àThe€executrix,€Beatrice€Connatser,€is€the€widow€of€Climer€E.ÏConnatser.€Gary€M.€Connatser€is€a€son€of€Climer€E.€Connatser,Ïdeceased,€by€a€prior€marriage.€€€Under€the€Will€of€Climer€E.ÏConnatser,€which€is€contested€here,€Beatrice€Connatser€is€the€soleÏdevisee€of€any€and€all€property,€real,€personal€or€mixed€"to€theÏexclusion€of€all€others"€in€the€event€she€survived€the€testator,Ïwhich€she€did.€Samuel€D.€Connatser€is€the€son€of€BeatriceÍConnatser€and€Climer€E.€Connatser,€and€a€one„half€brother€to€GaryÏM.€Connatser.€€Samuel€is€the€contingent€devisee€in€the€event€hisÏmother,€Beatrice,€should€have€predeceased€the€testator.ÌÌà àWe€should€note€that€the€plaintiff„contestant€is€pro€se.€ÏWhile€we€are€constrained€to€view€pleadings€and€procedural€mattersÏliberally€when€a€non„lawyer€party€appears€pro€se,€we€are€not€atÏliberty€to€overlook€either€procedural€law,€substantive€law€or€theÏRules€of€Civil€Procedure€approved€by€the€Supreme€Court€and€theÏGeneral€Assembly.€€The€record€is€filled€with€superfluous€andÏirrelevant€documents,€having€no€basis€in€either€law,€fact€orÏprocedure€insofar€as€the€record€reflects.€€Nevertheless,€we€haveÏreviewed€the€record€in€its€entirety€in€an€œattempt€to›€ensure€thatÏthe€appellant€suffered€no€injustice€at€the€hands€of€the€judicialÏsystem.€€We€are€unable,€however,€to€ensure€that€the€appellant€willÏnot€suffer€an€œ"injustice›œ"›€as€a€result€of€incompetent€representa…tion€as€a€pro€se€litigant.ÌÌà àIn€òòState€v.€Goodwinóó,€909€S.W.2d€35,€(Tenn.€œCrim›.€App.€1995),Ïthe€defendant€sought€to€represent€himself.€€The€trial€court€cau…tioned€the€defendant€as€follows:ÌÌÓÓà8 à"You€have€no€greater€right€than€any€other€litigants€andÏmust€expect€and€receive€the€same€treatment€and€consider…ation€as€if€you€were€represented€by€an€attorney.€You€areÏheld€to€the€same€familiarity€with€the€required€proce…dures,"€and€that's€what€bothered€me€some,€"and€the€sameÏnotice€of€statutory€local€rules€as€would€be€attributedÏto€a€duly„qualified€member€of€the€bar.€The€trial€judgeÏwill€not€act€for€your€attorney€at€all.€A€party€whoÏrepresents€himself€would€be€held€to€the€same€standard€ofÏknowledge€and€practice€as€any€qualified€member€of€theÏbar.€Reasonable€consideration€for€a€layman€acting€as€hisÏown€attorney,€"and€I€have€already€advised€œyou›€this,Ï"does€not€require€the€Court€to€interrupt€the€course€ofÏproceedings€to€translate€legal€terms,€explain€legalÏrules,€or€otherwise€attempt€to€address€the€ongoingÏconsequences€of€the€party's€decision€to€function€in€aÏcapacity€for€which€he€is€not€trained."€ÌÌÓÓId.€at€41.ÌÌà àWe€agree€with€the€general€proposition€set€out€by€the€trialÏjudge€in€òòGoodwinóó,€however,€as€we€have€previously€noted,€we€willÏcast€the€pro€se€litigant's€actions€in€the€most€liberal€lightÏallowed€by€law.€€In€this€case,€we€have€done€so.ÌÌà àThe€appellant's€issues€presented€for€review,€generally€stat…ed,€assert€that€he€was€denied€due€process€and€abuse€of€discretionÏby€the€trial€court.€€We€find€no€merit€in€either.ÌÌà àThe€appellee€filed€a€motion€for€summary€judgment€pursuant€toÏRule€56,€Tennessee€Rules€of€Civil€Procedure,€on€the€grounds€thatÏthere€was€no€genuine€issue€of€a€material€fact€and€that€she€isÏentitled€to€judgment€as€a€matter€of€law.€€As€earlier€noted,€theÏgrounds€upon€which€the€appellant€sought€to€contest€the€will€œwere›Ïlack€of€mental€capacity€and€undue€influence.€€The€appellee€filedÏin€support€of€her€motion€for€summary€judgment,€the€affidavits€ofÏthe€attorney€who€drafted€the€will€and€the€two€attesting€witnesses.€ÏThe€affidavits€established€that€the€will€was€duly€executed€and€inÏthe€opinion€of€the€attorney€and€the€attesting€witnesses,€theÏtestator€was,€at€the€time€of€the€execution€of€the€will,€of€soundÏmind€and€disposing€memory€and€did€not€appear€to€be€under€any€undueÏinfluence.ÌÌà àThe€duty€of€a€non„moving€party,€when€faced€with€a€motion€forÏsummary€judgment€is€well„settled.€ÌÌÓÓà8 àà àDuring€the€course€of€time€while€this€litigation€was€pendingÏin€the€trial€court,€the€appellant€filed€various€affidavits.€€None,Ïhowever,€went€to€the€question€of€mental€capacity€at€the€time€ofÏthe€execution€of€the€will.€€Most€contained€inadmissible€or€irrele…vant€evidence€and€did€not€meet€the€requirements€of€òòFowler€v.€HappyÏGoodman€Familyóó,€supra,€regarding€admissibility€of€evidence.€ÏFurther,€the€appellant€failed€to€demonstrate€in€any€fashion€thatÏthe€testator€was€mentally€incompetent€to€make€a€will.