€herÏthat€Tennessee€Farmers€objected€to€such€a€proceeding,€that€a€jury€hadÏbeen€demanded,€and€that€I€would€be€at€the€courthouse€immediately.Ð  Ð  Ð  ÐÌà8  àà N à16.à  àI€spoke€to€Thomas€H.€Peebles€III€for€a€few€minutes€and€leftÐ ,.|)- Ðmy€office€and€went€to€the€Davidson€County€Courthouse€as€quickly€asÏpossible.€€By€the€time€I€cleared€security€and€actually€arrived€in€theÏcourtroom,€it€was,€to€the€best€of€my€recollection,€approximately€10:00Ïa.m.€or€shortly€after€10:00€a.m.Ð  Ð  Ð  ÐÌà8  àà N à17.à  àWhen€I€arrived€in€the€courtroom,€plaintiff's€counsel€wasÐ ´3/3 Ðconcluding€his€examination€of€the€plaintiff.€€Neither€the€namedÏdefendants€nor€their€counsel€was€present€in€the€courtroom.€€Plaintiff'sÏcounsel€briefly€examined€another€witness.Ð  Ð  Ð  ÐÌà8  àà N à18.à  àFollowing€the€plaintiff's€proof,€I€approached€the€bench€andÐ P8 38 Ðobjected€to€the€case€being€heard€as€a€nonjury€matter.€€The€CourtÏoverruled€my€objection€and€announced€that€the€case€would€be€takenÐ (:x5: Ðunder€advisement.Ð  Ð  Ð  ÐÌÓ€ÓÔ€¼¬/¼XXF9Ôà  àœThe›€July€30,€1997€motion€for€a€new€trial€by€Tennessee€Farmers€and€JohnÐ ˆØ ÐDoe€was€overruled€by€the€trial€court€on€January€2,€1998€and€these€partiesÏappealed.ÌÌà  àOn€appeal,€Tennessee€Farmers€complains€that€having€demanded€trial€byÏa€jury€of€twelve€in€its€pleadings,€trial€by€jury€cannot€be€waived€without€its€consent.€ÏAppellant€relies€on€Tennessee€Rule€of€Civil€Procedure€38.05€providing€in€part,€"AÏdemand€for€trial€by€jury€as€herein€provided€may€not€be€withdrawn€without€theÏconsent€of€all€parties€as€to€whom€issues€have€been€œjoined."€€Tenn.€R.€Civ.€P.€38.05Ï(1997„98).›ÌÌà 9P4= Ðà  àThe€basis€of€this€decision€is€best€stated€by€counsel€for€TennesseeÏFarmers€in€his€affidavit:ÌÓ€Óñ›ñœñ›ñà8  à7.à N àAfter€careful€consideration,€I€made€a€tactical€decision€notÐ à0 Ðto€participate€actively€in€the€trial€of€the€case.€€I€knew€theÏnamed€defendants'€attorney€to€be€capable€and€was€confidentÏhe€would€keep€the€plaintiff's€damages€low€enough€to€avoidÏany€underinsured€motorist€coverage€exposure.€€BecauseÏTennessee€Farmers€had€a€subrogation€lien€for€medicalÏpayments,€any€underinsured€exposure€would€require€a€verdictÏof€at€least€$35,000.€€I€believed€a€jury€would€be€unlikely€toÏaward€more€than€that€amount.€€I€also€believed€that€the€juryÏwould€be€unlikely€to€assess€any€substantial€percentage€of€faultÏto€"John€Doe"€if€"John€Doe"€was€not€represented€at€trial.€€ForÏthese€and€other€tactical€reasons,€I€determined€not€to€participateÏactively€in€the€jury€trial.€€In€underinsured€motorist€cases,€it€isÏrelatively€common€for€counsel€to€decide€not€to€participateÏactively€in€trials.Ð  Ð  Ð  ÐÌÓ€ÓÌà  àThe€dilemma€confronting€counsel€for€Tennessee€Farmers€in€this€case€isÏobvious.€€Prior€to€œChapter›€313€of€the€Public€Acts€of€1989,€now€codified€asÏTennessee€Code€Annotated€section€56„7„1201(e),€there€was€no€uninsured€motoristÏcoverage€in€the€absence€of€physical€vehicle€contact.€€The€effect€of€the€1989€act€isÏstated€by€the€Supreme€Court:ÌÓ€Óà8  à.€.€.€Prior€to€the€1989€amendment€to€Tenn.Code€Ann.€ðð€56„7„¼1201,€there€could€be€no€recovery€unless€there€was€actualÏphysical€contact€between€the€uninsured€motorist's€vehicle€andÏthe€insured's€vehicle.