'& TXFXXQXM   ` Theappellant,Mr.KennethCulbert,appealsfroman h*!* orderoftheCircuitCourtofCarterCountygrantingCarterCountysmotiontodismissorforsummaryjudgmentofMr.CulbertsappealofadecisionoftheCarterCountyPlanningCommissionbyawritofcertiorari.   ` Mr.CulbertisoneofseveralownersofatractoflandinCarterCounty,Tennessee.Mr.CulbertsapplicationtobuildtheRolandAcresMobileHomeParkuponthislandwasdeniedbythePlanningCommission.   :0>    ` PriortoJune20,1994,Mr.Culbertsubmitteda preliminaryplanforRolandAcresMobileHomeParktothePlanningStaffforconsiderationbythePlanningCommission.ConsiderationoftheplanforthethismobilehomeparkfirstappearedonthePlanningCommissionsagendaonJune20,1994.Atthismeeting,theCommissionnotedMr.CulbertsuseofthispropertywouldnotbepermittedbytheproposedzoningordinanceforCarterCounty.TheoriginaldraftforthiszoningordinancewassubmittedbythePlanningCommissiontotheCarterCountyBoardofCommissionersinOctoberof1993.Amapdisplayingtheproposedzoningdistrictswasposted,andthereafteramendedasnecessary,intheCountyPlanningOffice.Thepropertyatissueinthiscasewasconsistentlyzonedforsinglefamilyresidences,excludingmobilehomes.AtthetimeofMr.Culbertsapplication,theproposedordinancewasnearingitsfinalform.ThePlanningCommissioncertifiedtheordinanceinitsfinalformonJuly14,1994,andsubmittedtheordinancetotheCarterCountyBoardofCommissioners.ThisproposedordinancewasadoptedonSeptember29,1994.   ` ThePlanningCommissiontooknoactiononMr.CulbertsproposalinthemeetingofJune20,1994.OnJuly18,1994,the  :04 CommissionestablishedasubcommitteetostudyMr.Culbertsproposalandreportitsfindingsatthenextcommissionmeeting.OnAugust15,theCommissionstatedseveraldefectsintheplansubmittedbyMr.Culbert,andonceagainnotedthattheuseofthelandsoughtbyMr.Culbertwasinconsistentwiththependingordinance.TheCommissionpostponedconsiderationofPlatapprovaluntilAugust22,1994,inordertoobtainanopinionfromthecountyattorneyonwhetherapprovalcouldbedeniedbasedonthe pendingordinancedoctrine.OnAugust22,1994,theCommissiondeniedapprovaloftheplanforthefollowingreasons: `  ThereispendingbeforetheCarterCountyCommissionazoningresolutionorordinance,whichresolutionforzoninghasbeenrecommendedbytheplanningcommission.IfthiszoningresolutionispassedbythecountycommissionofCarterCounty,the91lotmobilehomeparkwillbeinviolationthereof. `  Theapprovaloftheproposed91lotmobilehomeparkwouldnotpromotethepublichealth,safety,moralandgeneralwelfareofCarterCounty. `  Also,approvaloftheproposaloftheproposed91lotmobilehomeisdeniedbecausethedeveloper,KennethCulbert,hasfailedtocomplywithotherrulesandregulationsofthisplanningcommission.   ` OnMarch23,1995,aftertheCommitteedeniedapprovalofthemobilehomepark,Mr.CulbertfiledsuitintheCircuitCourtforCarterCountyinElizabethtonagainstCarterCounty,membersoftheCarterCountyPlanningCommission,andmembersoftheCarterCountyBoardofCommissioners.Inhiscomplaint,Mr.Culbertsoughttheissuanceofacommonlawwritofcertiorariby 09/3 theTrialCourt.CarterCountyansweredthecomplaint,andfiledamotiontodismissorforsummaryjudgmentastoallofMr.Culbertsclaimsallegingthathehadfailedtostateaclaimforwhichreliefcouldbegrantedorhadnotraisedagenuineissueofmaterialfactfortrial.   ` OnOctober28,1995,theCircuitCourtissuedthewritofcertiorari.OnNovember12,1996,theCircuitCourtheardCarterCountysmotion.Attheconclusionofthehearing,theChancellorgrantedthemotiononallgroundsasserted.TheCourtenteredajudgmentdismissingallclaimsonDecember18,1996.   ` OnJanuary16,1997,Mr.Culbertfiledamotionforanewtrial,amendmentoforder,rehearingorissuanceofthepermitsought.Inthismotion,Mr.CulbertaskedonlythattheCircuitCourtchangeitsrulingonthedismissalofhispetitiontooverturntheCommissionsdenialofapprovalfortheRolandAcresMobileHomeParkpursuanttothewritofcertiorari.TheChancellorheard,anddeniedMr.CulbertsmotiononJune18,1997.AnorderdenyingthismotionwasenteredonAugust6,1997.Mr.CulbertfiledhisnoticeofappealonSeptember4,1997.   ` EventhoughwequestionthetimelinessoftheplaintiffsapplicationforcertioraritotheCarterCountyCircuitCourt,wefinditnecessarytoonlyaddressthefollowingissuepresentedbyMr.Culbert:  :04 M†TR[A' Legal[A'LegalA' LegalA' LegalT     ` WhetherthePlanningCommissionsdenialofMr. `  CulbertsplanfortheRolandAcresMobileHomeParkwassupportedbymaterialevidence.   ` Undertherecorddevelopedinthiscase,ourscopeofreviewundercommonlawwritofcertiorariislimitedtodeterminingwhethertheadministrativecommissionhasactedwithoutmaterialevidencetosupportitsdecision.SeeWattsv.