ÌÌÓÓà8 àà àWhile€the€burden€is€upon€the€proponent€to€establishÏthat€the€will€was€duly€executed€by€a€competent€testator,Ïupon€proof€of€due€execution,€the€capacity€of€testatorÏand€voluntariness€of€his€act€are€presumed.€òòCurry€v.ÏBridgesóó,€45€Tenn.€App.€395,€325€S.W.2d€87€(1959);ÏòòœNeedham›€v.€Doyleóó,€39€Tenn.€App.€597,€286€S.W.2d€601Ï(1956).ÌÌÓӜ̛à àThe€subject€action,€civil€in€nature,€was€properly€trans…ferred€to€the€Circuit€Court€from€the€Probate€Court€ofÏShelby€County€under€the€applicable€statute.€Accordingly,Ïwe€find€that€where€there€is€no€genuine€issue€as€to€anyÏmaterial€fact€summary€judgment€under€Rule€56€is€appro…priate€in€a€will€contest€proceeding€and€does€not€amountÏto€an€improper€denial€of€contestants'€right€to€a€juryÏtrial.ÌÌId.€at€760.ÌÌÓÓÌà àSummary€judgment€upholding€the€validity€of€the€last€will€andÏtestament€of€Climer€E.€Connatser€was€properly€granted€in€thisÏcase.ÌÌœà àThe€appellant€asserts,€in€a€manner€somewhat€disrespectful€toÏthe€court,€that€the€court€"erred€in€precluding€him€from€conductingÏdiscovery."€€First,€we€note€that€the€appellant€filed€eighty„fiveÏinterrogatories.€€Of€the€eight„five€interrogatories,€€eleven€wereÏanswered.€€The€remaining€interrogatories€concerned,€in€the€main,Ïevents€that€could€in€no€way€be€calculated€to€lead€to€the€discoveryÏof€admissible€evidence€or€relevant€information,€or€were€so€overlyÏbroad,€burdensome€and€ambiguous€as€to€be€incapable€of€a€meaningfulÏanswer.€€We€note€that€the€interrogatories€were€filed€with€theÏappellant's€original€pleadings.€€At€the€same€time,€a€motion€toÏcompel€answers€to€the€interrogatories€was€filed.€€Such€a€motionÏwas€untimely,€frivolous€and€not€in€harmony€with€the€TennesseeÏRules€of€Civil€Procedure.€€Further,€the€appellant€claims€to€haveÏfiled€a€notice€to€take€depositions€which€he€claims€the€appelleeÍignored€and€the€court€refused€to€enforce.€€We€find€in€the€record€aÏ"motion€to€start€depositions€and€discovery"€which€was€also€filedÏon€the€same€date€as€the€original€pleading.€€Such€a€motion€isÏunknown€to€the€Tennessee€Rules€of€Civil€Procedure.€€The€motion,Ïdid€however,€contain€a€list€of€items€that€could€be€construed€asÏrequests€to€produce.€€The€request€for€production€of€documents€was,Ïlike€the€interrogatories,€in€the€main,€totally€irrelevant€andÏcould,€in€no€way,€reasonably€be€expected€to€lead€to€additionalÏinformation€material€to€the€issues€raised€in€the€pleadings€in€theÏtrial€court.€€Proper€responses€were€made€to€all€appropriate€re…quests€for€production.ÌÌà àFinally,€as€to€the€"notice€to€take€deposition,"€there€isÏcontained€in€the€file€a€document€styled€"Notice€to€Take€Deposi…tion."€€The€"notice,"€however,€is€a€"request"€addressed€to€theÏCircuit€Court€Clerk€to€issue€subpoenas€to€take€depositions.€€ThereÏwas€no€notice€as€contemplated€by€Rule€30.02,€Tennessee€Rules€ofÏCivil€Procedure.€€Rule€30.02€provides€in€pertinent€part€as€fol…lows:ÌÌÓÓà8 àà à(1)€A€party€desiring€to€take€the€deposition€of€anyÏperson€upon€oral€examination€òòò òshall€give€notice€inÏwriting€to€every€other€party€to€the€actionóóó ó.€TheÏnotice€shall€be€served€on€the€other€parties€at€leastÏfive€days€beforehand€when€the€deposition€is€to€be€takenÏin€the€county€in€which€suit€is€pending.€When€the€deposi…tion€is€to€be€taken€out€of€the€county,€at€least€sevenÏdays'€notice€shall€be€given.€The€notice€shall€state€theÏtime€and€place€for€taking€the€deposition€and€the€nameÏand€address€of€each€person€to€be€examined,€if€known,€andÏif€the€name€is€not€known,€a€general€description€suffi…cient€to€identify€the€person€or€the€particular€class€orÏgroup€to€which€the€person€belongs.€If€a€subpoena€ducesÏtecum€is€to€be€served€on€the€person€to€be€examined,€theÏdesignation€of€the€materials€to€be€produced€as€set€forthÏin€the€subpoena€shall€be€attached€to€or€included€in€theÏnotice.€(Emphasis€added).ÌÌÓÓÌà àWe€find€no€merit€in€the€appellant's€complaints€relating€toÏthe€trial€court's€alleged€failure€to€enforce€the€appellant'sÏattempts€to€obtain€discovery.€€In€so€doing,€we€are€constrained€toÏstate€affirmatively€that€the€allegations€of€wrongdoing,€prejudice,Ïbias€and€malfeasance€leveled€against€the€trial€judge€in€the€appel…lant's€brief€are€entirely€unsupported€by€the€record,€are€scurri…lous€and€demonstrate€a€total€lack€of€reasonable€decorum.€SuchÏconduct€by€attorneys€or€pro€se€litigants€should€not€be€condoned.ÌÌ›à
