AFFIRMED ANDREMANDED  +&&  4    <      D HERSCHELP.FRANKS,J.CONCUR:W.FRANKCRAWFORD,P.J.,W.S.ALANE.HIGHERS,J. 944 Ї@( OPINION   4  Inthisdivorceaction,theTrialJudgegrantedthewifeadivorce,   orderedthedefendanttopayalimonyintheamountof$400.00amonth,andchildsupportforonechildintheamountof$750.00,andattorneysfeesforthewifeintheamountof$1,634.67.HealsoorderedthehusbandtopaycertaindebtsoftheϜmarriage.Onappeal,thehusbandseeksareversalofthedecreeforalimony,paymentofthemaritaldebtsandattorneysfeestothewife.HealsoseeksareductionintheamountofchildsupportawardedbytheTrialJudge. 4  Thepartieshavebeenmarriedtwice,firstin1969,divorcedin1977andremarriedin1978,andseparatedneartheendof1993.Onechildatthetimeofthedivorcewasaminor,bornonAugust28,1981.Alsoatthetimeofthedivorce,thewifewasresidingatBrownsville,Tennessee,andthehusbandinCalifornia.Atthetimeofthedivorcethewifewasearningagrossmonthlyincomeof$1,560.00,andthehusbandwasnotemployed.Hehadahistoryofearninginexcessof$5,000.00permonth,andthewifetestifiedthatthemajorindebtednessofthepartieswasduetothehusbandspurchasesofanautomobile,furnitureanditemsforhispersonaluse. 4  TheTrialJudgesetthealimonyandchildsupportbasedonthehusbandsearningcapacity,whichisauthorizedbystatute.SeeTennesseeCode +%& Annotated365101etseq.Need,andtheabilitytopayaretheprincipalcriteriafor -'( awardingalimony.Lloydv.Lloyd,860S.W.2d409(Tenn.App.1993).Applyingthe /)* МfactorssetforthinTennesseeCode36-5101(d)forawardingalimony,wefindtherecordsupportstheTrialJudgesawardofalimony.Therelativeearningcapacityofthepartiesissubstantiallyunequal.Theeducationallevelofthepartiesissimilar,butthehusbandswork,experienceandtrainingissuperior.Thepartiesarethesameageandbothareingoodhealthandhadarelativelylongmarriage.TheTrialJudgefound 934 thehusbandtobeatfaultforthebreakupofthemarriage.Thewifetestifiedthatsheandherdaughterhadmonthlylivingexpensesinexcessof$2,700.00.Theawardofalimony2i23wa3swithintheTrialCourtsdiscretion,andwewillnotdisturbthisawardonappeal. 4  Afterjudgmentwasenteredawardingchildsupport,butbefore4it45thejudgment5becamefinal,thehusbandfiledamotiontoreconsiderandattachedaletterfromanemployerinCaliforniawhichstatesthatthehusbandhadbeenemployedwiththatcompanyandwouldbeearning$40,000.00peryear.Thehusbandofferednoevidenceatthetimethemotionwasheard,andtheTrialJudgeoverruledthemotion.Theawardofchildsupportisappropriateontheevidenceinthisrecord.TheevidencebeforetheTrialJudgeestablishedthatthehusbandhada earningcapacityinexcessof$5,000.00permonth,anditisappropriatefortheTrialJudgetouse6the6earningcapacityasagaugeforsettingsupport,unlessthespousecandemonstratethatheorshecannolongerearnthatincomethroughnofaultoftheirown.WeaffirmthejudgmentoftheTrialCourtontheissueofchildsupport.However,thehusbandisgrantedleavetoreapplyforareductionifhecandemonstrate,byapreponderanceoftheevidence,thathehasactedingoodfaithandcannotfindgainfulemploymentthatapproximatesinamountthehistoryofhispastearnings. 4  Finally,courtshavethediscretiontomakeawardstohelpaspousetopaylegalexpensesandcostsinadivorcecase.Foxv.Fox,657S.W.2d747,749 t,&& (Tenn.1983).Here,thewifelackedsufficientfundstopayherlegalexpenses.See |.(( Houghlandv.Houghland,844S.W.2d619,andshewouldeitherdepleteher 0** resources,orberequiredtoborrowmoneytopayherlegalbills.7̛ L  L 788SeeHarwellv. 2,, Harwell,612S.W.2d182,185(Ct.App.1980).Theamountoffeesandcostsis 4.. reasonableandtheawardwasaproperexerciseoftheTrialJudgesdiscretion.99:9t9::T:;heevidencedoesnotpreponderateagainsttheTrialCourtsfindings.T.R.A.P.Rule13(d).; :44  4  WeaffirmthejudgmentoftheTrialCourtfortheforegoingreasons,andremandwithcostoftheappealassessedtoappellant.Ӏ     #XX5SZ#5SXX 4    <     __________________________ $   4    <     HerschelP.Franks,J.CONCUR:___________________________W.FrankCrawford,P.J.___________________________AlanE.Highers,J.#XX5S0#
