Ї  Mr.CooleyremainedintheSequatchieCountyJailfollowingtherevocationofhisparole  ratherthanbeingreturnedtotheDepartmentofCorrection.AccordingtoMr.Cooley,theSheriff  ofSequatchieCountyaskedhimtoworkasatrustyandpromisedhimthathewouldearntwodays  ofsentencereductioncreditsforeverydayheperformedroutinemaintenancetasksasassigned. t Accordingly,Mr.Cooleybeganwashingcountyvehicles,maintainingthepropertyaroundthejail, ` andperformingmaintenanceworkoncountyvehicles.AccordingtoMr.Cooley,healsoperformed L  personalworkfortheSheriff,includinghaulingfirewoodtotheSheriffscabin,repairingtheroof 8  oftheSheriffsbarn,andperformingmaintenanceworkonvehiclesownedbytheSheriffandhis $ t friends.   1        `   Afterserving485daysintheSequatchieCountyJail,Mr.CooleywasagainparoledonApril  8  20,1995.FourdaysafterMr.Cooleysrelease,theBoardofParolesissuedanotherparoleviolation $  warrant.Mr.CooleyassaultedhisparoleofficerandtheChiefDeputySheriffofSequatchieCounty   whentheyservedhimwiththewarrantonJune12,1995.Mr.Cooleywasreturnedtocustody,and   onApril28,1997,wasconvictedofaggravatedassaultandsentencedtofouryearstobeserved   consecutivelywithhispriorsentence.Onthisoccasion,Mr.Cooleywasincarceratedinastate   correctionalfacilityratherthantheSequatchieCountyJail. p   In1999Mr.CooleyinquiredintotheDepartmentofCorrectionscalculationofhissentence H reductioncreditsandlearnedforthefirsttimethattheDepartmenthadreceivednoinformationfrom 4 theSheriffofSequatchieCountyregardingthesentencecreditsheearnedwhileincarceratedinthe  p SequatchieCountyJail.Accordingly,onOctober4,1999,hefiledapetitionforwritofmandamus  \ intheCircuitCourtforSequatchieCountyrequestingthecourttoordertheSheriffofSequatchie H CountytocalculatehissentencecreditsandforwardtheinformationtotheDepartmentof 4 Correction.Eventually,theSherifffiledaproseanswerassertingthathehadmaileda    computationofMr.CooleyssentencereductioncreditstotheDepartmentofCorrection.T   2           Mr.Cooleyspetitionlanguishedinthetrialcourtforoveroneyear,apparentlybecauseMr.  CooleywasunawareofLocalRuleIX(a)thatrequiredthemovingpartyonanycivilmotionornon  jurytrialtofilea requesttodocketonanapprovedformatleastsevendaysbeforetherequested l hearingdate.   3      ׀FinallyinAugust2000,Mr.Cooleyfileda petitionforfastandspeedyhearing. complaint,heperformedworkforwhichhewasentitledtosentencereductioncreditswhilehewas  incarceratedintheSequatchieCountyJail.P   16      ׀     Mr.CooleyalsoallegesthattheSheriffofSequatchieCountyhasalegaldutytoprovidethe t DepartmentofCorrectionwithreportsconcerningtheaccrualofthesecredits.QT   17      ׀Forthesepurposes, ` theSheriffofSequatchieCountyisdeemedtobea warden,Tenn.CodeAnn.4121236(d),and L  is,therefore,requiredtokeepwrittenrecordsonamonthlybasisofthesentencereductioncredits 8  aprisonerhasearned.Tenn.CodeAnn.4121236(a)(3).Becauseprisonersmaybecome $ t ineligibletoearnsentencereductioncreditsTh   18      ׀andmayalsobedeprivedofsentencereductioncredits  ` theyhavealreadyearned,U   19      ׀theserecordsmustreflectanyactionsthateitherrenderaprisoner  L  ineligibletoearnsentencecreditsordepriveaprisonerofpreviouslyearnedsentencereduction  8  credits.Althoughnostatuteorruleexpresslyrequiresasheriffhousingastateprisonertosendan $  accountingofaprisonerssentencereductioncreditstotheDepartmentofCorrection,thisobligation   isanecessarypartofTenn.CodeAnn.4121236(a)(3).Itwouldbenonsensicaltoallowstate   prisonerstoearnsentencereductioncreditswhiletheyareincarceratedinacountyjailbutthennot   torequireasherifftoinformtheDepartmentofCorrection!thelegalcustodianoftheprisoner!
