X XThethirdpartytortfeasor,JimmyGotcherandSpringfieldOfficeMachines& Z PrintingfiledforbankruptcyunderChapter11sixdayspriortothetrialwithDoss.On @ October27,1997,asettlementwasreachedbetweenthePlaintiffandGotcher,foratotal &v paymentof$60,000.FarmersInsuranceExchangepaiditspolicylimitof$25,000while  \ theremaining$35,000waspaidbysomecombinationoftheGotchersandSpringfield B Printing.Asaresultofthissettlement,PlaintiffexecutedaReleaseandanOrderof ( CompromiseandSettlementforeverreleasingthethirdpartytortfeasorfromany  liabilityarisingfromtheApril8,1993accidentanddismissingthetortclaimwith  prejudice.ThebankruptcypetitionsofJimmyGotcherandSpringfieldOfficeMachines   &PrintingwereultimatelydismissedbyOrderoftheU.S.BankruptcyCourton p! "$r# Cas.Co.ofReading,Pennsylvania,584S.W.2d200at203(Tenn.1979).Thecourtsof %X $ Tennesseeallowaninsurertoclaimsubrogationunderthemedicalpaymentprovisions %>!% ofitspolicy.Wilsonv.TennesseeFarmersMutualInsuranceCompany,411S.W.2d699 &$"& (1966).Thepublicpolicyofinsurancecontemplatesthatinsurancecarriersshallhaveall ' #' rightsofrecoveryagainstthetortfeasorthattheinsuredwouldhaveuptotheamount (#( paidbytheinsurer.TennesseeFarmersreservedarightofsubrogationthroughtheterms )$) oftheinsurancepolicyandenjoyedidenticalrightstothoseofDoss.Thus,theinsured l*%* extinguishedtherightsofTennesseeFarmersundertheirclaimforsubrogationwhenshe R+&+  relinquishedherrightsthroughtheexecutionoftheReleaseandtheOrderof 8,', CompromiseandSettlement.McGeev.CountyofWilson,574S.W.2d744at747  (Tenn.App.1978). However,Appelleecorrectlyrecitestheexceptiontothemadewholedoctrineunder   Tennesseelaw(espousedinanunreporteddecision)wheretheinsurerdidnotparticipate p!  inthesettlementnegotiationssurroundingthetortclaimanddidnotwaivetheirrightof V"! subrogation.
