` àOn€March€20,€1995,€Wife€filed€a€Petition€for€Scire€Facias€because€HusbandÏhad€unilaterally€reduced€and€eventually€terminated€his€alimony€payments.€€OnÐ °511 ÐMarch€31,€1995,€Husband€filed€a€Motion€to€Modify€the€Decree€specificallyÏrequesting€the€Chancellor€ð ðto€reduce€his€support€payments€to€$200.00€per€month,Ïwith€medical€payments€to€$300.00€per€month.ðð׃×Ý ƒ##ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€€In€support€of€his€request,€HusbandÐ ° Ðalleges€that€there€have€been€material€and€substantial€changes€in€circumstances€sinceÏthe€entry€of€the€divorce€decree€warranting€a€reduction€in€his€alimony€obligation.€ÏHusband€asserts€that€Wifeððs€financial€upswing,€which€included€an€inheritance€fromÏher€motherððs€estate,€coupled€with€his€financial€downturn,€which€resulted€in€filing€forÏbankruptcy€on€his€part,€constitutes€a€substantial€and€material€change€ofÏcircumstances€to€justify€the€requested€reduction€in€alimony.€€In€response€toÏHusbandððs€motion,€Wife€asserts€that€Husband€is€able€to€afford€the€support€obligationÏand€that€she€at€all€times€has€been€in€need€of€the€support.Ìà Ð(Tenn.€App.€1989).€€The€factors€set€forth€in€T.C.A.€ðð€36„5„101(d),€applicable€to€theÏinitial€grant€of€spousal€support€and€maintenance,€where€relevant,€must€be€taken€intoÏconsideration€in€determining€whether€there€has€been€a€change€in€circumstances€toÏwarrant€a€modification€of€the€alimony€obligation.€€ò òòòThreadgill€v.€Threadgillóóó ó,€740Ð ¸  ÐS.W.2d€419,€422„23€(Tenn.€App.€1987).Ìà ` àWhile€T.C.A.€ðð€36„5„101(d)€enumerates€several€factors€for€the€court€toÏconsider,€the€need€of€the€spouse€receiving€the€support€is€the€single€most€importantÏfactor.€€ò òòòCranfordóóó ó,€772€S.W.2d€at€50.€€In€addition€to€the€need€of€the€spouse€receivingÐ ¼  Ðsupport,€the€ability€of€the€obligor€spouse€to€provide€support€is€taken€intoÏconsideration.€€ò òòòId.óóó óÐ À Ðà ` àAs€part€of€Husbandððs€contention€that€his€support€obligation€should€beÏreduced,€Husband€asserts€that€Wifeððs€inheritance€of€approximately€$125,000.00€fromÏher€motherððs€estate€subsequent€to€the€divorce€constitutes€a€substantial€and€materialÏchange€in€circumstances.€€Husband€also€contends€that€a€reduction€is€justifiedÏbecause,€in€addition€to€the€inheritance,€Wife€now€owns€the€former€marital€houseÏmortgage„free,€purchased€a€new€1994€Honda€vehicle€with€cash,€and€is€now€receivingÏSocial€Security€benefits€along€with€proceeds€from€a€V.A.€Dependent€and€IndemnityÏFund.׃×Ý ƒ##ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€€Furthermore,€Husband€avers€that€his€financial€downturn,€which€includes€hisÐ Ä,(( Ðcompanyððs€œand€his›€œjoint€bankruptcy›€in€œ1990›€and€the€loss€of€numerous€property€rightsÏto€foreclosure,€warrants€a€reduction€in€alimony.Ìà ` àOn€the€other€hand,€Wife€asserts€that€Husband€is€a€man€of€substantial€wealthÏand€earning€potential.€€Wife€contends€in€her€brief€that€since€the€divorce€Husband€hasÏsubstantially€increased€his€assets:€Ð Ä622 ÐÓÓà8 ` àà8¸ ` ü!` ü!