€€òòSee€e.g.,€Hoyle€v.€Carrollóó,€646€œS.W.2ñ›ñ›ñ›ñd›Ð  %ð # Ð161€(Tenn.1983).€€The€requirement€of€physical€contact€withÏthe€vehicle€operated€by€the€unknown€motorist€prohibitedÏrecovery€in€cases€where€the€unknown€motorist€caused€theÏaccident€but€there€was€no€physical€contact€between€theÏvehicles.€€Subsection€(e)(1)(B),€enacted€in€1989,€allowsÏrecovery€in€cases€where,€for€example,€the€insured€is€forced€offÏthe€road€by€an€unknown€motorist€without€physically€strikingÏthe€insured's€vehicle.€€The€high€standard€of€proof€required€byÏthe€amendment,€clear€and€convincing€evidence€produced€byÏwitnesses€other€than€the€occupants,€obviously€was€intended€byÏthe€legislature€as€a€safeguard€against€bogus€claims€arisingÏfrom€one„vehicle€accidents.€€òòCf.€id.€óóat€162.Ð`2°-/ Ð  Ð  ÐÌò òòòFruge€v.€Doeó óóó,€952€œS.W.2ñ›ñ›ñ›ññ’ñdñ’ñ›€408,€411€(Tenn.€1997).Ð €4Ð/1 ÐÌÓ€ÓÌà  àòòò ò€óóó óCounsel€for€Tennessee€Farmers€would€be€representing€an€"empty€chair"Ð :8Š35 Ðin€front€of€they€jury.€€The€fear,€real€or€imagined,€is€that€the€presence€of€counselÐ Õ9%57 Ðdefending€the€empty€chair€will€suggest€to€the€jury€the€existence€of€liabilityÏinsurance.€€It€is€also€correct€to€say€that€counsel€representing€Sloan€would€attemptÏto€keep€the€damages€of€the€plaintiff€as€low€as€possible.ÌÌà  àThe€other€horn€of€Tennessee€Farmers'€dilemma€under€this€post€1989Ï"John€Doe"€case€is€that€the€interest€of€counsel€for€Sloan€and€Tennessee€FarmersÏis€far€from€identical.€€It€is€Sloan€who€first€asserted€the€existence€of€John€Doe€andÏunder€comparative€fault€principles€sought€a€companion€to€share€the€misery.€ÏPlaintiff€then€amended€his€complaint€to€join€"John€Doe"€with€all€parties€fullyÏaware€that€in€order€to€prevail€against€John€Doe,€Tennessee€Code€AnnotatedÏsection€56„7„1201,€subsequent€to€1989,€required:€€"(B)€€The€existence€of€suchÏunknown€motorist€is€established€by€clear€and€convincing€evidence,€other€than€anyÏevidence€provided€by€occupants€in€the€insured€vehicle."ÌÌà  àFaced€with€these€circumstances,€counsel€for€Tennessee€Farmers€madeÏhis€tactical€decision€not€only€to€not€participate€in€the€trial€of€the€case€but€also€notÏto€appear€even€as€an€observer.€€Thus,€Tennessee€Farmers€deferred€all€trialÏdecisions€to€counsel€representing€the€defendants€Sloan.ÌÌà Ðfederal€counterparts.€€Generally,€if€a€defendant€in€federal€court€defaultsÏafter€having€properly€demanded€a€jury€trial,€he€may€insist€on€a€jury€trialÏas€to€damage€issues.€€Federal€cases€split€on€whether€a€party'sÏnonappearance€is€tantamount€to€a€waiver€of€jury€trial€on€liability.€ÏProfessors€Wright€and€Miller€take€the€position€that€"[f]ailure€to€appear,Ïin€person€or€by€counsel,€at€the€trial€should€be€considered€a€waiver€ofÏjury€trial".€€State€case€law€demonstrates€that€the€provisions€of€applicableÏstatutes€or€rules€control€resolution€of€the€jury€trial€waiver€issue.€€StateÏcourts€which€have€had€occasion€to€apply€statutes€or€rules€similar€toÏAlaska€Civil€Rules€38(d)€and€39(a)€(i.e.:€where€express€consent€isÏrequired€for€a€waiver€of€a€previously€demanded€jury€trial)€generallyÏrefuse€to€treat€non„appearance€as€a€waiver.€€Typical€of€such€decisionsÏis€Loiselle€v.€Gladfelter,€160€So.2d€740€(Fla.App.),€aff'd,€165€So.2d€767Ï(Fla.1964).