Aboutaweeklater,Mr.Cowan,principalofRedBank,announcedthatbecauseofadecreaseinenrollment,theschoolwouldloseteachers. OnSeptember8,1995,theplaintiffwasinformedthatshewasbeingtransferredtoSoddyDaisyMiddleSchool,alongwithtwootherteachers. ShereportedtodutyatSoddyDaisyonSeptember11,1995andwasassignedtoteachfiveseventhgradeclasses.ShedidnotreportfordutyonSeptember13,1995,laterstatingthatshewashavingsomeemotionalproblemsbecauseofthesituationandsoughtpsychiatrichelp. Shethereafterfiledagrievanceoverthetransfer,whichtheBoardofEducationdecidedadverselytoher.InthisactionshecomplainsthattheTennesseeEducationAssociation[ TEA]andtheHamiltonCountyEducationAssociation[ HCEA]owedherthedutyofprovidingcounselpursuanttoacollectivebargainingagreementthenineffect,andthattheagreementprovidedthatshewasentitledtofivedaysnoticeofthetransferincontrasttothethreedayswhichwereaccordedtoher.Sheseeksdamagesfortheallegedwrongfultransfer. Thecasewasdismissedonmotionforsummaryjudgment.
