Thecomplaintsought$350,000damagesfornegligenceandmismanagementoftheestateofIraRichardsCockrill.Thecomplaintdoesnotexplaintheplaintiffsinterestin,northedefendantsrelationshiptotheestate.ϜAmongtheallegationsisone ThatthiscomplaintisbroughtunderauthorityofϜT.C.A.2920201,et.seq.thatnoticewastimelygivenperattachedexhibit1.andthatsaidcomplaintisproperunderremovalofimmunity,T.C.A.2920205.  Tenn.CodeAnn.292201,etseq.dealswiththeremovalofimmunityforgovernmentalentitiesundertheTennesseeGovernmentalTortLiabilityAct.Nogovernmentalentitieshavebeennamedasdefendants,andhowthecitedlegislationaffectsthecontroversyisnotexplainedinthecomplaint.  Fromtheremainingallegationsinthecomplaintwegatherthatthedecedentownedaparcelofrealestateathisdeathandthatsomeone(notanyofthedefendants)livedinitrentfreeforseventeenyearsdespitetheprotestsoftheϜheirs,andtheirinsistencethattheinterloperberemoved;thattheplaintiffthinksthe executorsmismanagedtheestateandprofitedfromittothedetrimentoftheheirs;thattheprobatejudgeerredinnotremovingtheinterloperfromtheϜproperty,andthenorderingthepropertysoldthroughtheauctioncompany.̜@ II.@ TheLawyerandtheAuctionCompany   ThelawyerdefendantandtheauctioncompanyfiledmotionstodismissunderRule12.02(6),Tenn.R.Civ.Proc.Weagreethatthecomplaintdoesnotstateacauseofactionagainsteither.Afterbeingmentionedinthecaption,thelawyersnamedoesnotthereafterappearinthecomplaint.Astotheauctioncompany,byengaginginabroadviewofthecomplaint,wecouldinterpretitasstatingthattheauctioncompanysoldthepropertyundertheordersoftheprobatecourt.  ThereisnoallegationinthecomplaintthateitherdefendantengagedinanywrongfulconductorbreachedanydutytotheindividualplaintiffϜortotheestate.Thereforeweconcludethatthelowercourtproperlydismissedthesetwodefendants.@ III.@ TheTwoIndividualDefendants   Theothertwoindividualdefendantsfiledananswer.Withoutidentifyingtheirrelationshiptotheestate,theydeniedthematerialallegationsinthecomplaintandallegedthattherecordsoftheprobatecourtwouldshowthattheyusedtheirbesteffortstoevicttheinterloperandtogetthepropertysold.Theansweralsoassertsthattheproceedsfromthesaleofthepropertyweredividedequallyamongtheheirs.Wethinkareasonableconclusiontobedrawnfromtheansweristhatthetwoindividualsfilingtheanswerwererepresentativesoftheestateinsomecapacity.Despitetheconclusiontobedrawnfromtheanswer,thelowercourtdismissedthecomplaintsuasponte.  Weagreethatthecomplaintshouldhavebeendismissedevenonthecourtsownmotion.Defensesofthefailuretostateaclaimandthelackofsubjectmatterjurisdictionofthecourtarenotwaivedbyfilingananswertothecomplaint.Tenn.R.Civ.Proc.12.08.Theymayberaisedatanytime,evenatatrialonthemerits,id.,andthecourthastheauthoritytodismissthecomplaintsuasponte.Huckebyv.Spangler,521S.W.2d568(Tenn.1975).  Takingtheallegationsofthecomplaintinthelightmostfavorabletotheplaintiff,thisisanactionfordamagesagainstthetwonamedindividualsfornottakingcontrolofthedecedentsrealpropertyandfornotsellingitinareasonablemanner.Evenifwetaketheanswerasanadmissionthatthetwoindividualsrepresentedtheestateinsomecapacity,therealpropertyofthedecedentdescendstotheheirsorpassestothedeviseeunderthewill,andtheexecutororadministratorcannotmanageordisposeofit.Grayv.BoyleInv.Co.,803S.W.2d678(Tenn.App.1990). Inshort,theexecutororadministratorhasnothingtodo,virtuteofficii,withthelandsofthedecedent,excepttosubjectit,incaseoftheinsolvencyofthepersonalty,inthemodeprescribedbystatute,tothesatisfactionofthedecedentsdebts.PritchardonWillsandAdministrationofEstates,FifthEd.630;Edwardsv.McCall,10Tenn.App.276(1929).  Apparentlythepropertyinthiscasewassoldtopaythedebtsofthedecedent(althoughthatisnotclearfromtherecord),butthecomplaintallegesthatthesalewasconductedundertheordersoftheprobatecourt.Inshort,thecomplaintdoesnotstateabreachofdutytotheplaintiffforwhichtheindividualdefendantsareliableindamages.  Ifweconstruedthecomplaintasanactiontoopentheaccountsofthepersonalrepresentatives,wewouldhavedifficultywiththequestionofthecircuitcourtsjurisdiction.Whilethecourtshaverecognizedtheinherentpowerofthechancerycourttoopenandreviewaccountsgenerally,Cannonv.Apperson,82Tenn.553(1885),wedonotknowofanyauthoritytoconductsuchaproceedinginthecircuitcourt.
