Ðfindings,€this€Court€must€affirm€the€decision€of€the€trial€court€awarding€an€absolute€divorce€toÐ ¥#õ" ÐPlaintiff€on€the€ground€of€inappropriate€marital€conduct.€€Tenn.€R.€App.€Proc.€13(d);€òòHobbsóó,€987Ð Ž$Þ# ÐS.W.2d€at€846.€€Ð w%Ç $ ÐÌà  àOur€review€of€the€record€does€not€indicate€that€the€evidence€preponderates€against€the€trialÐ I'™"& Ðcourt's€finding€that€Plaintiff€carried€the€burden€of€proving€her€entitlement€to€a€divorce€on€the€groundÐ 2(‚#' Ðof€inappropriate€marital€conduct.€€In€the€statement€of€the€evidence€articulated€by€the€Plaintiff€andÐ ° Ðapproved€by€the€trial€court,€there€are€statements€that€Defendant€was€violent€during€the€marriage€andÐ ™é Ðwas,€at€one€point,€arrested€by€the€Germantown€Police€Department€for€domestic€violence.€€ThoughÐ ‚Ò ÐDefendant€denied€he€committed€such€offenses€against€Plaintiff€in€his€answer,€"[t]he€findings€of€theÐ k» Ðtrier€of€fact€dependent€upon€the€credibility€of€the€witnesses€should€be€accorded€great€weight€by€theÐ T¤ Ðappellate€court."€€òòHobbsóó,€987€S.W.2d€at€847€(citing€òòTown€of€Alamo€v.€Forcum„James€Co.óó,€327Ð =  ÐS.W.2d€47€(Tenn.€1959);€òòSisk€v.€Valley€Forge€Ins.€Co.óó,€640€S.W.2d€844€(Tenn.€Ct.€App.€1982)).€Ð & v ÐGiven€the€state€of€the€record€presented€for€our€review,€there€is€no€evidence€to€contradict€the€findingÐ  _ Ðof€the€trial€court€other€than€Defendantððs€denial.€€Therefore,€this€Court€affirms€the€trial€court'sÐ ø H Ðdecision€awarding€Plaintiff€an€absolute€divorce€from€Defendant.Ð á 1  ÐÌà  àIn€addition,€there€is€also€insufficient€evidence€to€overturn€the€trial€court's€finding€thatÐ ³  ÐDefendant€should€not€be€awarded€a€divorce€from€Plaintiff€on€the€ground€of€inappropriate€maritalÐ œì  Ðconduct.€€The€only€conduct€Defendant€alleges€that€could€be€considered€grounds€for€a€divorce€wouldÐ …Õ  Ðbe€Plaintiff's€"secretive"€use€of€credit€cards,€which€increased€the€parties'€debt.€€However,€there€is€noÐ n¾  Ðevidence€that€such€conduct€caused€pain,€anguish€or€distress€to€Defendant€or€that€it€renderedÐ W§  Ðcohabitation€improper,€unendurable,€intolerable€or€unacceptable.€€òòBolin€v.€Bolinóó,€99€S.W.3d€102,€105Ð @ Ð(Tenn.€Ct.€App.€2002)€(quoting€òòEarls€v.€Earlsóó,€42€S.W.3d€877,€892€(Tenn.€Ct.€App.€2000)€(Cottrell,Ð )y ÐJ.,€concurring));€òòsee€Flanagan€v.€Flanaganóó,€1997€Tenn.€App.€LEXIS€453,€at€*5„6€(Tenn.€Ct.€App.Ð b Ð1997).€€Therefore,€this€Court€affirms€the€trial€court's€decision€awarding€an€absolute€divorce€on€theÐ ûK Ðground€of€inappropriate€marital€conduct€to€Plaintiff€and€denying€award€of€a€divorce€on€the€sameÐ ä4 Ðground€to€Defendant.Ð Í ÐÌÓ  Óò òProperty€Divisionó óÐ Ÿï ÐÌÓ  Óà  àDefendant€next€argues€that€the€property€division€by€the€trial€court€was€inequitable€andÐ r Ðimproper.€€In€reviewing€a€trial€court's€division€of€marital€assets,€we€are€mindful€that€the€lower€courtÐ [« Ðis€vested€with€broad€discretion€in€dividing€the€marital€property.€€òòBatson€v.€Batsonóó,€769€S.W.2d€849,Ð D” Ð859€(Tenn.€Ct.€App.€1988);€òòFlanaganóó,€1997€Tenn.€App.€LEXIS€453,€at€*10.€€In€this€instance,Ð -} ÐDefendant€appeals€the€property€division€of€the€marital€home,€the€parties'€retirement€and€investmentÐ f Ðaccounts,€and€the€credit€card€debt€incurred€by€Plaintiff.Ð ÿO ÐÌà  àBecause€a€mortgage€was€taken€out€on€the€parties'€marital€home€to€pay€off€the€credit€cardÐ Ñ!!  Ðdebt,€those€two€items€may€be€addressed€together.€€From€the€final€divorce€decree,€it€appears€the€trialÐ º" ! Ðcourt€awarded€each€party€half€the€equity€in€the€martial€home,€which,€in€effect,€places€the€burden€ofÐ £#ó" Ðthe€credit€card€debt€equally€on€both€parties€since€the€home's€equity€is€reduced€by€the€mortgage€takenÐ Œ$Ü# Ðto€pay€the€debt.€€Defendant€contends€that,€because€Plaintiff€was€responsible€for€incurring€the€debt,Ð u%Å $ Ðshe€should€bear€the€entire€burden€of€paying€that€debt.€€However,€the€statement€of€the€evidenceÐ ^&®!