€€In€that€case,€the€Florida€Court€of€Appeals€recognized€theÏ"divergent€views€of€our€sister€states€based€upon€their€particular€statutesÏor€rules€of€procedure,"€and€also€acknowledged€the€split€in€federalÏauthority.€€160€So.2d€at€742.€€Interpreting€a€rule€of€civil€procedure€thatÏrequired€"the€consent€of€the€parties"€before€a€demand€for€jury€trial€couldÏbe€withdrawn,€the€court€concluded€that€"waiver€by€implication€in€theseÏcircumstances€must€be€more€than€a€mere€failure€to€appear€and€contestÏthe€issues€of€the€case."€€Id.€Ð Ðdefendant)€having€been€properly€brought€before€the€trial€court€byÏservice€of€process,€did€not€appear€and€defend€the€suit.€€Therefore,€hisÏconsent€to€the€waiving€of€the€jury€was€implied."€€òòId.óó€€In€that€case,€theÐ L œ Ðplaintiff€originally€demanded€a€jury€but€waived€that€demand€after€theÏco„defendant€failed€to€appear.€€The€trial€was€conducted€in€his€absence,Ïand€the€judgment€for€unliquidated€damages€awarded€by€the€trial€courtÏsitting€without€a€jury€was€upheld.€€òòId.óóÐü L  Ð  Ð  ÐÌà8  àà N à[2]à  àThe€law€in€1950€required€that€both€parties€consent€beforeÐ Ô$  Ðdemand€for€jury€could€be€waived.€€The€Supreme€Court€held€that€theÏfailure€to€appear€is€an€implied€consent€to€the€waiver€of€jury€trial.€€òòId.óó€Ð ¬ü  ÐOur€present€law€requiring€all€parties€to€consent€to€waiver€of€a€previousÏjury€demand,€Tenn.R.Civ.P.€38.05,€is€the€same€that€existed€when€theÏSupreme€Court€decided€òòRussellóó.€€Therefore,€we€must€follow€theÐ pÀ ÐSupreme€Court's€ruling€in€òòRussellóó.€€In€the€instant€case,€Ballard€did€notÐ \¬ Ðappear€at€trial,€"[t]herefore,€his€consent€to€the€waiving€of€the€jury€wasÏimplied."€€òòId.óóÐ4„ Ð  Ð  ÐÌà8  àà N à[3]à  àBallard€also€argues€that€there€can€be€no€implied€waiverÐ  \ Ðbecause€of€the€circumstances€of€this€case.€€Ballard's€counsel€claims€thatÏhe€extended€Davis's€counsel€common€courtesy€by€allowing€him€toÏcontinue€the€trial€when€it€was€first€scheduled.€€When€the€case€was€calledÏthe€second€time,€Davis€proceeded€without€Ballard.€€Ballard€asserts€thatÏDavis's€counsel€should€have€returned€the€favor.€€Davis's€attorney€arguedÏthat€Ballard€had€procrastinated€and€delayed€the€trial,€and€that€he€felt€itÏwas€time€to€zealously€represent€his€client.€€While€we€believe€thatÏprofessional€courtesy€should€be€the€norm€of€our€profession,€there€isÏnothing€legally€wrong€with€the€actions€of€Davis's€counsel.Ð  Ð  Ð  ÐÌà8  àà N àAccordingly,€the€judgment€of€the€trial€court€is€affirmed,€and€theÏcase€is€remanded€for€such€further€proceedings€as€are€necessary.€€CostsÏof€the€appeal€are€assessed€against€the€appellant.Ð  Ð  Ð  ÐÌò  à.€.€.€For€economic€and€strategic€reasons,€uninsured€motoristÏcarriers€often€elect€not€to€participate€directly€in€trials.€€ForÏexample,€consider€the€following€hypothetical€situation:€€aÏplaintiff€in€an€automobile€accident€case€alleges€$3,000€inÏmedical€expenses€and€prays€for€$100,000€in€damages.€€SheÏcarries€$100,000€in€uninsured/underinsured€motoristÏinsurance.€€She€sues€the€driver€of€the€other€vehicle€involvedÏin€the€accident€and€serves€her€own€uninsured€motorist€carrierÏwith€the€complaint.€€The€named€defendant€driver€has€minimalÏ$25,000€limits€and€is€defended€by€able€counsel.€€Under€thisÐ Š9Ú49
