Ðalimony€òòÔ#†/¼Gå»X/Xya#ÔÔ‡/XyX»/¼GåÔin€solidoóóÔ#†/¼Gå»X/Xyq #ÔÔ‡/XyX»/¼GåÔÔ#†XyXX/Xy'#ÔÔ‡/XyXXXyÔÐ $X" ÐÑ  ÑÌà  àAs€addÔ#†/¼Gå»X/Xy¿ #ÔÔ‡/XyX»/¼GåÔitional€spousal€support€òòÔ#†/¼Gå»X/Xyw!#ÔÔ‡/XyX»/¼GåÔin€futuroóóÔ#†/¼Gå»X/XyÔ!#ÔÔ‡/XyX»/¼GåÔ,€Husband€would€be€responsible€for€WifeÔ#†/¼Gå»X/Xy""#ÔÔ‡/XyX»/¼GåÔððs€healthÐ à%0!$ Ðinsurance€for€the€remainder€of€herÔ#†/¼Gå»X/Xy‹"#ÔÔ‡/XyX»/¼GåÔ€life.€€The€divorce€judgment€provides€thatÐ Ì&"% ÐÌà  àà8 ` à[Husband]€shall€initiate€and€pay€the€cost€of€[Wife]Ô#†/¼Gå»X/Xy##ÔÔ‡/XyX»/¼GåÔððs€health€insurance,Ð ¤(ô#' Ðincluding€COBRA€benefits€for€so€long€as€they€are€available,€for€theÐ )à$( Ðremainder€of€[Wife]Ô#†/¼Gå»X/XyÝ##ÔÔ‡/XyX»/¼GåÔððs€life.€€[Husband]€shall€pay,€indemnify,€and€holdÐ |*Ì%) Ðharmless€[Wife]€for€payment€of€all€medical,€dental,€hospital,Ð h+¸&* Ðpsychological,€and€pharmaceutical€expenses€incurred€by€[Wife]Ð ° Ðwhich€are€not€paid€by€any€third€party€or€carrier,€excepting€that€ifÐ œì Ð[Wife]€uses€any€health€care€provider€not€included€in€his€privateÐ ˆØ Ðinsurance€plan,€[Husband]€shall€not€be€responsible€for€any€charges€forÐ tÄ Ðsaid€provider.Ð`°` x` x ÐÔ#†/¼Gå»X/Xy¶$#ÔÔ#†¼Gå»»/¼Gå!#ÔÔ‡XyX»¼GåÔÔ‡/XyXXXyÔÌà  àFollowing€the€divorce,€Ô#†/¼Gå»X/Xy>'#ÔÔ#†¼Gå»»/¼Gå]'#ÔÔ‡/¼Gå»»¼GåÔÔ‡/XyX»/¼GåÔthe€record€demonstrates€that€issues€arose€between€the€partiesÐ 8 ˆ Ðconcerning€Husbandððs€obligation€to€furnish€health€insurance€and€to€cover€various€medical€expenses.€Ð $ t ÐIn€December,€2002,€Wifeððs€COBRA€benefits,€which€she€received€through€Husbandððs€healthÐ  ` Ðinsurance,€expired.€€Consequently,€she€was€forced€to€obtain€new€insurance.€€Husband€obtained€theÐ ü L  Ðpaperwork€for€her€to€apply€for€TennCare€coverage.€€Wife€contended,€however,€that€she€was€informedÐ è 8  ÐTennCare€was€no€longer€accepting€applications.€€Wifeððs€attorney€subsequently€assisted€her€inÐ Ô$  Ðobtaining€HIPAA€coverage€through€Blue€Cross/Blue€Shield,€at€a€premium€of€$545.46€per€month.€Ð À  ÐAt€the€time€of€the€most€recent€hearing€below,€Husband€was€covering€these€monthly€payments.€€AnÐ ¬ü  Ðissue€also€arose€during€this€period€of€time€as€to€Wifeððs€visits€to€her€psychiatrist,€Dr.€McDougal.€€HerÐ ˜è  Ðhealth€insurance€provided€coverage€for€a€certain€number€of€such€visits;€Wife,€however,€exceeded€theÐ „Ô  Ðnumber€of€permitted€visits.€€Husband€remitted€approximately€$900€to€cover€the€additional€cost.€€€€Ð pÀ ЀÌà  àIn€February,€2001,€Husband€retired€from€Erlanger€Medical€Center.