LarryE.BrumitwasconvictedonSeptember26,1996ofthemurderoftwoadultmales,includingJamesAlbertSummar,Jr.OnNovember15,1996,Mr.BrumitfiledalawsuitwhichallegedthatduringtrialJamesAlbertSummar,Sr.hadtoldmembersofthejury,whowerestandinginthehallwayofthecourthouse,thatBrumitwasguilty,andthat theybetterfindhimguilty.Mr.Brumitaskedfor$10millionindamages.Mr.SummarfiledaMotiontoDismissforfailuretostateacauseofaction.Thetrialcourtgrantedthemotion,anddismissedthecomplaintwithprejudice.Thisappealfollowed.  Mr.BrumitarguesthatMr.Summarsstatementstothejuryconstitutedembracery,anancienttermincriminallaw.Itistheoffenseof attemptingtoinfluenceajurycorruptlytoonesideortheother,bypromises,persuasions,entreaties,entertainments,douceurs,andthelike....BlacksLawDictionary522(6thed.1990).  ThoughthetermembraceryisnotfoundinTennesseescurrentcriminalcode,Mr.Brumitiscorrectinstatingthatthebehaviordesignatedbythattermstillconstitutesacriminaloffense: 0    Tenn.CodeAnn.3916508.Coercionofjuror. Wenotethatasidefromcriminalsanctionsagainstanembraceor,impropercommunicationbetweenathirdpartyandajurorinacriminalcasecanalsoresultinreversalofacriminalconvictionthatwasprocuredbysuchacommunication.SeeStatev.Furlough,797S.W.2d631(Tenn.Crim.App.1990). @ II.   Severaljurisdictionsrecognizeaprivaterightofactionforembraceryaswell.InEmployersInsuranceofWausauv.Hall,49N.C.App.179,270S.E.2d617(1980),forexample,theNorthCarolinaappealscourtaffirmedanawardof$1,280fortheplaintiffslegalexpensesafteramistrialinducedbythedefendantsattempttocoerceajuror.  InLaBarrev.Payne,174Ga.App.32,329S.E.2d533(1985),theplaintiffbroughtsuitunderboth42U.S.C.1983andstatetortlaw,contendingthatthedefendantshadconspiredtointerferewithjurydeliberations.Thetrialcourtgrantedsummaryjudgmenttothedefendants.Theappealscourtaffirmedthedismissalofthefederalclaim,butreversedthedismissalofthestatelawclaim,holdingthatGeorgia,likeNorthCarolina,recognizedembraceryasacivilwrong.  However,severalotherjurisdictionshavefoundeitherthatsuchaprivaterightdoesnotexist,orthatforreasonsofpublicpolicyanactionforembracerywouldnotbepermittedunlesstheinjuredpartyhasnoothermeansofredress.SeeOMIHoldingsv.Howell,864F.Supp.1046(D.C.Kansas,1994);Trudellv.Heilman,158Cal.App.3d251,204Cal.Rptr.551(2Dist.1984).  WehavefoundnocaseinwhichaTennesseecourthasrecognizedacivilactionforembracery.Nor,aftermuchsearching,havewefoundanycasesunderEnglishCommonLaw,orintheCommonLawofNorthCarolinapriorto1796,thatacknowledgestheexistenceofsuchanaction.  TheNorthCarolinaCourtofAppealsdecisioninEmployersIns.ofWausauv.HallrestsontheopencourtsclauseoftheConstitutionofNorthCarolina.WhiletheConstitutionofTennesseecontainsasimilarprovision,seeTenn.Const.art.I,17,wedeclinetoadopttheNorthCarolinacourtsreasoningbecauseitdiffersfromourunderstandingofthepurposeoftheopencourtsclause.Theseprovisionsdonotcreatenewrightsbutratherrecognizethatpersonshavearighttoajudicialremedyforrecognizedlegalinjuries.Recognizedlegalinjuriesincludewrongsasrecognizedbythelawoftheland.SeeBarnesv.Kyle,202Tenn.529,53435,306S.W.2d1,3(1957).ThelawofthelandconsistsoftheConstitutionofTennessee,thecommonlawincorporatedintoourlawinaccordancewithTenn.Const.art.XI,1,andthedulyenactedstatutes,regulations,andlocalordinances.  Becausethereisnostatestatuteauthorizingacivilactionfordamagesforembracery,Mr.Brumitsclaimcannotsucceedunlesshecandemonstratetheexistenceatcommonlawofarightofactionfordamagesforembracery.Mr.Brumithasnotpointedtothiscommonlawcauseofaction,andourexaminationofthetextsandtreatiseshasnotyieldedone.Accordingly,wedeclinetorecognizetheexistenceofacivilactionfordamagesforembracery.Webelievethatthesanctionsavailableunderourcriminallawareasufficientdeterrencetoanyonewhowouldseektoimproperlyinfluencejuriesintheexerciseoftheirofficialacts.@ III.
