We\M K  2       2@),    `  4 +.    ` PursuanttoTCA2917802,theCityandCountydeposited$77,100withtheCircuitCourtClerksOfficeastheamountofpaymenttheydeterminedClassicwasentitledtoforthetakingofParkwayTowers.TheCityandCountyalsorequestedreliefunderTCA2917803.This quicktakeprovisionrequiredClassictorespondtothenoticeofpetitioninfivedays;otherwisethecourtcouldgrantanordergivingtheCityandCountyimmediatepossessionoftheproperty.ClassicfileditsObjectiontothePetitionforCondemnationonJune3,1997,andtheMotionforanOrderofTakingwasheardJuly25,1997.   ` Atthemotion,RichardT.Linio,ExecutiveDirectoroftheStadiumCorporation,testifiedthatParkwayTowers,onceacquiredbytheCityandCounty,wouldberazedandreplacedwithaparkinglot.Thecostforthedemolitionofthebuildingwouldbe$250,000;whereas,thecostofapossiblerefurbishmentofthebuildingforanotherusewouldcostapproximately$2,000,000.OtherpossibleusesforthebuildingtheHousingAuthorityhadconsideredincludedofficespace,equipmentstorage,oruseasacommissaryfortheconcessionaire.AccordingtoMr.Linio,thesealternateplansarenolongerunderconsiderationbytheHousingAuthority.   ` TwoarchitectsalsotestifiedatthemotionhearingregardingParkwayTowers.Mr.WilliamH.Wilkerson,thearchitectrepresentingtheStadiumCorporation,testifiedthathewasinchargeofdesignatingthepropertiesdeemednecessaryin  :04 theCityandCountyresolutionsforthesocalled footprintofthestadium,i.e.,theactualphysicalstructure.Mr.Wilkersontestifiedthatatthebeginningoftheprojectitwasnotcertainexactlywherethestadiumwouldrest.Thus,itwasnecessarytodesignateaminimumamountoflandnecessaryfortheconstructionofthestadium,socalled coreproperties.ThisminimumdesignationdidnotincludeClassicsproperty;instead,Classicspropertywaslistedasan additionalproperty.Mr.Wilkersontestifiedthatthe additionalpropertieswerenecessaryfortheoverallstadiumproject,butnotspecificallyforthestadium.   ` Theotherarchitect,Mr.HenryBledsoe,wascalledasanexpertwitnessbyClassic.ThegistofMr.Bledsoestestimonywasthattheproposedparkinglotwouldbetooexpensivetobuild,and,therefore,costprohibitivetotheCityandCounty.Hisestimatedtotalcostfortheprojectwas$750,000toacquireandconvertthepropertyintoaparkinglotcontaining63spaces.Astothatfact,Mr.Wilkersontestifieditwashisbeliefthat85spacescouldbecreated.   ` Alsoatthemotionhearing,theattorneyforClassicattemptedtointroduceintoevidencetwonewspaperarticlesdescribingawidevarietyofusesforParkwayTowersthatwerementionedbyStadiumCorporationofficials.XZR] K   3      ׀Thesearticleswere `6-0 excludedfromtheevidenceashearsaybytheCircuitCourt.WhilethisCourtdoestakenoteofthearticlesaspartoftherecord,wemakenodeterminationastotheiradmissibilitybecausethelowercourtsrulingisnotchallengedinthisappeal.Additionally,thesearticlesservenoroleintheCourtsdeterminationofthematter.   `    ` TheCircuitCourtofHamiltonCountyissueditsOrderofTakinginfavoroftheCityandCountyonSeptember5,1997.TheCircuitCourtruledthat byvirtueofthepowerofeminentdomainandofthelawsoftheStateofTennessee,thepetitionerbeplacedinimmediate,quietandfullpossessionofthepropertybeingcondemnedintheaboveentitledsuitforthepurposeoftheFinleyStadiumProject....TheCourtdivestedClassicofanyinterestinthepropertyandawardedtheCityandCountyfulltitletothepropertyinfeesimple.   ` LocalRuleofPractice18.04forHamiltonCountyCircuitCourtrequirestheattorneyresponsiblefordrawinganordertodosowithin14daysoftheCourtsrulingonamatter.Inthiscase,the14dayrulewasviolatedbytheattorneyfortheCityandCounty.Apparentlyduringtheelapsedtime,theCircuitCourtwasonvacation.ClassicmovedtheCircuitCourttofollowthelanguageofRule18.04requiringdismissalofthecaseasapenaltyagainsttheCityandCountyfornotsubmittingtheorderwithinthe14daysallotted.TheCircuitCourtdeniedthisrequestonSeptember8,1997,pursuanttoLocalRuleof  :04 Practice1.02whichallowsthecourttosuspendtheruleswhenjusticesorequires.   ` OnSeptember29,1997,ClassicmovedtheCourtforanewtrial.ThismotionwasdeniedonNovember19,1997;subsequently,ClassicfileditsnoticeofappealonDecember1,1997.   ` EventhoughprotractedlitigationhaskeptParkwayTowersfirmlyinplaceatitsCarterStreetlocation,theCityandCountywereabletogoforthwiththeconstructionofthestadiumbecauseClassicspropertywasneverincorporatedarchitecturallyintothestadiumsphysicalstructure.BeginninginOctoberof1997,FinleyStadiumopeneditsdoorstothepublic.Atthistime,thestadiumstandscompleteandreadyforuse.Infact,FinleyStadiumhasalreadyservedashostforseveralevents.   `    ` II.TheLawofEminentDomain   ` ThereisnodisputethatthepowerofeminentdomainisaninherentrightaffordedstategovernmentthroughtheTennesseeConstitution.Section21ofArticle1provides:8  Thatnomansparticularservicesshallbedemanded,orpropertytakenorappliedtopublicuse,withouttheconsentofhisrepresentatives,orwithoutjustcompensationbeingmadetherefor.