€€Subsequently,€onÐ H˜ ÐNovember€1,€2001,€Wife€sought€an€injunction€from€the€trial€court€to€direct€Husband€to€sign€aÐ 4„ ÐQualified€Domestic€Relations€Order€that€would€entitle€Wife€to€one„half€of€the€Erlanger€MedicalÐ  p ÐCenter€retirement€fund€per€the€divorce€judgment.€€The€trial€court€entered€an€appropriate€order€andÐ  \ ÐWife€subsequently€received€approximately€$140,000,€or€one„half€of€the€retirement€fund,€in€June,Ð øH Ð2002.Ô#†XyXX/Xyæ'#ÔÔ‡/XyXXXyÔ€€€After€his€retirement,€Husband€went€to€work€for€Walgreens€Pharmacy€on€a€full„time€basis.€Ð ä4 ÐIn€April€or€May,€2003,€he€reduced€Ô#†/¼Gå»X/Xy(#ÔÔ‡/XyX»/¼GåÔhis€hours€to€32€hours€per€week.€€On€June€1,€2003,€HusbandÐ Ð  Ðunilaterally€lowered€his€monthly€spousal€support€payment€to€$1,300Ô#†/¼Gå»X/XyR0#ÔÔ‡/XyX»/¼GåÔ.Ô#†/¼Gå»X/Xy$1#ÔÔ‡/XyX»/¼GåÔÔ#†XyXX/Xy~/#ÔÔ‡/XyXXXyÔ€€In€July,€2003,€HusbandÐ ¼  Ðcommenced€working€at€Bi„Lo€Pharmacy.€€Although€he€was€subsequently€offered€a€full„time€position,Ð ¨ø ÐHusband€chose€to€work€fewer€hours.€€Since€August€1,€2003,€Husband€has€worked€30€hours€per€weekÐ ”ä Ðat€$41.83€per€hour.Ô#†/¼Gå»X/Xyg1#ÔÔ‡/XyX»/¼GåÔ€Ô#†/¼Gå»X/Xy3#ÔÔ‡/XyX»/¼GåÔÔ#†XyXX/Xy©1#ÔÔ‡/XyXXXyÔÐ €Ð ÐÌÑ  ÑÔ#†/¼Gå»X/XyV3#ÔÔ‡/XyX»/¼GåÔà  àOn€August€11,€2003,€in€response€to€Husbandððs€decision€to€reduce€his€monthly€alimonyÐ X ¨ Ðpayments,€Wife€filed€a€Ô#†/¼Gå»X/Xyü3#ÔÔ‡/XyX»/¼GåÔð ðPetition€for€Show€Cause€and€to€Interpret€and/or€Modify€Decree,Ô#†/¼Gå»X/XyÌ4#ÔÔ‡/XyX»/¼GåÔðð€allegingÐ D!” Ðthat€a€substantial€and€material€change€in€circumstances€had€occurred€since€the€entry€of€the€divorceÐ 0"€  Ðjudgment.€€Wife€contended€that€HusbandÔ#†/¼Gå»X/XyP5#ÔÔ‡/XyX»/¼GåÔððs€earnings€increased€after€his€retirement,€that€her€needs€hadÐ #l! Ðalso€increased,€and€that€Husbandððs€reduction€of€hisÔ#†/¼Gå»X/XyR6#ÔÔ‡/XyX»/¼GåÔ€support€payment€to€$1,300€per€month€caused€herÐ $X" Ðfinancial€hardship.€€She€further€alleged€that€Husband€had€failed€and€refused€to€comply€with€theÐ ô$D # Ðdivorce€judgment€and,€consequently,€she€was€entitled€to€attorneyððs€fees.Ô#†/¼Gå»X/Xy 7#ÔÔ‡/XyX»/¼GåÔ€€In€response,€HusbandÐ à%0!$ ÐaverredÔ#†/¼Gå»X/Xye8#ÔÔ‡/XyX»/¼GåÔ€that€he€was€entitled€to€reduce€the€amount€of€spousal€support€per€the€divorce€judgment€andÐ Ì&"% Ðthat€Ô#†/¼Gå»X/XyÙ8#ÔÔ‡/XyX»/¼GåÔð ðthis€reduction€constitutes€any€unanticipated€change€of€circumstances€which€would€entitleÐ ¸'#& Ð[Wife]€to€any€relief.Ô#†/¼Gå»X/Xy9#ÔÔ‡/XyX»/¼GåÔðð€€Husband€also€filed€a€counter„Ô#†/¼Gå»X/XyW:#ÔÔ‡/XyX»/¼GåÔpetition€in€which€he€alleged€that€Wife€was€inÐ ¤(ô#' Ðviolation€of€the€divorce€judgment€(1)€due€to€her€failure€to€pay€medical€bills€incurred€by€seeing€Dr.