WilliamM.Goad,Jr.isincarceratedatthe_Riverbend_ԀMaximumSecurityInstitutionfollowingconvictionsinDavidsonCountyforarmedrobberyandassaultwithintenttocommitfirstdegreemurder_ 5   _ԀandinSumnerCountyforfirstdegreemurderandarmedrobbery. 6   ׀InAugust1989,Dr.AlphonseT._Pasipanodya_ԀperformedsurgeryonMr.Goadat_Meharry_Ԁ_Hubbard_ԀHospitaltorepairanepigastrichernia.Dr._Pasipanodya_ԀclosedMr.Goadsfasciawith_Ԝprolene_Ԁsuturesandthenclosedtheincisionwithsurgicalstaples.The_prolene_sutureswerepermanentandnonabsorbable,andDr._Pasipanodya_ԀintendedthemtoremaininMr.Goadsabdomeninaccordancewithacceptedmedicalpractice. InOctober1993,Mr.Goadnoticedthesuturesimmediatelybeneathhisskinandbeganexperiencingdiscomfortintheareaofhisherniaoperation.Dr.FrankThomasexaminedhimintheprisoninfirmaryinNovember1993andorderedseveralmedicaltests.Larry_Woodlee_,aphysiciansassistantworkingattheprison,examinedMr.GoadagaininearlyJanuary1994andreferredhimtoanotherphysicianforadditionalmedicaltreatment.Severalweekslater,Mr.GoadfiledaprosecomplaintintheChanceryCourtforDavidsonCountyagainstDrs._Pasipanodya_ԀandThomas,Mr._Woodlee_,and_Meharry_Ԁ_Hubbard_ԀHospitalallegingthattheyhadfailedtoexerciseduecareanddidnotprovidehimwithpropermedicaltreatment.ThechancerycourtlatertransferredthecasetotheCircuitCourtforDavidsonCounty. Mr._Woodlee_ԀmovedforasummaryjudgmentinFebruary1995.ThetrialcourtenteredanorderonMarch17,1995,dismissingMr.GoadsclaimsagainstMr._Woodlee_ԀandincludedintheorderaTenn.R.Civ.P.54.02certificationthattheorderwouldbedeemedfinal.Thereafter,_Meharry_Ԁ_Hubbard_ԀHospitalmovedforasummaryjudgment.OnJune19,1995,thetrialcourtenteredanordergranting_Meharry_Ԁ_Hubbard_ԀHospitalsmotionandcertifyingthatthisorderwouldalsobedeemedtobefinalunderTenn.R.Civ.P.54.02.Mr.GoadfiledanoticeofappealwiththetrialcourtonJuly24,1995,statingthathedesiredtoappealfromthetrialcourtsJune19,1995order.@ II.  ThisappealinvolvesthefateofMr.GoadsclaimsagainstMr._Woodlee_and_Meharry_Ԁ_Hubbard_ԀHospital. 7   ׀EventhoughMr.Goadtakesissuewiththesummarydismissaloftheseclaims,wecannotreachthemeritsofhisargumentsbecausehehasnotcompliedwiththemandatoryrequirementsofTenn.R.App.P.3(f)and4(a). TheTennesseeRulesofAppellateProceduregovernappealstothiscourt.Tenn.R.App.P.3(f)requiresappellantstodesignatethe judgmentfromwhichreliefissought,andTenn.R.App.P.4(a)requiresthatnoticesofappealmustbe filedwithandreceivedbytheclerkofthetrialcourtwithin30daysafterthedateofentryofthejudgmentappealedfrom.Tenn.R.App.P.3(f)limitsthescopeofappellatereviewtothejudgmentororderdesignatedbythenotice;seeHallv.Hall,772S.W.2d432,43536(Tenn.Ct.App.1989);while,Tenn.R.App.P.4(a) 8    establishesamandatory,jurisdictionaltimelimitforfilinganoticeofappealthatcannotbewaivedorextended.SeeJeffersonv._Pneumo_ԀServs.Corp.,699S.W.2d181,184(Tenn.Ct.App.1985);JohnBarb,Inc.v.UnderwritersatLloydsofLondon,653S.W.2d422,424(Tenn.Ct.App.1983).IncarceratedproselitigantsarenotentitledtorelieffromTenn.R.App.P.4(a)smandatoryrequirements.SeeGoodwinv._Hendersonville_ԀPoliceDept,App.No.01A019509CH00423,1997WL576340,at*3(Tenn.Ct.App.Sept.17,1997)(Tenn.R.App.P.11applicationpending). Mr.GoadhasnotproperlyperfectedanappealfromtheMarch17,1995ordersummarilydismissinghisclaimsagainstMr._Woodlee_Ԁfortworeasons.First,hisnoticeofappealidentifiesonlythetrialcourtsJune19,1995orderanddoesnotmentiontheMarch17,1995order.Thus,Tenn.R.App.P.3(f)limitshisappealtotheJune19,1995order.Second,sincethetrialcourtdesignatedtheMarch17,1995orderasfinalinaccordancewithTenn.R.Civ.P.54.02,Mr.GoadshouldhavefiledhisnoticeofappealwithinthirtydaysaftertheentryoftheMarch17,1995order.HisJuly24,1995noticeofappeal,totheextentitcouldapplytotheorderdismissingMr.GoadsclaimsagainstMr._Woodlee_,wasfiledovertwomonthstoolate. Mr.Goadsappealfromthesummarydismissalofhisclaimsagainst_Meharry_Ԁ_Hubbard_ԀHospitalmustmeetthesamefate.EventhoughhespecificallydesignatedtheJune19,1995judgmentastheonehedesiredtoappealfrom,hedidnotfilehisnoticeofappealwiththeclerkofthetrialcourtuntilJuly24,1995.SincethetrialcourtclerkreceivedMr.GoadsnoticeofappealfromtheJune19,1995judgmentfivedaysaftertheexpirationofTenn.R.App.P.4(a)sfilingdeadline,thenoticeofappealwasfiledtoolate.@ III.  Wedonotfavordismissingproselitigantsappealsonwhatmightappeartobetechnicalities.However,whilepartieswhochoosetorepresentthemselvesareentitledtofairandequaltreatment,theyarenotentitledtoshifttheburdenoflitigatingtheircasetothecourts,seeDozierv.FordMotorCo.,702F.2d1189,1194(D.C.Cir.1983),ortobeexcusedfromcomplyingwiththesamesubstantiveandproceduralrequirementsthatotherrepresentedpartiesmustadhereto.SeeIrvinv.CityofClarksville,767S.W.2d649,652(Tenn.Ct.App.1988).Accordingly,they    mustactwithinthetimeperiodsprovidedbytheapplicablestatutesandrulesinordertohavetheircasesconsidered.SeeWilliams_Guice_Ԁv.BoardofEduc.,45F.3d161,164(7thCir.1995);Kelleyv.Secretary,_UnitedStatesDept_ԀofLabor,812F.2d1378,1380(Fed.Cir.1987).