% Ðapproved€by€the€trial€court€supports€the€conclusion€that€Plaintiff€used€a€credit€card€to€pay€for€herÐ G'—"& Ðliving€expenses€because€Defendant€would€not€provide€Plaintiff€with€any€money.€€We€find€no€errorÐ 0(€#' Ðor€abuse€of€discretion€with€this€property€division.Ð )i$( ÐÌà  àNext,€Defendant€argues€that€the€trial€court€improperly€handled€the€credit€card€debt€and€theÐ ë*;&* Ðmortgage€payments€on€the€home€given€that€the€parties€had€signed€an€agreement€with€each€otherÐ Ô+$'+ Ðdeciding€how€such€payments€would€be€divided.€€However,€it€appears€that€such€agreements€were€notÐ ° Ðentered€into€the€evidence€at€trial.€€The€scope€of€this€Court's€review€is€restricted€to€"facts€establishedÐ ™é Ðby€the€evidence€in€the€trial€court€and€set€forth€in€the€record€and€any€additional€facts€that€may€beÐ ‚Ò Ðjudicially€noticed€or€are€considered€pursuant€to€Rule€14."€€Tenn.€R.€App.€Proc.€13(c).€€Rule€14Ð k» Ðallows€this€Court€discretion€to€consider€òòpost„judgmentóó€facts.€€It€would€appear,€from€Defendant'sÐ T¤ Ðbrief,€that€such€agreements€were€entered€into€in€March€1997,€òòprioróó€to€any€divorce€decree€from€whichÐ =  Ðhe€appeals.€€Therefore,€because€these€agreements€cannot€be€judicially€noticed€and€were€neverÐ & v Ðintroduced€into€evidence€at€the€hearing,€this€Court€may€not€consider€them.Ð  _ ÐÌà  àFinally,€Defendant€argues€that€the€trial€court€erred€when€it€awarded€$14,000€of€his€retirementÐ á 1  Ðand€investment€account€to€Plaintiff,€while€awarding€him€nothing€from€Plaintiff's€retirement€accountÐ Ê   Ðwhich€was€valued€at€$17,000€according€to€the€statement€of€the€evidence.€€Tenn.€Code€Ann.€ðð€36„4„Ð ³  Ð121(b)(1)(B)€(2002)€states€that€"marital€property"€includes€"the€value€of€vested€and€unvestedÐ œì  Ðpension,€vested€and€unvested€stock€option€rights,€retirement€or€other€fringe€benefit€rights€relatingÐ …Õ  Ðto€employment€that€accrued€during€the€period€of€the€marriage."€€In€this€instance,€the€trial€courtÐ n¾  Ðawarded€Plaintiff€$14,000€from€Defendant's€retirement€and€investment€accounts€as€"her€fifty€percentÐ W§  Ðshare"€without€stating€whether€this€was€half€the€increase€in€value€or€whether€this€amount€was€offsetÐ @ Ðby€the€amount€of€Plaintiff's€retirement€account€to€which€Defendant€could€have€been€entitled.€€ItÐ )y Ðwould€appear€that€the€trial€court€was€attempting€to€divide€the€aggregate€amount€of€retirementÐ b Ðbenefits€equally€between€Plaintiff€and€Defendant.€€Plaintiff's€retirement€account€was€valued€atÐ ûK Ð$17,000€and€Defendant's€retirement€account€was€valued€at€approximately€$45,000.€€By€awardingÐ ä4 ÐPlaintiff€$14,000€from€Defendant's€retirement€account,€the€result€is€each€party€receives€$31,000€inÐ Í Ðretirement€benefits.€€While€this€may€be€the€most€equitable€division,€given€the€state€of€the€record€onÐ ¶ Ðappeal,€this€Court€is€unaware€of€whether€or€not€such€retirement€accounts€accrued€only€during€theÐ Ÿï Ðmarriage€or€whether€they€held€a€value€prior€to€the€marriage.€€The€answer€to€this€question€affects€theÐ ˆØ Ðclassification€of€the€accounts€as€"separate"€or€"marital"€property,€and,€therefore,€could€result€in€aÐ qÁ Ðdifferent€distribution€between€the€parties.€€For€these€reasons,€we€remand€this€portion€of€the€trialÐ Zª Ðcourt's€property€division€for€further€findings€consistent€with€this€opinion.Ð C“ ÐÓ  Óò òÌÌÌÌÌÌÌÌÌÌÌÌÌÌConclusionó óÐ ø*H&* ÐÐ â+2'+ ÐÓ  Óà  àFor€the€foregoing€reasons,€we€affirm€in€part€and€remand€this€case€to€the€Shelby€CountyÐ ° ÐCircuit€Court€for€further€findings€on€the€issue€of€the€division€of€the€parties'€retirement€accounts.€Ð ™é ÐCosts€are€taxed€one„half€to€Appellant,€Lucious€T.€Guinn,€Jr.,€and€his€surety,€and€one„half€toÐ ‚Ò ÐAppellee,€Gloria€J.€Guinn,€for€which€execution€may€issue€if€necessary.€Ô#†XÀ×XXX5†Q #ÔÔ#†¼Ÿá»XXÀ×# #ÔÔ€XÀ×X»¼ŸáÔÐ k» ÐÌÌÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð  _ Ðà  àà ` àà ¸ àà  àà h àà À àà  àALAN€E.€HIGHERS,€JUDGE