Ð )à$( ÐMcDougal€more€often€than€provided€by€her€health€insurance,€and€(2)€for€failing€to€apply€forÐ |*Ì%) ÐÔ#†/¼Gå»X/Xy¼:#ÔÔ‡/XyX»/¼GåÔð ðreasonably„Ô#†/¼Gå»X/Xy)<#ÔÔ‡/XyX»/¼GåÔpriced€health€care€insurance,Ô#†/¼Gå»X/Xyz<#ÔÔ‡/XyX»/¼GåÔðð€òòi.e.óó,€TennCare,€€and€choosing€her€own€insurance€plan,€theÐ h+¸&* Ðcost€of€which€Husband€was€required€to€pay.€€Husband€alleged€that€these€actions€constituted€willfulÐ ° Ðcontempt€of€the€divorce€judgmentÔ#†/¼Gå»X/XyÙ<#ÔÔ‡/XyX»/¼GåÔ.Ð œì ÐÑ  ÑÌÔ#†/¼Gå»X/Xy >#ÔÔ‡/XyX»/¼GåÔà  àAt€the€hearing€on€Wifeððs€petition€and€Husbandððs€counter„Ô#†/¼Gå»X/Xyp>#ÔÔ‡/XyX»/¼GåÔpetition,€the€trial€court€receivedÐ tÄ Ðtestimony€from€both€parties.€€The€court€also€heard€from€an€employee€of€Creekside,€the€independentÐ `° Ðliving€center€at€which€Wife€resided,€who€testified€as€to€Wifeððs€living€expenses,€the€size€of€herÐ L œ Ðapartment,€and€the€scope€of€services€that€were€available€to€her€at€Creekside.€€The€trial€court€enteredÐ 8 ˆ Ðan€order€on€December€9,€2003,€in€which€it€found€the€following:€(1)€that€the€provisions€of€the€divorceÐ $ t Ðjudgment€that€pertained€to€Husbandððs€post„retirement€employment€permitted€the€court€to€addressÐ  ` Ðwhether€a€modification€of€alimony€was€appropriate;€(2)€that€Wife€was€entitled€to€increased€alimonyÐ ü L  Ðin€the€amount€of€$1,900€per€month;€(3)€that€with€respect€to€WifeÔ#†/¼Gå»X/Xyü>#ÔÔ‡/XyX»/¼GåÔððs€visits€to€her€psychiatrist,€Dr.Ð è 8  ÐMcDougal,€Husband€was€required€to€cover€the€cost€of€those€visits,€even€if€they€exceeded€the€numberÐ Ô$  Ðof€visits€permitted€under€her€insurance;€and€(4)€that€Wife€was€entitled€to€$4,000€in€attorneyÔ#†/¼Gå»X/Xy…B#ÔÔ‡/XyX»/¼GåÔððs€fees.€Ð À  ÐThe€trial€court€further€found€that€neither€Wife€nor€Husband€was€in€contempt,€but€that€HusbandÐ ¬ü  Ðmisinterpreted€the€divorce€judgment.€€It€is€from€this€order€that€Husband€appeals.Ð ˜è  ÐÌÑ  ÑÔ#†/¼Gå»X/XyÕC#ÔÔ‡/XyX»/¼GåÔÓ  ÓII.Ð pÀ ÐÓL#ÔÔ‡/XyX»/¼GåÔððs€efforts€to€obtain€lower„cost€health€insurance;Ð ”ä Ðand€(4)€reversing€the€award€of€attorneyÔ#†/¼Gå»X/XyÕL#ÔÔ‡/XyX»/¼GåÔððs€fees.€€Wife€contends€that€the€trial€court€did€not€err€in€itsÐ €Ð Ðdecision,€and€further€seeks€attorneyÔ#†/¼Gå»X/Xy‡M#ÔÔ‡/XyX»/¼GåÔððs€fees€for€the€appeal.€€Ð l¼ ÐÌÔ#†/¼Gå»X/XyDN#ÔÔ‡/XyX»/¼GåÔÓ  ÓIII.Ð D!” ÐÓ×NÓÔ#†/¼Gå»X/Xy¸N#ÔÔ‡/XyX»/¼GåÔà  àÔ#†/¼Gå»X/Xy/O#ÔÔ#†¼Gå»»/¼Gå˜3#ÔÔ‡XyX»¼GåÔÔ‡/XyXXXyÔÌÔ#†/¼Gå»X/Xy O#ÔÔ‡/XyX»/¼GåÔà  àWe€must€first€address€whether€it€was€appropriate€for€the€trial€court€to€consider€whether€aÐ #l! Ðmodification€of€spousal€support€was€proper.