Thepetitionstatesthefollowingfacts: OnJuly27,1981,theprisonerwassentencedto25yearsconfinementat35%forunspecifiedcriminalactivity.(The35%isdoubtlesstheminimumlengthofincarcerationbeforepossibleparole.) OnMay14,1993,theprisonerescapedfromcustody. OnMay21,1993,adisciplinarypanelassessedthefollowingpunishment: (a) Forassaultonemployee:30%extensionofreleaseorparoledates.(Presumably,theabove35%minimumincarcerationwasincreasedby30%or10.5%to40.5%oftheoriginal25yearssentence.) (b)Forescape:10%extensiononreleasedate.(Anadditionof3.5%to44%.) TheprisonerappliedtotheCommissionerforadeclaratoryrulinguponthevalidityofthedecisionofthedisciplinarypanelandthedefendant,Lachie,respondedtotheapplicationbystatingthatadeclaratoryorderwasnotappropriate. Otherallegationsofthepetitionanditsamendmentsaredeemedirrelevanttothedispositionofthisappeal. Theprisonerfiledthepresentsuitseekingthefollowingrelief: 1. AdeclarationthattheadministrativepoliciesofthedefendantsviolateT.C.A.Ϝ4035117(c)andthefederalandstate prohibitionsagainstexpostfactopunishment. 2. Mandatoryordersto reinstateandrecalculateplaintiffsparoleeligibility;to expungethedisciplinaryrecord;to determineplaintiffsconductwithinthepoliciesandproceduresineffectatthetimeofplaintiffsconviction. 3. Compensatoryandpunitivedamages. ThedefendantsmovedforsummaryjudgmentsupportedbyaffidavitoftheSentenceAnalystoftheDepartmentstatingthat: 1. OnDecember16,1974,defendantreceivedtwo15yearconcurrentsentencesforrobbery,andwasreleasedtoparolesupervisiononSeptember26,1980. 2. OnJuly27,1981,plaintiffreceiveda25yearsentenceforaggravatedrape,a25yearsentenceforaggravatedkidnapingandathreetotenyearsentenceforautolarceny,thethreesentencestorunconsecutively. Theplaintifffilednoswornresponsetotheaboveaffidavit. TheTrialCourtsustaineddefendantsmotionforsummaryjudgment,statingthefollowingreasons:   `  Plaintiffwasconvictedofaggravatedrape,aClassXoffensein1981.Atthetimeofthisconviction,T.C.A.4028301(a)provided NotwithstandinganyprovisionoftheTennesseeCodeAnnotatedtothecontrary,theserviceofsentence,releaseeligibilityandsupervisionwhileonreleaseofapersonconvictedofaClassXfelonyshallbegovernedexclusivelybytheprovisionsofthissection.T.C.A.4028301(h)provided,inpart, Foraviolationofanyoftherulesofthedepartmentofcorrectionortheinstitutioninwhichthepersonisincarceratedthecommissionerofcorrectionorhisdesignee,maydeferthereleaseclassificationeligibilitydatesoastoincreasethetotalamountoftimeaprisonermustservebeforebecomingeligibleforreleaseclassificationstatus.Thus,atthetimeofPlaintiffs1981conviction,PlaintiffwasonnoticethataviolationofanyTDOCrulemightresultinhisreleaseeligibilitydateextension.BecausethepolicyunderwhichPlaintiffreceivedhisREDextensionwasineffectatthetimeofhisescape,therewasnoexpostfactoviolation.CaliforniaDepartmentofCorrectionsv.Morales,514US499,115S.Ct.1597,131L.Ed2d588(1955);Reinholtzv.Bradley,No01A019512CH00570(Nov.1,1996).     Theappellantsbriefcontainsno statementoftheissuespresentedforreviewasrequiredbyTRAPRule27(a)(4).However,saidbriefcontainsthefollowing arguments:   `  I. WhethertheTrialCourterredoractedcontrarytolawingrantingsummaryjudgmenttoappellees II. TrialCourterredinfailingtostrikeappelleesimproperlyfiledmotions,pleadingandpapers. III. WhethertheTrialCourterredindismissingappellantspetitionfordeclaratoryjudgment.           Appellantarguesthatthesummaryjudgmentinfavorofdefendantsiserroneousorcontrarytolaw.Authoritiescitedbyappellantareinapplicablebecausedefendantspresentedevidencewhich,ifuncontradicted,entitleddefendantstodismissal.Appellantofferednocontradictoryevidence.Therefore,thesummaryjudgmentinfavorofdefendantswasnoterroneousorcontrarytolaw.TRCPRule56;Armesv.Hewlett,Tenn.App.1992,843S.W.2d427. AppellantnextarguesthattheTrialCourterredinfailingtoruleuponhisnumerousmotionstostrikedefendantspleadings.AnysuchfailureoftheTrialCourtwasjustifiedbythelackofmeritinthemotionstostrike,andtheresultreached. Finally,appellantarguesthattheTrialCourterredindismissinghissuitfordeclaratoryjudgment.T.C.A.4035117(c)declares:   `  (c) ForallpersonswhocommittedcrimespriortoJuly1,1982,priorlawshallapplyandremaininfullforceandeffectineveryrespect,including,butnotlimitedto,sentencing,paroleandprobation.[Acts1989,ch.591,6.]     AlloftheabovesentenceswerereceivedpriortoJuly1,1982,butthereisnoshowingthatsaidsentences,ortheparoleorprobationthereonhavedeviatedfromtheprovisionsofT.C.A.4035117. AppellantnextarguesthatDepartmentPolicy502.02wasapplicabletohisparolebutwaschangedbyanundesignatedandunquotedpolicyonAugust7,1986,andbyafurther,quoted,policyonFebruary15,1989,whichrequiredescapetobepunishedbydelayofparoleeligibilityorsentenceexpiration,whicheverisless. Thereisnoshowingthattheexpirationofappellantssentenceshasbeendelayed. Fortheforegoingreasons,appellantsthirdargumentisfoundtobewithoutmerit.̛̜ ThejudgmentoftheTrialCourtisaffirmed.Costsofthisappealaretaxedagainsttheappellant.ThecauseisremandedtotheTrialCourtfornecessaryfurtherproceedings.
