YY)REMANDEDYY  JOHND.LOCKRIDGEandSCARLETTA.BEATY,LOCKRIDGE,VALONE&BEATY,PLLC,Knoxville,forPlaintiffAppellant.THOMASC.JESSEE,JESSEE&JESSEE,JohnsonCity,forDefendantAppellee.@% OPINION  %  4    <      D   Franks,J. 4  Thisisanappealfromareductioninorderedchildsupport. 4  PeggyAnneBrasfieldandJimmyCarrollBrasfieldweredivorcedonJune16,1992.Theywereawardedjointcustodyofthethreeminorchildren,withMs.Brasfieldreceivingphysicalcustodyofthetwoyoungersons,HunterandTyler,andDr.Brasfieldreceivingphysicalcustodyoftheolderson,Spencer,whowassixteenyearsoldatthetimeofthedivorce.Dr.BrasfieldwasawardedliberalvisitationwithHunterandTyler. 4  Dr.Brasfieldwasorderedtopay$2,500.00amonthinchildsupportfor 912 thesupportofthetwoyoungerchildren,whichtheCourtsaidwasbasedontheappropriatechildsupportguidelines.Ms.BrasfieldwasnotrequiredtomakechildsupportpaymentsforSpencer,becausethecourttookthatfactorintoaccountinsettingchildsupporttoMs.Brasfield.Dr.Brasfieldwasalsoorderedtopayallofthecollegeeducationexpensesforthethreechildren. 4  OnMay27,1994,Ms.BrasfieldfiledaPetitionforanIncreaseinChildSupport,allegingamaterialchangeincircumstancesbecauseofincreasedexpensesofrearingmiddleschoolagedchildrenandbecauseshenolongerhadthelegalobligationtosupportSpencer,whowasnolongeraminor.ThepartiesenteredintoanAgreedOrderonSeptember21,1994,whichsetthechildsupportat$3,000.00permonth,whichtheorderrecitedwas ...inkeepingwiththechildsupportguidelines. 4  OnJanuary27,1998,Dr.BrasfieldfiledpleadingswiththeCourtaskingthattheCourtsuspendhischildsupportobligation,duetothechildrensenrollmentinaboardingschool.Ms.Brasfieldrespondedbyrequestinganincreaseinchildsupportandajudgmentforarrearage.Sheconcededthechildrenwereenrolledinaboardingschoolforthe199798schoolyear,butassertedthatshehadtomaintainahomeforthemandcontributetotheirsupport,andthattherewasasignificantvariancebetweentheguidelineamountandthecurrentsupportbeingpaidbyDr.Brasfield. 4  Dr.Brasfieldisaneurosurgeonwhosetaxableincomefor1996was$749,428.00.Attrial,thepartiesstipulatedthatthehusbandsnetincomeaftertaxesfor1997was$37,905.00permonth.Ms.BrasfieldistheChoralMusicDirectoratSevierCountyHighSchool,wheresheearnedanetmonthlyincomeof$2,315.00in1997.AtthetimeoftrialinMarchof1998,theYYpartiesYYYYchildrenwereaged16and14,andthechildrenhaveenjoyedalavishYYlifestyleYYYYwithbothYYparentsprovidingexpensiveYYYYclothing,meals,andvacations. 4  Ms.BrasfieldtestifiedthatsheprovidesthegasandinsuranceforYYher 922 carYYYYthatTylerdrives,andthatshehashotelandtravelexpensesYYandpurchasestheirfoodwhenYYYYshegoestoBaylorSchoolinChattanoogatovisitwiththechildren,andothertravelexpenseswhenshepicksupthechildrentogohomeonweekendsYYduringtheYYYYYYschoolyear.YYYYShetestifiedthattheexpensesrelatingtohavingthechildreninherhomehavenotdecreasedsincetheybeganattendingBaylor.WhilethechildrenboardatBaylorduringtheschoolyear,theirprimaryresidenceisstillwithher,andthechildrenlivewithYYherYYYYduringtheentiresummer.ShefurthertestifiedthatexpensesYYgoingtosupportthechildrenYYYYhavegreatlyincreasedsincethelastorderonchildsupport,wherethepartiesagreedtoasumof$3,000.00permonth. 4  Shetestifiedthat,sincethedivorce,shehasincurredexpensesinexpandingthenumberofbedroomsinherhomeandinaddingastudyroom,playroom,basement,newwindows,roof,andjetskiYYliftsforthechildren,YYYYandthatsheusedsomeofthemoneyfromthedivorcesettlementtomakethehomeimprovements.Shetestifiedthatshespendswellover32%ofhernetincomeforexpensesforthechildrenandthatshedoesnothavethefundsformotelstospendasmanynightsinChattanoogatobewithherchildrenwhileatBaylor,asshewouldlike. 4  Dr.Brasfieldtestifiedthatheisspendingapproximately$44,000.00ayearforthetwochildrensboardandtuitiontoattendtheBaylorSchool,thatheprovidestelephonecardsforlongdistancecalls,aspendingmoneyallotmentforsnacksandsoforth,whileatschool,andhealsoprovidesanautomobileandagasYYcard.YYHealsoincurstravelexpensestovisitthechildrenwhileinschool.   