€€The€trial€court€held€that€the€issue€was€properly€beforeÐ $X" Ðit€based€on€that€provision€of€the€divorce€judgment€which€provides€thatÐ ô$D # ÐÔ#†/¼Gå»X/XyP#ÔÔ‡/XyX»/¼GåÔà  àà8 ` àÐ ` x` x Ðà  àà8 ` à[i]n€the€event€that€[Husband]€continues€to€have€earnings€after€hisÐ Ì&"% Ðretirement€from€Erlanger,€he€agrees€to€notify€[Wife]€upon€receipt€ofÐ ¸'#& Ðhis€earnings€and€to€furnish€promptly€to€her€information€as€to€hisÐ ¤(ô#' Ðearnings.€€If€the€parties€are€unable€to€agree€as€to€what€effect,€if€any,Ð )à$( Ðsuch€earnings€would€have€on€increasing€her€alimony,€then€[Husband]Ð |*Ì%) Ðagrees€to€pay€for€mediation€prior€to€litigation;Ðh+¸&*` x` x Ї(NumberinÔ#†/¼Gå»X/Xy“Q#ÔÔ‡/XyX»/¼GåÔg€in€original€omitted).€€Ô#†XyXX/Xy¿O#ÔÔ‡/XyXXXyÔThe€court€interpreted€this€provision€to€mean€that€Husband€shouldÐ ° Ðð ðsupply€[Wife]€with€information€concerning€his€earnings€and€the€right€to€litigation€after€mediationÐ œì Ðis€reserved€on€this€issue.ðð€€Consequently,€the€trial€court€held€that€ð ð[Husband]€has€voluntarily€stayedÐ ˆØ Ðin€the€workÔ#†/¼Gå»X/Xy/T#ÔÔ‡/XyX»/¼GåÔ€force€and€[the€court€finds]€the€[c]ourt€has€the€right€and€obligation€under€the€finalÐ tÄ Ð[judgment]€of€divorce€to€address€whether€or€not€there€should€be€an€alimony€modification€and,€if€so,Ð `° Ðin€what€amount.ðð€€We€agree€with€the€trial€courtððs€interpretation€of€this€provision€of€the€divorceÐ L œ Ðjudgment.€€Ð 8 ˆ ÐÌà  àHusband€relies€primarily€on€the€Supreme€CourtÔ#†/¼Gå»X/Xy(V#ÔÔ‡/XyX»/¼GåÔððs€decision€in€ò òòòÔ#†/¼Gå»X/Xy"X#ÔÔ‡/XyX»/¼GåÔBogan€v.€Boganó óóóÔ#†/¼Gå»X/Xy|X#ÔÔ‡/XyX»/¼GåÔ,€60€S.W.3dÐ  ` Ð721€(Tenn.€2001),€in€support€of€his€argument€that€his€retirement€should€have€prompted€the€trial€courtÐ ü L  Ðto€reduce€his€spousal€support€obligation.€€In€particular,€Husband€cites€language€from€ò òòòÔ#†/¼Gå»X/XyÒX#ÔÔ‡/XyX»/¼GåÔBoganó óóóÔ#†/¼Gå»X/Xy Z#ÔÔ‡/XyX»/¼GåÔ€whichÐ è 8  Ðprovides€that€where€an€obligor€spouse€elects€an€Ô#†/¼Gå»X/XyWZ#ÔÔ‡/XyX»/¼GåÔð ðobjectively€reasonable€retirement,€taken€in€goodÐ Ô$  Ðfaith€and€without€intent€to€defeat€the€support€obligation,€[the€retirement]€constitute[s]€a€substantialÐ À  Ðand€material€change€in€circumstance€so€that€a€modification€of€support€obligations€may€beÐ ¬ü  Ðconsidered.Ô#†/¼Gå»X/XyäZ#ÔÔ‡/XyX»/¼GåÔðð€€ò òòòÔ#†/¼Gå»X/Xyc\#ÔÔ‡/XyX»/¼GåÔId.ó óóóÔ#†/¼Gå»X/Xy±\#ÔÔ‡/XyX»/¼GåÔ€at€727.€€Ô#†/¼Gå»X/Xyü\#ÔÔ‡/XyX»/¼GåÔThe€trial€court€acknowledged€the€ò òòòBoganó óóó€decision€as€ð ðaddress[ing]€theÐ ˜è  Ðinterrelationship€between€alimony€and€€retirement.ðð€€However,€it€deemed€ò òòòBoganó óóó€to€be€immaterialÐ „Ô  Ðin€light€of€the€language€contained€in€the€divorce€judgment€permitting€the€court€to€modify€theÐ pÀ Ðalimony.€€We€agree€that€the€analysis€in€ò òòòBoganó óóó€has€little€bearing€on€the€instant€case.