InMay1995,FletcherfiledacomplaintforfraudagainstCampbell.TheessenceofFletchersfraudclaimwasthatCampbell,Fletchersformerattorney,testifieduntruthfullyataDecember1992hearingheldonFletcherspetitionforpostconvictionreliefinacriminalcase &   ׀andthat,relyinguponthesemisrepresentations,thecriminalcourtjudgehearingthecasedeniedFletcherspetition. Campbellrespondedtothecomplaintbyfilingamotiontodismissinwhichheassertedthatthecomplaintwasbarredbythestatuteoflimitations,thattheallegationsinthecomplaintdidnotstateanactionableclaimforfraud,andthatthecomplaintfailedtostateaclaimuponwhichreliefcouldbegranted. Findingthatthemotiontodismisswaswelltaken,thetrialcourtgrantedthemotionanddismissedFletcherscomplaint.Onappeal,Fletcherpresentsthefollowingissuesforreview,whichwehaverestatedforpurposesofclarity:8  1.WhetherthetrialcourterredindismissingFletcherscomplaintbaseduponthedefenseofthestatuteoflimitations.8  2.WhetherthetrialcourterredindismissingFletcherscomplaintforfailuretostateaclaimuponwhichreliefcouldbegranted. Weconcludethatresolutionofthesecondissueisdispositiveandaffirm.Inordertostateaclaimforfraudulentmisrepresentation,theplaintiffmustallege, interalia , thattheplaintiffreasonablyreliedonthemisrepresentationandsuffereddamage. Stacksv.Saunders ,812S.W.2d587,592(Tenn.App.1990); accord  MetropolitanGovtv.McKinney ,852S.W.2d233,237(Tenn.App.1992); Lambdinv.Garland ,723S.W.2d953,956(Tenn.App.1986); Williamsv.VanHersh ,578S.W.2d373,376(Tenn.App.1978).Here,Fletcherfailedtostateaclaimforfraudulentmisrepresentationbecause,althoughFletcherallegedthathewasdamagedbyCampbellsrepresentations,Fletcherfailedtoallegethatheactuallyreliedonthestatements.Rather,FletcherscomplaintallegedthathewasdamagedbecauseofthecriminalcourtsrelianceonFletchersstatements. Thiscaseisanalogousto Deedv.Condrell ,568N.Y.S.2d679(N.Y.Sup.Ct.), affd ,579N.Y.S.2d930(N.Y.App.Div.1991).There,theplaintiffsuedacourtappointedpsychologistforfraudulentmisrepresentationafteracourt,relyingonthepsychologistsrecommendations,awardedsolecustodyoftheplaintiffschildtotheplaintiffsformerhusband.Thebasisoftheplaintiffsfraudclaimwasthatthepsychologisthadmisrepresentedhisproficiencyinchildcustodycases.Initsopiniongrantingthepsychologistsmotiontodismiss,thecourtreasonedthat:8 Although[thecomplaint]aversthatdefendantmisrepresentedhisproficiencyinchildcustodycasesitotherwisedoesnotappearthat[plaintiffs]relianceontheseallegedmisrepresentationsinjuredplaintiff....theonlyinjuryallegedinthiscaserelatestotheentryof[the]custodyorder. Inthepresentcase,thecomplaintallegedthatCampbellmadecertainmisrepresentationswhichdamagedFletcher.Thecomplaint,however,failedtoallegethatFletcherrelieduponthestatementstohisdetriment.Asin Deedv.Condrell ,thecourtissuingthedetrimentalorder,andnottheplaintiff,reliedonthestatements.Underthesecircumstances,Fletcherscomplainthasfailedtostateacauseofactionuponwhichreliefcanbegranted.
