OnJuly1,1996thechancellorgrantedDavidEarlFranksabedandboarddivorcefromPetraFranksonthegroundofinappropriatemaritalconduct.Mr.Frankswasalsoawardedcustodyofthepartiesthreeminorchildren.  OnDecember18,1996Mrs.Frankspetitionedthecourtforachangeofcustody,allegingasignificantchangeofcircumstancessincetheoriginalorder.ThepetitionallegedthatMr.Frankshadexposedthechildrentopornographictapesandthatheandhisparentshaddisciplinedthechildrenininappropriateways.  Inafurtherpleadingstyled PlaintiffsOutlineofIssuesandWitnesses,Mrs.FranksallegedthatthechildrenwerebeingneglectedbyMr.Franks,specificallybyfailingtotreataskinconditionsufferedbyallthree;thatMr.Franksandhisparentsslappedthechildrenandusedaflyswattertospanktheyoungestchild;thattheoldestchild,sevenyearoldGabriella,stilltakesbathswithherfather;thatthelivingconditionsinNashvillewhereMr.Frankshadrelocatedwereunsuitable;thatMr.Franksparentssmokedinthehome;thatthechildrenweredirty;thatMr.FranksandhisparentshadconnectionswiththeKuKluxKlanandwereraisingthechildrenaswhitesupremacists;andthatsincethedivorcethechildrenwerelosingtheirfluencyintheGermanlanguage,Mrs.Franksnativetongue.  Afterhearingtheproof,thechancellordeniedthepetitionforachangeofcustody.Inhisoralfindingsfromthebenchthechancellorsaid:8 8  Well,intheinitialcasetheCourtsaidthatitwasinterestedinboththepartiesestablishingapermanentresidence.Wheretheyplantoliveandhowtheyplantocareforthemselvesandminorchildren.ItwasconcernedaboutMr.Frankscontinuedemployment.Thenitsaiditwouldsetthechildsupportatanotherhearing.8 8  SincethatMs.FrankshasraisedalitanyofcomplaintsaboutherhusbandandaverringthatmostoftheseareoccurringsincethebedandboarddecreeinJuneof1996.8 8  Onhercrossexamination,mostofthesecomplaintswerelargelydefusedortheysortofmergedintotheactivitiesofbothpartiesduringthemarriage.@ ***8 8 ...ItstheallAmericantragedy,butithasntchangedsincewehadahearinginJune.@ II.   Custodydecreesthathavebecomefinalareresjudicataonthefactsexistingatthetimeofthedecree.Nicholsv.Nichols,792S.W.2d713,715(1990).Therefore,toobtainachangeofcustodythepetitionermustallegeandprovethatcircumstanceshavechangedsincethepriororder.Doddv.Dodd,737ϜS.W.2d286,290(Tenn.App.1987).Factsthatcouldhavebeenanticipatedatthetimeoftheformerordermaynotbeusedtoestablishachangeofcircumstances.Hicksv.Hicks,176S.W.2d371,375(1943).  ThechancellorfoundasafactthatthelistofhorriblesMrs.Frankssetforthinherpleadingswereeithernotprovedorwerelitigatedintheformerhearing.WehaveexaminedtherecordfrombothhearingsandweconcludethatwhileMrs.Franksdidallegeachangeofcircumstances,shefailedtoproveit.Theevidencedoesnotpreponderateagainstthechancellorsfindingthatherproofdidnotsupporttheallegationsinherpleadings.SeeRule13(d),Tenn.R.ϜApp.Proc.Therefore,thechancellordidnotabusehisdiscretionindecidingthattheinterestsofthechildrenwouldbebestservedbyleavingthemwiththeirfather.Grayv.Gray,885S.W.2d353(Tenn.App.1994).