€€Ô#†XyXX/XyŠT#ÔÔ#†¼Gå»XXyH]#ÔÔ‡XyX»¼GåÔÔ‡/XyXXXyÔIn€ò òòòBoganó óóó,€theÐ \¬ Ðcourt€addressed€whether€the€husbandððs€retirement€ð!ð€which€had€òònotóó€been€contemplated€by€the€expressÐ H˜ Ðlanguage€in€the€judgment€of€divorce€ð!ð€constituted€a€substantial€and€material€change€in€circumstanceÐ 4„ Ðthat€would€enable€a€trial€court€to€even€consider€modifying€alimony€pursuant€to€the€factors€set€forthÐ  p Ðin€Tenn.€Code€Ann.€ðð€36„5„101(d)€(Supp.€2004).€€In€the€instant€case,€the€divorce€judgment€expresslyÐ  \ Ðprovided€that€should€Husband€continue€to€work€following€his€retirement,€he€would€be€required€toÐ øH Ðnotify€Wife€of€his€continued€employment€and,€should€the€parties€be€unable€to€arrive€at€an€agreementÐ ä4 Ðas€to€the€amount€of€spousal€support,€they€would€go€to€mediation.€€In€addition,€ò òòòBoganó óóó€did€not€addressÐ Ð  Ðthe€issue€before€us,€òòi.e.óó,€the€impact€of€post„retirement€earnings€on€a€modification€of€alimony,€and€thisÐ ¼  Ðis€a€distinction€conceded€by€Husband€in€his€brief.€€We€agree€with€the€trial€court€that€the€court€hadÐ ¨ø Ðthe€ð ðright€and€obligation€under€the€[divorce€judgment]€to€address€whether€or€not€there€should€be€anÐ ”ä Ðalimony€modification€and,€if€so,€in€what€amount.ðð€€Therefore,€based€upon€our€finding€that€the€issueÐ €Ð Ðof€modification€was€properly€before€the€trial€court,€we€now€turn€to€Husbandððs€allegation€that€theÐ l¼ ÐÔ#†/¼Gå»X/Xyl_#ÔÔ‡/XyX»/¼GåÔmodification€ordered€is€not€supported€by€the€evidence.Ð X ¨ ÐÌà  àWe€first€address,€however,€another€contention€made€by€Husband.€€Ô#†XyXX/Xy‹_#ÔIn€his€brief,€he€argues€thatÐ 0"€  Ðeven€if€some€level€of€support€exceeding€$1,300€was€justified,€it€was€not€appropriate€for€the€trial€courtÐ #l! Ðotherwise,€that€Wife€continued€to€demonstrate€need€for€the€support€award.€€The€court€found€that€sheÐ $X" Ðstill€was€unable€to€work,€and€consequently€was€unable€to€unilaterally€improve€her€financial€position.€Ð ô$D # ÐWife€testified€that€her€expenses€had€increased€due€to€a€rent€increase€from€$1,060€at€the€time€of€theÐ à%0!$ Ðdivorce€to€$1,260€at€the€time€of€the€hearing.€€She€further€stated€that€due€to€the€increase,€she€had€beenÐ Ì&"% Ðforced€to€relinquish€the€carport€that€she€rented.€€Although€Wifeððs€expenses€may€not€have€increasedÐ ¸'#& Ðgreatly€since€the€initial€award€in€1999,€the€evidence€does€not€preponderate€against€the€trial€courtððsÐ ¤(ô#' Ðfinding€that€she€still€demonstrated€financial€need.€€Husband€attempts€to€counter€any€claim€that€herÐ )à$( Ðâ âexpenses€have€increased€by€citing€numerous€purchases€made€by€Wife€which,€by€her€testimony,€wereÐ |*Ì%) Ðgifts€for€her€children€and€grandchildren.