4  TheTrialJudgenotedthattheguidelinesaredesignedtoapplytosituations wherethechildrenarelivingprimarilywithoneparent.Rule12-40-2.01(6).However,theCourtpurportedtofollowtheguidelinesinsettingthechildsupport.InJonesv. 700 Jones,930S.W.2d541(Tenn.1996),JusticeDrowatasetouthowchildsupportis  calculatedundertheguidelines:0 4 0 4(#4(#[T]heCourtcalculatesthenetincomeoftheparentwithwhomthechildrendonotprimarilylive,calledthe obligor,andthenmultipliesthatfigurebythepercentagewhichcorrespondstothenumberofchildrenforwhomsupportisbeingset.Thatamountisthenpayabletothe obligee,theparentwithwhomthechildrenprimarilylive.  (# (# p.543. 4  YYUnderYYYYtheYYguidelines,childsupportiscalculatedYYYY basedupontheappropriatepercentageofallnetincomeoftheobligor.Smithv.Smith,984S.W.2d606, @8 609(Tenn.App.1997).YYYYY Y  %  1      YY H@  4  YYWhilethefocusshouldhavebeenonthereductionoftheobligeesexpenses,ifany,theTrialYYJudgeundertooktocalculatethedaysYYthechildrenactuallyYYspentwiththemother,i.e.,threemonthsinthesummerandfortydaysforthemotherscontactwiththechildrenwhileatBaylorSchool,andunderthatcalculus,heconcludedthatthere shouldbeanupwarddeviationintheguidelinessupportforaperiodoffourmonths,i.e.,April,May,JuneandJuly.Hesetthechildsupportforthosemonthsat$4,000.00permonthwithoutanyconsiderationgiventothemothersongoingexpenses,astestifiedtoattrial,includingexpensesofmaintainingthehomeandbuyingclothingandothersupportitemsforthechildren.Insum,heconcludedthathewasreducingthesupportbelowtheamountscalledforintheguidelines,andgaveasthereasonthefathers +$$ spending$44,000.00ayearforthechildrensattendanceatBaylor.YYP 4  PMs.YYBrasfieldwasconsultedbythechildrenaboutattendingBaylor,apparentlyafterDr.Brasfieldandthechildrenhadagreedthattheywouldattendtheboardingschool.Ms.BrasfieldthenagreedtotheirattendingBaylorSchool.Dr.BrasfieldvoluntarilyagreedtopaytheadditionalexpenseofattendingBaylorSchool.Undertheguidelines,suchexpenseisdeemedanextraordinaryeducationalexpense,andordinarilywouldbeaddedtothepercentagecalculatedundertheguidelines.YYQTenn.Comp.R.&RegQRQ.QRSs.STRuleTUCh.UYY124024.04(c). 4  Whilethechildrenareatboardingschool,theTrialJudgeobserved: Ms.Brasfieldwouldnotbecookingmeals,buyinggroceries,thosetypeofthings.However,theexpenseofmaintainingaresidenceforthechildren,astestifiedtobyMs.Brasfield,continues,andwhilethereductionofcostofgroceries,utilitiesandsoforthwhilethechildrenareatBaylorisnotintherecord,Ms.Brasfieldtestifiedtothesignificantadditionalexpenseoftravel,motelsandvisitingwiththechildrenwhileatschool. 4  TheburdenwasonDr.Brasfieldtoestablishbyapreponderanceoftheevidencethathewasentitledtoareductioninchildsupport.WefindhedidnotcarrythatYYburden.SeeJones.YYYYThepartieshadpreviouslyagreedtochildsupportintheamount '  of$3,000.00permonth,andtheyagreedthatDr.BrasfieldwouldassumetheextraordinaryexpenseofsendingthetwochildrentoBaylorSchool,buttheydidnotagreethattheorderedchildsupportshouldbereduced. 4  Ms.Brasfield,onappeal,seeksYYcontinVuedVWuingWYYYYchildsupportintheamountofYY$3,000.00XpermonthX,YYYYasthepartieshadpreviouslyagreed,andsinceDr.Brasfieldhasnotcarriedtheburdentoestablishareductioninthatamount,weYYmodifyYYYYthejudgmentoftheTrialCourtandreinstatethepriororderofchildsupportintheamountof$3,000.00permonth. 700  4  TheTrialJudgesOrderawardingthewifeattorneysfeesisaffirmed,anduponremand,theTrialJudgewillestablishareasonablefeeforthewifesattorneyforservicesrenderedintheappealofthisaction. 4  Thecostoftheappealisassessedtotheappellee.@+ D  <4   4    <     __________________________ @8  4    <     HerschelP.Franks,J.CONCUR:___________________________HoustonM.Goddard,P.J.___________________________H.DavidCate,ZSp.ZJ.
