ÐÌÓ  Óò òÌÌÌChild€CustodyÐ K'›"& Їó óÓ  Óà  àMother€asserts€that€the€trial€court€should€have€awarded€her€primary€parenting€time,€whileÐ ° ÐFather€should€have€received€visitation€every€other€weekend,€one„half€of€the€holidays,€and€one„halfÐ ™é Ðof€each€summer.€€In€her€brief,€and€during€oral€argument,€Mother€argued€that€ð ð[t]he€trial€court€failedÐ ‚Ò Ðto€compare€the€fitness€of€the€two€parties€and€then€decide€which€parent,€under€all€the€circumstances,Ð k» Ðwas€comparatively€more€suited€to€have€custody/parenting€time€of€the€children.ðð€Mother€argues€thatÐ T¤ Ðthe€court€below€failed€to€consider€the€statutory€factors€in€section€36„6„106(a),€specifically€sectionÐ =  Ð36„6„106(a)(5)€which€requires€the€court€to€consider€the€mental€health€of€the€parents.€€In€support€ofÐ & v Ðher€argument,€Mother€asserts€that€the€trial€courtððs€final€divorce€decree€makes€no€findings€of€fact,€butÐ  _ Ðmerely€states€that€ð ð[t]he€fatherððs€desire€is€to€share€an€equal€part€in€the€childrensðð€lives€with€theÐ ø H Ðmother€and€the€court€sees€no€reason€why€that€should€not€be€done.ðð€Ð á 1  ÐÌà  àMother€also€argues€that€this€Court€should€ð ðpresume€that€Mr.€Golightlyððs€mental€healthÐ ³  Ðrecords€would€not€reflect€favorable€[sic]€on€him€since€he€was€unwilling€to€allow€the€court€to€considerÐ œì  Ðthem.ðð€€Mother€argues€that€Fatherððs€assertion€of€privilege€found€in€section€63„23„107€of€theÐ …Õ  ÐTennessee€Code,€to€prevent€the€social€workers€from€disclosing€communications€made€duringÐ n¾  Ðtherapy,€constitutes€additional€evidence€that€the€court€below€failed€to€consider€Fatherððs€mental€healthÐ W§  Ðwhen€making€its€custody€determination.׃×Ý ƒ#ÃÝòòÚ  Ú7Ú  ÚóóÝ  Ý×  ׀Р@ Ðà  à¹Ó  Óà  àThe€legislature€has€provided€that€the€trial€court€must€consider€the€following€factors€whenÐ b Ðmaking€a€custody€determination:Ð ûK ÐÌÒ` °ÒÒ` °ÒÓ  Óà ¸ à(a)€In€a€suit€for€annulment,€divorce,€separate€maintenance,€orÐ Í Ðin€any€other€proceeding€requiring€the€court€to€make€a€custodyÐ ¶ Ðdetermination€regarding€a€minor€child,€such€determination€shall€beÐ Ÿï Ðmade€upon€the€basis€of€the€best€interest€of€the€child.€€The€court€shallÐ ˆØ Ðconsider€all€relevant€factors€including€the€following€whereÐ qÁ Ðapplicable:Ð Zª Ðà ¸ à(1)€The€love,€affection€and€emotional€ties€existing€betweenÐ C“ Ðthe€parents€and€child;€Ð ,| Ðà ¸ à(2)€The€disposition€of€the€parents€to€provide€the€child€withÐ e Ðfood,€clothing,€medical€care,€education€and€other€necessary€care€andÐ þN Ðthe€degree€to€which€a€parent€has€been€the€primary€caregiver;Ð ç 7 Ðà ¸ à(3)€The€importance€of€continuity€in€the€childððs€life€and€theÐ Ð!