€€Yet,€we€do€not€find€that€this€evidence€preponderates€againstÐ ° Ðthe€trial€courtððs€apparent€concern€that€Wife€is€unable€to€unilaterally€alter€her€financial€situation.€€Ð œì Ðâ âÌà  àHusband€also€faults€the€trial€court€for€failing€to€consider€that€Wife€received€a€substantial€sumÐ tÄ Ðfrom€Husbandððs€retirement€plan.€€Therefore,€so€the€argument€goes,€the€trial€court€should€haveÐ `° Ðordered€Wife€to€deplete€some€of€the€assets€contained€in€her€IDS/American€Express€account€ratherÐ L œ Ðthan€increase€her€award€of€alimony.€€In€support€of€his€argument,€Husband€refers€us€to€the€SupremeÐ 8 ˆ ÐCourtððs€language€in€ò òòòBoganóóó ó€in€which€that€court€opined€in€declining€to€increase€the€wifeððs€alimonyÐ $ t Ðthat€ð ð[w]e€would€note€the€important,€if€not€overlooked,€fact€that€Ms.€Bogan€has€received€a€substantialÐ  ` Ðsum€from€Mr.€Boganððs€retirement€plan,€an€additional€amount€that€she€was€not€entitled€to€receiveÐ ü L  Ðbefore€his€retirement.ðð€€ò òòòBoganó óóó,€60€S.W.3d€at€733.€€Consequently,€the€ò òòòBoganó óóó€court€factored€in€theÐ è 8  Ðassets€received€from€the€retirement€fund€to€hold€that€the€wife€was€not€entitled€to€an€increase€in€herÐ Ô$  Ðalimony€award.€€ò òòòId.ó óóó€€We€find,€however,€that€the€facts€before€us€present€an€entirely€different€scenarioÐ À  Ðfrom€that€in€ò òòòBoganó óóó.€€In€ò òòòBoganó óóó,€the€wifeððs€expenses€had€increased€by€$192€since€the€divorce,€andÐ ¬ü  Ðalthough€she€still€fell€short€of€her€monthly€expenses,€the€trial€court€found€that€she€could€supplementÐ ˜è  Ðher€earnings€by€investing€the€lump€sum€payment€from€her€husbandððs€retirement€plan.€€ò òòòId.ó óóó€at€732,Ð „Ô  Ð733.€€However,€in€balancing€the€wifeððs€need€against€the€husbandððs€ability€to€pay,€the€court€noted€thatÐ pÀ ÐMr.€Boganððs€only€income€stemmed€from€his€retirement€investments,€which€yielded€half€of€theÐ \¬ Ðincome€he€was€earning€when€the€original€support€award€was€made.€€ò òòòId.ó óóó€at€732.€€In€the€instant€case,Ð H˜ Ðhowever,€Husband€continued€to€receive€earnings€after€his€retirement€by€virtue€of€his€part„timeÐ 4„ Ðemployment€such€that€he€did€not€have€to€disturb€his€savings€in€order€to€cover€his€expenses.€€WeÐ  p Ðtherefore€find€that€the€evidence€does€not€preponderate€against€the€trial€courtððs€decision€not€to€compelÐ  \ ÐWife€to€deplete€her€savings.Ð øH ÐÌÔ#†XyXX/XyÅj#ÔÔ#†¼Gå»XXy]k#ÔÔ‡XyX»¼GåÔà  àIn€his€brief,€Husband€contests€the€trial€courtððs€conclusion€that€forcing€Wife€to€deplete€herÐ Ð  Ðassets€would€be€unrealistic€since€the€funds€would€be€depleted€in€a€short€period€of€time.