In1985,theJuvenileCourtofShelbyCountyissuedpaternityordersholdingthatPlaintiff/AppellantCharlesG.Fossett( Fossett)wasthefatheroftwominorchildrenbytwodifferentmothers.Atthetime,bothmotherswerereceivingAidtoFamiliesWithDependentChildren( AFDC)fromtheTennesseeDepartmentofHumanServices( TDHS).FossettwasorderedtopaychildsupporttotheJuvenileCourt.MostofthesepaymentswereforwardedtoTDHStorepayAFDCpaymentsmadetothemotherspursuanttoTennesseeCodeAnnotated713124.(Supp.1996) In1993,bloodtestsindicatedthatFossettwasnotthefatherofthechildren.Consequently,in1994,theJuvenileCourtissuedanordersettingasideitspreviouspaternityordersandreleasingFossettfromhischildsupportobligations.FossettthenfiledacomplaintwiththeTennesseeClaimsCommissionagainsttheStateofTennessee( State),seekingreimbursementofthepastchildsupportpayments. Inresponse,theStatefiledwiththeClaimsCommissionamotiontodismissunderRule12oftheTennesseeRulesofCivilProcedure,assertingthattheClaimsCommissionlackedjurisdictionovertheplaintiffsclaim.OnJanuary13,1997,theClaimsCommissionissuedanordergrantingtheStatesmotiontodismiss.TheCommissionconcludedthatitlackedsubjectmatterjurisdictionsincetherewasnospecificstatutoryexceptiontosovereignimmunityfortheclaimsassertedinthislawsuit.Fossettnowappealsthedismissal. Onappeal,FossettcontendsthattheCommissionerredinrulingthatitdidnothavejurisdiction.Fossettfurtherassertsthat,intheeventthattheCommissiondidnothavejurisdiction,thecaseshouldhavebeentransferredtoChanceryCourt. InconsideringaRule12motiontodismiss, courtsshouldconstruethecomplaintliberallyinfavoroftheplaintiff,takingallallegationsoffactthereinastrue. Cookv.SpinnakersofRivergate,Inc., 878S.W.2d934,938(Tenn.1994).Suchamotionwillbedenied unlessitappearsthattheplaintiffcanprovenosetoffactsinsupportof[his]claimthatwouldentitle[him]torelief. Id.  FossettfirstallegesthattheClaimsCommissionhadjurisdictiontohearthecase.CitingTennesseeCodeAnnotated713124 and98307(Supp.1997),FossettmaintainsthatitwasimproperfortheCommissiontodismisshisaction.Section713124setsforththeassignmenttotheStateofthemothersrighttoreceivesupport.ItcontainsnoprovisiongrantingtheClaimsCommissionjurisdictionoverclaimsforreimbursementforsupportpayments.Section98307setsforththecategoriesofclaimsoverwhichtheClaimsCommissionhasjurisdiction. UndertheTennesseeConstitution,claims maybebroughtagainsttheStateinsuchmannerandinsuchcourtsastheLegislaturemaybylawdirect.Tenn.Const.art.I,𛀜17.Thelegislature,inturn,enactedTennesseeCodeAnnotated2013102(a),whichstates:8 (a)Nocourtinthestateshallhaveanypower,jurisdiction,orauthoritytoentertainanysuitagainstthestate,oragainstanyofficerofthestateactingbyauthorityofthestate,withaviewtoreachthestate,itstreasury,funds,orproperty,andallsuchsuitsshallbedismissedastothestateorsuchofficers,onmotion,plea,ordemurrerofthelawofficerofthestate,orcounselemployedforthestate.Tenn.CodeAnn.2013102(a)  (1994).  Nevertheless,thelegislaturehasauthorizedsometypesofsuitsformonetarydamagesagainsttheState. See Tenn.CodeAnn.98301et.seq . (Supp.1997).FossettcontendsthatauthorizationforhissuitissetforthinSection98307(a)(1)(F).ThisprovisionstatesthattheClaimsCommissionhasjurisdictionformonetaryclaimsagainsttheStatebasedonthe [n]egligentcare,custodyorcontrolofpersonalproperty. Id. FossettarguesthatsincehischildsupportpaymentswereassignedtoTDHSunderTennesseeCodeAnnotated713124,theStateissubrogatedtotheinterestsoftherecipients.Fossettthenreasonsthattherewasanegligenttakingofhispersonalproperty,asaresultoftherecipientsuntruthfulnessregardinghisallegedpaternity. TennesseecourtshavestrictlyconstruedstatutesauthorizingtheStatetobesued.In BeareCo.v.Olsen, 711S.W.2d603,605(Tenn.1986),theSupremeCourtheld:8 InconstruingArt.I,17thisCourthasheldthatstatuteswhichpermitsuitsagainstthestateundertheauthorityofthisprovisionareinderogationofthestatesinherentexemptionfromsuitandmustbestrictlyconstrued.Inaddition,thejurisdictiongrantedundersuchstatutescannotbeenlargedbyimplication.(citationsomitted).Therefore,thestatutoryexceptionstosovereignimmunitycitedbyFossettmustbestrictlyconstrued. InreviewingSection98307(a)(1)(F),itisclearthattheStatesconductdidnotconstitutethe care, custody,or controlof personalproperty.Therefore,theCommissioncorrectlyconcludedthatitlackedjurisdictionovertheplaintiffsclaim. FossettalsoallegesthattheCommissionerredbynottransferringthecasetoChanceryCourt.FossettassertsthattheCommissionerretainedthisoptionpursuanttostatute  6   כ anderredbynotexercisingthisoption.However,therecorddoesnotindicatethatFossettrequestedatransfer.Therefore,thisissuewillnotbeconsideredonappeal.