àby€acquiring€an€interest€in€a€valuable€Cadillac€lease€whichÏis€paid€in€full,€an€interest€in€a€$30,000.00€ChevroletÏSuburban€which€is€titled€in€his€live„in€lady€friendððs€name,Ïan€interest€in€real€property€in€Shelby€County,€Tennessee,Ïan€interest€in€at€least€4€parcels€of€real€property€in€theÏState€of€Colorado,€an€interest€in€107€condominiums€inÏMemphis,€Tennessee,€an€interest€in€two€pieces€of€propertyÏin€Mississippi,€an€interest€in€a€limited€liability€corporationÏwhich,€at€least€for€the€next€8€months,€will€pay€himÏ$4,000.00€per€month€as€a€return€in€capital€and€cash€valueÏin€a€life€insurance€policy.Ð ¸ ¤¸ ¤ Ѐ€ÌÓe,Óà ` àFurthermore,€Wife€asserts€that,€along€with€the€accumulation€of€numerousÏassets,€Husbandððs€income€has€increased€since€the€time€of€the€divorce,€and€that€oneÏof€Husbandððs€business€entities€substantially€contributes€to€his€living€expenses€whichÏis€not€charged€to€him€as€income.€€According€to€Wife,€despite€the€fact€that€HusbandÏhas€gone€through€a€bankruptcy€proceeding,€his€financial€situation€and€lifestyle€haveÏimproved€since€the€entry€of€the€divorce€decree.Ìà ` àWife€argues€that€even€though€her€income€has€increased€due€to€the€inheritanceÏshe€received€and€various€other€investments,€Husband€failed€to€prove€that€theseÏmatters€were€not€in€the€contemplation€of€the€parties€at€the€time€of€the€divorceÏdecree.€€In€addition,€Wife€asserts€that€while€her€income€may€have€increased,€the€costÏof€living€has€substantially€increased,€and,€as€a€result,€she€is€barely€able€to€afford€herÏreasonable€expenses€even€with€the€full€amount€of€alimony.Ìà ` àIt€is€true,€as€Husband€argues,€that€inheritance€may€constitute€a€substantial€andÏmaterial€change€warranting€a€reduction€in€the€award€of€alimony.€€ò òòòSee€Brewer€v.Ð °*&& ÐBreweróóó Ðthe€divorce€due€in€part€to€the€receipt€of€the€inheritance€from€her€motherððs€estate,ÏHusband€has€failed€to€carry€the€burden€thrust€upon€him€in€proving€that€such€hasÏconstituted€a€substantial€and€material€change€of€circumstances.€€It€must€have€beenÏforeseeable€to€the€parties€in€a€marriage€of€thirty„two€years€that€Wife€would€receiveÏan€inheritance€from€her€motherððs€estate.€€Regardless,€Husband€failed€to€œcarryññingññ›€hisÏburden€of€proving€that€such€was€unforeseeable€or€that€such€was€not€within€theÏcontemplation€of€the€parties€at€the€time€of€the€Agreement.Ìà àFurthermore,€this€Court€does€not€believe€that€alimony€of€$18,000.00€per€yearÏwas€all€that€Wife€truly€needed€to€support€herself€nor€is€it€sufficient€for€Wife€toÏmaintain€the€standard€of€living€to€which€she€was€accustomed€prior€to€the€divorce.€ÏThe€record€indicates€that€the€parties€enjoyed€a€comfortable€standard€of€living€duringÏtheir€marriage€and€there€is€no€evidence€presented€to€indicate€that€Wife€is€now€ableÏto€enjoy€a€higher€standard€of€living€based€on€her€alimony€combined€with€theÏproceeds€from€the€inheritance.׃×Ý ƒ##ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ×€€Wifeððs€Affidavit€of€Income€and€Expenses€establishesÐ °($$ Ðthat€she€is€just€able€to€afford€her€reasonable€expenses€even€when€in€receipt€of€the€fullÏamount€of€spousal€support.