€€HusbandÐ ¼  Ðretorts€by€arguing€that€since€the€difference€between€what€Husband€was€paying€prior€to€the€courtððsÐ ¨ø Ðdecision€and€the€courtððs€order€was€only€$600,€it€would€take€almost€35€years€for€Wife€to€deplete€herÐ ”ä Ðassets€even€if€they€earned€no€interest.€€Husband€further€argues€that€since€Wife€maintains€a€minimumÐ €Ð Ðbalance€of€$2,500€to€$4,100€per€month€in€her€checking€account,€which€represents€four€to€sevenÐ l¼ Ðmonths€of€the€increase€in€support,€she€is€hardly€someone€who€is€so€destitute€as€to€require€an€increaseÐ X ¨ Ðin€alimony.€€We€find,€however,€that€the€evidence€does€not€preponderate€against€the€trial€courtððsÐ D!” Ðdecision,€and€we€defer€to€that€judgment€when€the€evidence€does€not€dictate€otherwise.Ô#†¼Gå»XXyŒ#ÔÔ‡XyX»¼GåÔÔ‡/XyXXXyÔÐ 0"€  ÐÔ#†/¼Gå»X/Xyd#ÔÔ‡/XyX»/¼GåÔÔ#†XyXX/Xyƒ#ÔÔ‡/XyXXXyÔÌà  àHusband€also€challenges€the€trial€courtððs€findings€as€to€his€ability€to€pay.€€In€particular,€heÐ $X" Ðchallenges€the€trial€courtððs€finding€that€his€income€was€between€$84,000€and€$85,000€per€yearÔ#†/¼Gå»X/XyÚ#ÔÔ‡/XyX»/¼GåÔÔ#†XyXX/Xy‘#ÔÔ‡/XyXXXyÔ,Ð ô$D # Ðarguing€that€these€figures€are€unsupported€by€the€evidence,€and€that€it€is€unclear€how€the€courtÐ à%0!$ Ðarrived€at€those€numbers.€€Husband€further€contends€that€the€trial€court€erred€in€relying€uponÐ Ì&"% ÐHusbandððs€earning€capacity€rather€than€his€actual€earnings,€arguing€that€(1)€he€had€retired€and€wasÐ ¸'#& Ðno€longer€under€any€obligation€to€continue€working,€and€(2)€that€he€had€actual€earnings€at€the€timeÐ ¤(ô#' Ðof€the€hearing€that€should€have€been€used€for€the€purposes€of€modifying€the€award€of€spousalÐ )à$( Ðsupport.€€Ð |*Ì%) ÐÐ h+¸&* Ðà  àAt€the€hearing,€the€parties€introduced€into€evidence€Husbandððs€tax€returns€from€1999€throughÐ ° Ð2002,€which€indicated€that€Husband€received€gross€income€in€the€following€amounts€for€those€years:Ð œì Ð$77,418€in€1999;€$105,629€in€2000;€$102,596€in€2001;€and€$86,484€in€2002.€€Husband€argues€thatÐ ˆØ Ðthe€trial€courtððs€reliance€on€these€figures€was€improper€since€they€were€only€relevant€to€his€earningsÐ tÄ Ðin€the€years€prior€to€the€petition€to€modify.€€Since,€according€to€Husband,€he€had€the€right€to€acceptÐ `° Ðretirement,€his€ð ðearning€capacityðð€became€non„existent€once€he€retired€since€he€was€no€longerÐ L œ Ðobligated€to€work.€€As€support€for€this€argument,€Husband€relies€upon€language€in€this€courtððsÐ 8 ˆ Ðopinion€in€ò òòòLamberson€v.€Lambersonó óòòóóóó,€No.€M2002„02773„COA„R3„CV,€2004€WL€170388€(Tenn.Ð $ t ÐCt.€App.€M.S.,€filed€January€27,€2004).