àOn€August€29,€1997,€the€mother€filed€a€ð ðPetition€for€Order€of€Arrearage€and€MedicalÏExpenses€and€to€Amend€Decree.ðð€€The€petition€alleged€that€the€father€had€concealed€a€part€ofÏhis€earnings€resulting€in€an€inadequate€award€of€monthly€support,€that€support€has€been€paidÏonly€since€June,€1994,€and€that€the€mother€was€required€to€pay€an€unstated€amount€of€birthÏexpenses.€€The€petition€prayed€as€follows:ÌÒ àOn€November€8,€1995,€the€father€filed€an€answer€and€counter€petition€admittingÏprevious€proceedings€and€denying€all€other€facts€alleged€in€the€petition.€€Affirmatively,€theÏanswer€alleged€that€the€child€ð ðmay€have€been€adopted€by€the€motherððs€husband,€that€the€claimÏfor€arrearage€and€medical€expenses€was€barred€by€laches,€and€that€the€mother€had€interferedÏwith€visitation€by€concealing€the€identity€of€the€child€and€parentage€of€its€father€until€May€12,Ï1994.ÌÌà àThe€counter€complaint€alleged€that€the€child€prefers€to€reside€with€his€father.€€TheÏcounter€complaint€prayed€for€custody€and€child€support.ÌÌà àOn€July€16,€1997,€the€father€filed€a€petition€to€terminate€child€support€because€the€childÏhad€graduated€from€high€school,€had€lived€with€his€father€since€July€1996,€and€his€name€hadÏbeen€changed€from€Garrett€to€Gray.ÌÌà àOn€August€29,€1997,€the€Juvenile€Judge€entered€an€order€reading€as€follows:ÌÒ ¸ ÒÒ « ÒÓÓà àThis€cause€came€on€to€be€heard€before€theÏHonorable€Barry€Brown,€Judge,€upon€the€Petition€ofÏYvette€Garrett€seeking€to€have€a€judgment€of€arrearage€inÏchild€support€adjudicated€€against€the€Respondent€JamesÏGray.€€The€Court€declined€to€conduct€an€evidentiary€hearingÏand€the€parties€stipulated€that€if€called€to€testify€the€partiesÏwould€have€testified€as€follows:ÌÌà àThat€the€Respondent€James€Gray€had€beenÏadjudicated€the€father€of€the€minor€child€Shelton€on€the€11thÏday€of€May,€1994€and€was€ordered€to€pay€the€sum€ofÏ$530.00€being€21%€of€his€net€salary€of€$3,466.00€perÏmonth€in€accordance€with€the€guidelines.€€The€Court€at€thatÏtime€reserved€the€issue€of€arrearage€in€child€support€to€aÏlater€hearing.ÌÌà àThat€prior€to€filing€the€original€Petition€in€this€caseÏthe€mother€had€filed€no€Petition€for€enforcement€of€childÏsupport.ÌÌà àThat€in€1979€the€Respondent€was€on€active€duty€asÏa€staff€sergeant€in€the€U.S.€Army.€€That€from€1980€to€1981Ïthe€Respondent€was€employed€full€time€with€the€MemphisÏPolice€Department,€and€from€1981€to€present€he€has€beenÏemployed€by€the€Shelby€County€Sheriffs€Department€whereÏhe€is€now€an€administrative€assistant€to€the€ProcessingÏCommissioner.ÌÌà àThat€in€1994€the€Respondentððs€monthly€income€wasÏ$3,466.00.€€In€1993€his€monthly€income€was€$3,303.42Ïand€in€1992€his€monthly€income€was€$2,845.00.€€TheÏRespondent€was€unable€to€provide€proof€of€income€otherÏthan€above€but€at€no€time€during€the€life€of€the€child€wasÏRespondent€not€fully€employed€at€a€salary€at€or€above€theÏminimum€wage€and€that€the€Respondent€had€at€all€timesÏmedical€insurance€available€for€the€child.ÌÌà àThat€the€mother€has€no€records€to€support€her€claimÏfor€necessities€for€the€child€but€would€have€testified€that€theÏcost€of€the€birth€of€the€child€was€$5,000.00€and€that€theÏcost€of€necessities€for€the€child€from€1979€to€1981€wasÏ$175.00€per€month,€1982€was€$310.00€per€month,€1983€toÏ1994€was€$330.00€per€month.ÌÌà àThe€Court€finds:ÌÌà àThat€due€to€the€motherððs€failure€to€seek€childÏsupport€prior€to€1994€the€Court€should€mitigate€theÏarrearage€and€that€the€father€should€pay€to€the€mother€theÏtotal€sum€of€$850.00€as€child€support€arrearage.€€The€CourtÏfurther€finds:ÌÌà àThat€the€child€will€become€18€on€the€18th€day€ofÏAugust,€1997€and€has€graduated€from€high€school€andÏtherefore€the€fatherððs€obligation€for€payment€of€childÏsupport€should€terminate.ÌÌà àIt€is€thereby€ORDERED,€ADJUDGED€ANDÏDECREED€that€Petitioner,€Yvette€Garrett,€is€awardedÏ$850.00€for€child€support€arrearage.ÌÌà àIt€is€further€ORDERED,€ADJUDGED€ANDÏDECREED€that€support€payments€shall€terminate€as€ofÏAugust€1,€1997.ÌÌà àThe€record€received€by€this€Court€contains€no€transcript€or€statement€of€the€evidence.€ÏHowever,€the€judgment€of€the€Juvenile€Court,€quoted€above,€does€contain€some€findings€ofÏfacts.