€€Ìà ` àWith€regard€to€the€marital€residence,€ownership€of€such€mortgage„free€wasÏobviously€foreseeable€and€within€the€contemplation€of€the€parties€at€the€time€of€theÏdivorce€decree.€€The€Agreement€provides€for€Wife€to€receive€the€marital€residence€andÏto€assume€the€first€mortgage.€€Surely€it€was€foreseeable€that€the€mortgage€would€beÐ °400 Ðpaid„off€and€Wife€would€thereafter€own€the€home€mortgage„free.€€Furthermore,€theÏincrease€in€equity€in€the€marital€home€awarded€to€Wife€cannot€be€considered€toÏconstitute€a€substantial€and€material€change€in€circumstances.€€ò òòòSee€Norvell€v.€Norvellóóó ó,Ð ° Ð805€S.W.2d€772,€775€(Tenn.€App.€1990)€(ð ð[T]he€increased€value€of€marital€assetsÏreceived€in€a€divorce€decree€is€not€to€be€considered€as€a€factor€constituting€aÏsubstantial€change€in€circumstances€to€support€an€alimony€award€reduction.ðð).€€InÏaddition,€Wifeððs€receipt€of€monthly€Social€Security€benefits€and€proceeds€from€a€V.A.ÏDependent€and€Indemnity€Fund€were€foreseeable€and,€thus,€presumably€within€theÏcontemplation€of€the€parties€at€the€time€of€the€Agreement.Ìà ` àWith€regard€to€Husbandððs€financial€status,€Husbandððs€protestations€of€poverty€Ïare€not€supported€by€the€record.€€At€the€time€of€the€divorce,€Husband€had€an€incomeÏof€approximately€$75,000.00.€€Following€the€divorce,€Husbandððs€financial€situationÏimproved€substantially€according€to€the€record.€€At€the€beginning€of€1990,€the€yearÏin€which€Husband€filed€the€Chapter€11€bankruptcy,€Husbandððs€corporation,ÏProfessional€Development€Corporation,€had€a€value€of€approximately€$3,100,000.00.€ÏIn€addition,€according€to€a€financial€statement€prepared€in€1994,€Husband,Ïapproximately€four€years€after€the€bankruptcy€filing,€had€a€net€worth€ofÏapproximately€$2,700,000.00,€and€according€to€a€1994€W„2€form€from€CampbellÏManagement€Company,€another€business€entity€of€Husbandððs,€his€wages€wereÏ$84,700.00€which€did€not€account€for€the€numerous€individual€bills€and€debts€paidÏfor€by€the€company.€€At€the€proceedings€below,€Husband€contended€that€his€salaryÏwas€$2,467.00€per€month€which€is€approximately€$30,000.00€a€year.€€However,€thisÏamount€does€not€include€the€substantial€contributions€his€business€entity€providedÏfor€his€living€expenses€which€Wife€asserts€equals,€at€a€minimum,€approximatelyÏ$88,000.00€a€year€when€added€to€his€salary.€Ìà ` àœFurthermore,€in›€January€1995,€during€the€time€when€Husband€began€toÏunilaterally€reduce€his€support€obligation,€Husbandððs€live„in€girlfriend€became€anÐ ´844 Ðemployee€at€his€company€with€a€$30,000.00€salary,€and€Husband€tendered€a€checkÏto€her€in€the€amount€of€$5,500.00.€€Also€during€this€time,€Husband€leased€a€1995ÏCadillac€and€purchased€a€1994€Chevrolet€Suburban€for€$30,000.00.׃×Ý ƒ##ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×€€Finally,€thereÐ ° Ðare€numerous€assets,€such€as,€to€name€a€few,€a€house€in€Memphis€valued€atÏ$285,000.00€and€two€houses€in€Colorado€valued€at€$385,000.00€and€$415,000.00Ïrespectively,€that€Husband€has€acquired€since€the€Agreement.