€€In€ò òòòLambersonó óóó,€the€husband€was€involuntarily€terminatedÐ  ` Ðdue€to€a€change€in€job€duties€that€would€require€substantial€travel.€€ò òòòId.ó óóó,€at€*1.€€We€found€the€evidenceÐ ü L  Ðfailed€to€support€the€trial€courtððs€judgment€that€such€a€decision€was€a€willful€attempt€to€shirk€hisÐ è 8  Ðalimony€obligations;€rather,€we€held€that,€under€those€circumstances,€such€a€decision€constituted€aÐ Ô$  Ðsubstantial€and€material€change€of€circumstance€entitling€him€to€some€relief€from€his€alimonyÐ À  Ðobligation.€€ò òòòId.ó óóó,€at€*5.€€Consequently,€in€remanding€the€case€for€a€determination€of€the€extent€of€thatÐ ¬ü  Ðrelief,€we€stated€that€ð ð[i]t€is€well€to€note€that€the€relief€available€to€Mr.€Lamberson€on€remand€mayÐ ˜è  Ðbe€limited€in€time€due€to€the€fact€that€at€the€time€of€the€hearing€in€this€case€on€appeal€he€was€fastÐ „Ô  Ðapproaching€the€level€of€pay€that€he€enjoyedðð€in€his€previous€employment.€€ò òòòId.ó óóó,€at€*6.€€Husband€reliesÐ pÀ Ðupon€this€language€to€argue€that€we€should€set€alimony€based€upon€what€he€is€actually€earning€ratherÐ \¬ Ðthan€his€earning€capacity.€€We€find,€however,€that€this€argument€is€without€merit.€€It€appears€fromÐ H˜ Ðthe€evidence€adduced€at€the€hearing€that€regardless€of€whether€the€trial€court€considered€HusbandððsÐ 4„ Ðearnings€from€previous€years€based€upon€tax€returns€submitted€into€evidence,€there€was€evidenceÐ  p Ðbefore€the€court€of€his€earnings€for€2003.€€The€record€reflects€that€Husband€earned€$48,120.86€fromÐ  \ ÐWalgreens€through€July€4,€2003,€and€as€of€July€17,€2003,€there€is€documentation€indicating€thatÐ øH ÐHusband€commenced€working€thirty€hours€per€week€at€Bi„Lo€Pharmacy€at€the€rate€of€$41.83€perÐ ä4 Ðhour.€€In€addition,€evidence€proffered€at€the€hearing€demonstrated€that€his€earnings€from€his€part„timeÐ Ð  Ðjob€enabled€him€to€make€purchases€and€cover€his€living€expenses€without€depleting€his€savings.€€InÐ ¼  Ðfact,€testimony€revealed€that€some€of€those€expenditures€have€included€a€$25,000€boat€and€a€$39,260Ð ¨ø Ðtruck,€both€of€which€were€purchased€in€April,€2003;€a€gift€of€$6,000€to€a€family€friend;€$3,600€toÐ ”ä Ðcover€the€cost€of€tuition€for€his€girlfriendððs€child;€and€various€sums€to€cover€the€cost€of€repairing€hisÐ €Ð Ðgirlfriendððs€car.€€Consequently,€we€do€not€find€that€the€evidence€preponderates€against€the€trialÐ l¼ Ðcourtððs€judgment€awarding€an€increase€in€alimony€where€the€Wife€continues€to€demonstrate€financialÐ X ¨ Ðneed,€and€the€evidence€indicates€that€Husband€has€the€ability€to€pay.€Ð D!” ÐÔ#†XyXX/Xy„’#ÔÔ#†¼Gå»XXyB’#ÔÔ‡/¼Gå»»¼GåÔÔ‡/XyX»/¼GåÔÌà@‹‹)ìàV.ˆÐ #l!