ÌÌà àAppellant€argues€that€she€is€entitled€to€$50,272.00€arrears€child€support€from€the€birthÏof€the€child€to€the€date€of€the€order€of€patenrity€and€beginning€of€support€payments.€€TheÏincome€of€the€father€during€this€period€was€stipulated€and€counsel€stated€to€the€Court€that€theÏmother€would€testify€that€the€cost€of€birth€was€$5,000.00€and€that€the€cost€of€necessities€for€theÏœchild›€was€from€$175€to€$330€per€month€during€this€period.ÌÌà àThe€order€of€the€Trial€Court€stated€that€the€award€to€the€mother€should€be€mitigated€toÏ$850.00.ÌÌà àIn€òòState€ex€rel.€Coleman€v.€Clayóó,€Tenn.€1991,€805€S.W.2d€752,€the€parties€hadÏintimate€relations€for€two€years.€€When€informed€of€the€pregnancy€he€first€deniedÏresponsibility,€but€later€contributed€some€support€in€kind€and€promised€regular€support€but€didÏnot€perform.€€The€paternity€suit€was€filed€when€the€child€was€14€years€old.€€The€father€evadedÏprocess€for€2€years,€and€judgment€was€not€rendered€until€the€child€was€16.€€The€SupremeÏCourt€remanded€to€the€Juvenile€Court€for€revision€and€said:ÌÒ ¸ ÒÒ ` ÒÓÓà àThe€Court€of€Appeals,€relying€upon€emphasizedÏlanguage€in€ðð€36„2„108,€held€correctly€that€the€fatherððsÏresponsibility€for€support€of€a€child€of€his€born€out€ofÏwedlock€arises€at€the€date€of€the€childððs€birth.€€Because€theÏstatute€also€permits€the€juvenile€court€to€make€a€retroactiveÏaward€for€expenses€incurred€in€the€support€of€the€child€priorÏto€the€entry€of€the€paternity€decree,€such€an€award€can€beÏmade€back€to€the€date€of€the€childððs€birth,€under€appropriateÏcircumstances.€€Obviously,€the€juvenile€judge€has€broadÏdiscretion€to€determine€the€amount€of€such€a€retroactiveÏaward,€as€well€as€the€manner€in€which€it€is€to€be€paid.ÌÓ  Ó„€„€„€„ÌÓ  Óà àWhat€the€juvenile€judge€lacks€is€discretion€to€limit€theÏfatherððs€liability€for€child€support€in€an€arbitrary€fashion€thatÏis€not€consistent€with€the€provisions€in€T.C.A.€ðð€36„2„102Ïand€Ì€ðð€36„2„108.ÌÓ  Ó„€„€„€„ÌÓ  Óà àWe€further€agree€that€the€statute€gives€the€juvenileÏcourt€the€discretion€to€order€a€retroactive€support€award€backÏto€that€date,€the€amount€and€method€of€payment€to€beÏdetermined€by€juvenile€judge€in€light€of€the€circumstances€ofÏthe€case€and€consistent€with€the€standards€which€normallyÏgovern€the€issuance€of€child€support€orders.ÌÓ  Ó„€„€„€„ÌÓ  Óà àAs€did€the€Court€of€Appeals,€we€also€reject€theÏdefendantððs€argument€that€Mary€Coleman€should€be€deniedÏrecovery€because€she€is€guilty€of€laches.€€In€order€toÏestablish€such€a€bar,€more€than€mere€delay€must€be€shown.€ÏòòMurphy€v.€Emeryóó,€629€S.W.2d€895,€897„98€(Tenn.€1982).€ÍIndeed,€the€touchstone€of€laches€is€prejudice€to€the€otherÏparty,€and€here,€no€actual€prejudice€of€the€kind€contemplatedÏby€law€has€been€demonstrated€by€the€defendant.€€We€doÏfind,€however,€that€the€mother€has€waived€recovery€forÏexpensese€incurred€in€connection€with€her€pregnancy€andÏKristiððs€birth,€since€no€request€for€such€reimbursement€wasÏmade,€and€there€is€no€proof€in€the€record€to€support€such€anÏaward.ÌÒ  ÒÒ „ ÒÓ  ÓÓÓÌÓ  Óà àThe€foregoing€is€controlling€upon€the€facts€stated€therein.€€However,€in€the€presentÏappeal,€the€record€contains€no€transcript€or€statement€of€the€evidence€from€which€this€CourtÏcould€find€facts€comparable€to€those€recited€in€the€cited€opinion.€€This€Court€is€therefore€not€inÏposition€to€revise€or€reverse€the€discretion€of€the€Juvenile€Judge€which€was€repeatedlyÏrecognized€in€the€quoted€opinion€of€the€Supreme€Court.ÌÓ ðthe€supportÏof€the€child€prior€to€the€making€of€the€order€of€paternity€and€support,ðð€and€Tenn.€Code€Ann.€œÌðð›€36„2„108(d)€requires€that€these€decisions€must€be€made€in€accordance€with€the€child€supportÏguidelines.€€While€decisions€concerning€child€support€between€the€time€of€birth€and€the€time€ofÏfiling€the€paternity€petition€are€discretionary,€see€òòState€ex€rel.€Coleman€v.€Clayóó,€805€S.W.2dÏ752,€755€(Tenn.€1991);€òòBarabas€v.€Rogersóó,€868€S.W.2d€283,€288€(Tenn.€Ct.€App.€1993),Ïthese€decisions€cannot€limit€the€parentððs€liability€for€child€support€in€an€arbitrary€fashion.€€SeeÏòòState€ex€rel.€Coleman€v.€Clayóó,€805€S.W.2d€at€755.ÌÓ