€Ìà ` àThe€record€indicates€that€while€Husband€may€have€suffered€some€financialÏsetbacks€due€particularly€to€his€profession€as€a€real€estate€developer,€HusbandððsÏfinancial€situation€has€improved,€not€deteriorated,€since€the€execution€of€theÏAgreement.€€After€extensive€discovery€on€the€part€of€Wife,€thwarted€by€evasiveÏactions€on€the€part€of€Husband,€it€was€revealed€that€Husbandððs€financial€situationÏis€not€as€disastrous€as€he€claims.€€As€previously€stated,€Husband€has€acquiredÏnumerous€rights€in€property€and€assets€and€has€had€significant€increases€in€incomeÏsince€the€divorce€decree.€€The€record€simply€does€not€support€Husbandððs€contentionÏthat€there€has€been€a€substantial€and€material€change€of€circumstances€whenÏconsideration€is€given€to€Husbandððs€entire€financial€situation.€€The€record€taken€asÏa€whole€does€not€reveal€a€man€who€does€not€have€the€ability€to€provide€$18,000.00Ïper€year€in€alimony€for€which€he€is€liable.Ì€€à ` àHusbandððs€bankruptcy€does€not€automatically€constitute€a€substantial€andÐ °($$ Ðmaterial€change€of€circumstances.€òòò ò€See€Lampley€v.€Lampleyóóó ó,€No.€01A01„9708„CH„Ð °*&& Ð00423,€1998€WL€44938€(Tenn.€App.€M.S.€Feb.€6,€1998).€€€€œññÌ›à x àññIn›€ò òòòLampleyóóó ó,€the€husbandÐ ´,(( Ðhad,€since€the€entry€of€the€divorce€decree,€filed€a€Chapter€7€bankruptcy,€sufferedÏseveral€financial€downturns,€and€had€acquired€numerous€financial€commitments.€€InÏcontrast,€the€wife€had€acquired,€as€gifts€from€her€mother€and€son„in„law,€three€realÏestate€properties€which€were€used€as€rental€property,€had€built€a€new€house€forÐ ¸400 Ðherself,€and€had€numerous€other€financial€upswings€since€the€date€of€the€divorceÏdecree.€€In€an€attempt€to€reduce€his€alimony€obligation,€the€husband€contended€thatÏhe€could€no€longer€pay€the€agreed€alimony€and€that€the€wife€was€no€longer€in€needÏof€such.€€The€wife€responded€by€noting€that€the€husbandððs€earnings€had€increasedÏsince€the€divorce€decree,€that€he€had€purchased€a€new€home€with€his€paramour€andÏher€children,€and€that€he€had€numerous€other€assets€unaffected€by€the€bankruptcy.€ÏThe€Court,€refusing€to€alter€the€husbandððs€alimony€obligation,€said:€ÌÓÓà8 ` àà8¸ ` ü!` ü!àAlimony€is€not€a€required€provision€in€the€maritalÏdissolution€agreement.€.€.€.€€Nevertheless,€the€parties€sawÏfit€to€include€alimony€in€their€agreement.€€It€must€beÏpresumed€that€the€alimony€provision€was€part€of€theÏinducement€or€consideration€for€the€other€provisionsÏregarding€division€of€the€marital€estate.€€The€Courts€areÏjustified€in€being€reluctant€to€disturb€an€alimonyÏobligation€assumed€under€such€conditions.Ð ¸ ¤¸ ¤ ÐÌÓVMÓòòò òId.ó óóó€at€*5.Ð ° Ðà ` àWe€agree€with€the€trial€court€that€the€changes€in€circumstances€since€the€entryÏof€the€divorce€decree€are€not€substantial€or€material€insofar€as€Husbandððs€ability€toÏpay€and€the€Wifeððs€needs.€€Accordingly,€we€affirm€the€Chancellorððs€denial€ofÏHusbandððs€motion€to€modify€the€divorce€decree.€ÌÓ
